The trade in papers marked with non-Latin characters :documents and history.

: The nine contributions in The Trade in Papers Marked with non-Latin Characters initiated by Anne Regourd (edition) approach global history through the paper trade. They cover, in addition to a paper used in 14th C Persia, papers used in Africa (Ethiopia, Nigeria, Tunisia) and Asia (the Ottoman Levant, Mecca, Persia, Russia, and Yemen) during the 19th-20th C. Primarily based on paper examination and quantitative data, the book invites us to treat papers as a source, and provides tools to determine the production of manuscripts in space and time for the area of interest. This methodology offers new insights on the competition between suppliers to the various markets particularly in respect of the emergence of import-export trading companies. Contributors are: Michaelle Biddle, Evyn Kropf, Anne Regourd, Francis Richard, Alice Shafi-Leblanc, Jan Just Witkam, Olga Yastrebova. Foreword by Anna-Grethe Rischel.

: "The articles in this volume focus on the legal, linguistic, historical and literary roles of Jewish women in the Islamic world of the Middle Ages. Drawing heavily on manuscript evidence from the Cairo Genizah, the authors examine the challenges involved in the identification and interpretation of women's letters from medieval Egypt, the registers of women's written language, the relations between Jewish women and the Muslim legal system, the conversion of women, visions of women in Hell and gendered readings in the aggadic tradition of Judaism".

Early Islamic law in Basra in the 2nd/8th century : Aqwāl Qatāda born Diʻāma al-Sadūsī /

: The manuscript of the Aqwāl Qatāda has repeatedly attracted particular interest among modern scholars, as it raises questions concerning the early development of the Ibāḍī Basran community and the emergence of Islamic jurisprudence in Iraq. It is a unique document because it attests to the existence of a scholarly link between Sunnīs and Ibāḍīs during the early development of Islamic law. The fact that the legal responsa and traditions of Qatāda born Diʿāma al-Sadūsī (60/680-117/735) are part of an Ibāḍī collection, in which the traditions of Ibāḍī Imam Jābir born Zayd (d. 93/ 711) have been transmitted through ʿAmr born Harim and ʿAmr born Dīnār, proves that the Ibāḍī lawyers of the first generations considered Qatāda to be a faithful upholder of Jābir's doctrine. Given the lack of material available for Jābir , instructions must have been given to collect whatever was transmitted through Qatāda. Qatāda's legal responsa must have corresponded to those of the first Ibāḍī authorities, which explains why the collator of the Aqwāl Qatāda (probably Abū Ghānim al-Khurāsānī) included them in an Ibāḍī manuscript. The present volume sheds light on the relationship between the Aqwāl Qatāda and Ibāḍī authorities such as al-Rabī, Abū Ubayda, and Jābir.

Legal documents from the Judean desert the impact of the Sharīʻa on Bedouin customary law /

: This volume presents annotated English translations of 74 awards handed down by tribal arbitrators and other legal documents obtained from the Bedouin of the Judean Desert. The documents address such legal issues as blood and sexual offenses, family disputes, inheritance, private transactions in land and water rights, tribal boundaries, contracts and obligations. The documents, some of which date back to the 19th century, provide vital information on the process of Islamization of the tribal customary law in the precinct of the tribal judge. The facsimile reproductions of the manuscripts are included, rendering direct access to the original documents. The study is intended for students of Islamic law, of customary law and of comparative law, and historians interested in the legal, social and economic history of modern Palestine and Jordan. A linguistic essay, by Dr. Mūsā Shawārbah, based on the Bedouin documents, appears at the end of the study.

Arab painting : text and image in illustrated Arabic manuscripts /

: Arab painting, preserved mainly in manuscript illustrations of the 12th to 14th centuries, is here treated as an artistic corpus fully deserving of appreciation in its own terms, and not as a mere precursor to Persian painting. The book assembles papers by a distinguished list of scholars that illuminate the variety of material that survives in scientific as well as literary manuscripts. Because of the contexts in which the paintings appear, a major theoretical concern is, precisely, the relationship of painting to text. It rejects earlier scholarly habits of analysing paintings in isolation, and proposes the integration of text and image as a more satisfactory framework within which to elucidate the characteristics and functions of this impressive body of work.

La Summa Alexandrinorum : Abrégé arabo-latin de l'Éthique à Nicomaque d'Aristote. Édition critique, traduction française et introduction /

: This volume contains the first critical edition of the Summa Alexandrinorum , that is the medieval Latin translation made in 1243 by Hermann the German of an Arabic abridgment of the Nicomachean Ethics known as the Iḫtiṣār al-Iskandarānīyīn . It is accompanied by a French translation. The volume also contains a full study of the manuscript tradition of the Latin text and sets out the principles used in the edition, which takes account, where necessary, of the Arabic version of the text, which has survived in the form of fragments. A study of the origin of the Summa Alexandrinorum and the relations between the Summa and the fragments and testimonies which are extant in other traditions and different languages completes the volume. Kitāb talkhīṣ al-Muḥaṣṣal : fī sharḥ al-Muḥaṣṣal fī ʿilm al-kalām /

: Fakhr al-Dīn Rāzī (d. 606/1210) was a prominent theologian, interpreter of the Qurʾān and philosopher. He was born in Rayy where he studied theology, philosophy and law under different masters, including his father, a preacher. After his studies, he started a wandering life which took him to different cities and courts in Transoxania and Khwārazm. He finally settled in Herat where he spent the rest of his life, a wealthy and respected scholar and author of a number of seminal works. Naṣīr al-Dīn Ṭūsī (d. 672/1274) was an influential philosopher, theologian, mathematician and astronomer, besides being the first director of the famous observatory at Marāghah near Tabriz as well as a man of politics. Author of a large number of scholarly works, his influential commentary on Rāzī's Muḥaṣṣal on philosophical theology is a critical appraisal of a work which Ṭūsī considered much overrated.

Pre-modern Islamic legal practice is most often considered an essentially urban phenomenon. Relying on unedited fatwa collections and other Arabic manuscripts from the oasis of Tuwāt in southern Algeria, Droit musulman et société au Sahara prémoderne challenges this vision. The book explores the spread of Islamic legal institutions in the region between the seventeenth and the nineteenth centuries, and the interaction between village communities and Muslim jurists. Ismail Warscheid investigates this process from a dialectical perspective: how were sharʿī norms applied by local qadis and muftis, and how did local populations made use of court litigation, notarial certification, and legal consultation?
