The nine contributions in The Trade in Papers Marked with non-Latin Characters initiated by Anne Regourd (edition) approach global history through the paper trade. They cover, in addition to a paper used in 14th C Persia, papers used in Africa (Ethiopia, Nigeria, Tunisia) and Asia (the Ottoman Levant, Mecca, Persia, Russia, and Yemen) during the 19th-20th C. Primarily based on paper examination and quantitative data, the book invites us to treat papers as a source, and provides tools to determine the production of manuscripts in space and time for the area of interest. This methodology offers new insights on the competition between suppliers to the various markets particularly in respect of the emergence of import-export trading companies. Le commerce des papiers à marques à caractères non-latins , dont Anne Regourd (éd.) est à l'initiative, a pour projet de traiter d'histoire globale par le commerce du papier. Early Islamic law in Basra in the 2nd/8th century : Aqwāl Qatāda born Diʻāma al-Sadūsī /

The manuscript of the Aqwāl Qatāda has repeatedly attracted particular interest among modern scholars, as it raises questions concerning the early development of the Ibāḍī Basran community and the emergence of Islamic jurisprudence in Iraq. It is a unique document because it attests to the existence of a scholarly link between Sunnīs and Ibāḍīs during the early development of Islamic law. The fact that the legal responsa and traditions of Qatāda born Diʿāma al-Sadūsī (60/680-117/735) are part of an Ibāḍī collection, in which the traditions of Ibāḍī Imam Jābir born Zayd (d. 93/ 711) have been transmitted through ʿAmr born Harim and ʿAmr born Dīnār, proves that the Ibāḍī lawyers of the first generations considered Qatāda to be a faithful upholder of Jābir's doctrine. Given the lack of material available for Jābir , instructions must have been given to collect whatever was transmitted through Qatāda. Qatāda's legal responsa must have corresponded to those of the first Ibāḍī authorities, which explains why the collator of the Aqwāl Qatāda (probably Abū Ghānim al-Khurāsānī) included them in an Ibāḍī manuscript. The present volume sheds light on the relationship between the Aqwāl Qatāda and Ibāḍī authorities such as al-Rabī, Abū Ubayda, and Jābir.

This volume presents annotated English translations of 74 awards handed down by tribal arbitrators and other legal documents obtained from the Bedouin of the Judean Desert. The documents address such legal issues as blood and sexual offenses, family disputes, inheritance, private transactions in land and water rights, tribal boundaries, contracts and obligations. The documents, some of which date back to the 19th century, provide vital information on the process of Islamization of the tribal customary law in the precinct of the tribal judge. The facsimile reproductions of the manuscripts are included, rendering direct access to the original documents. The study is intended for students of Islamic law, of customary law and of comparative law, and historians interested in the legal, social and economic history of modern Palestine and Jordan. A linguistic essay, by Dr. Mūsā Shawārbah, based on the Bedouin documents, appears at the end of the study.

Al-Radd al-jamil : a fitting refutation of the divinity of Jesus /

al-Radd al-jamīl attributed to al-Ghazālī (d. 1111) is the most extensive and detailed refutation of the divinity of Jesus by a Muslim author in the classical period of Islam. Since the discovery of the manuscript in the 1930's scholars have debated whether the great Muslim theologian al-Ghazālī was really the author. This is a new critical edition of the Arabic text and the first complete English translation. The introduction situates this work in the history of Muslim anti-Christian polemical writing. Mark Beaumont and Maha El Kaisy-Friemuth argue that this refutation comes from an admirer of al-Ghazālī who sought to advance some of his key ideas for an Egyptian audience.

Fakhr al-Dīn Rāzī (d. 606/1210) was a prominent theologian, interpreter of the Qurʾān and philosopher. He was born in Rayy where he studied theology, philosophy and law under different masters, including his father, a preacher. After his studies, he started a wandering life which took him to different cities and courts in Transoxania and Khwārazm. He finally settled in Herat where he spent the rest of his life, a wealthy and respected scholar and author of a number of seminal works. Naṣīr al-Dīn Ṭūsī (d. 672/1274) was an influential philosopher, theologian, mathematician and astronomer, besides being the first director of the famous observatory at Marāghah near Tabriz as well as a man of politics. Author of a large number of scholarly works, his influential commentary on Rāzī's Muḥaṣṣal on philosophical theology is a critical appraisal of a work which Ṭūsī considered much overrated. Facsimile of the oldest known copy, dated 669/1270.

L'ouvrage explore la diffusion d'institutions juridiques islamiques dans la région entre le XVIIe et le XIXe siècles, ainsi que l'interaction entre communautés villageoises et juristes musulmans. Pre-modern Islamic legal practice is most often considered an essentially urban phenomenon. The book explores the spread of Islamic legal institutions in the region between the seventeenth and the nineteenth centuries, and the interaction between village communities and Muslim jurists. This is the first investigation of one of the main interests of astronomy in Islamic civilization, namely, timekeeping by the sun and stars and the regulation of the astronomically-defined times of Muslim prayer. The study is based on over 500 medieval astronomical manuscripts first identified by the author, now preserved in libraries all over the world and originally from the entire Islamic world from the Maghrib to Central Asia and the Yemen. The materials presented provide new insights into the early development of the prayer ritual in Islam. They also call into question the popular notion that religion could not inspire serious scientific activity. Only one of the hundreds of astronomical tables discussed here was known in medieval Europe, which is one reason why the entire corpus has remained unknown until the present. A second volume, also to be published by Brill, deals with astronomical instruments for timekeeping and other computing devices.
