Legal documents from the Judean desert the impact of the Sharīʻa on Bedouin customary law /

: This volume presents annotated English translations of 74 awards handed down by tribal arbitrators and other legal documents obtained from the Bedouin of the Judean Desert. The documents address such legal issues as blood and sexual offenses, family disputes, inheritance, private transactions in land and water rights, tribal boundaries, contracts and obligations. The documents, some of which date back to the 19th century, provide vital information on the process of Islamization of the tribal customary law in the precinct of the tribal judge. The facsimile reproductions of the manuscripts are included, rendering direct access to the original documents. The study is intended for students of Islamic law, of customary law and of comparative law, and historians interested in the legal, social and economic history of modern Palestine and Jordan. : During his research of the Arabic inscriptions in the Middle East at the end of the 19th century, Max van Berchem collected many squeezes of inscriptions. These squeezes are stored in the archives of the Fondation Max van Berchem in Geneva. The present publication wishes to present a scholarly record of these squeezes, many of which represent inscriptions that do no longer exist. This publication is the first of, hopefully, two addenda which will constitute a full record of one of the few treasures left by the great epigrapher in his archives. For many students of Arabic epigraphy these squeezes afford the only opportunity to have a close glimpse of the originals as possible, and learn about their contents with the aid of the photographs and studies which accompany them in this volume.

Rāhnamā-yi taṣḥīḥ-i mutūn /

: To know a culture, is to know its written tradition. Before the coming of the printing press, books were transmitted in manuscript form. When texts started to get printed rather than copied, earlier works that until then had only existed in manuscript, came to be printed too. Until the early nineteenth century, a fair copy of a handwritten text would be all that was needed to turn an older work into a printed book. Today, all this has changed and most ancient texts are now published on the basis of a commonly accepted methodology. In the Islamic world, where we have thousands of works in manuscript that still await a proper edition, these modern methods are not always accessible to local scholars and uncritical editions still abound. This Persian guide to the publication of manuscripts is meant to change that situation. As such, it is an important statement on the advances in scholarship in Iran.

Makārim al-akhlāq : Sharḥ-i aḥwāl u zindagānī-yi Amīr ʿAlī Shīr Navāʾī /

: Ghiyāth al-Dīn Khwāndamīr (d. after 942/1535-6) is a Persian historian who worked for several Timurid rulers in Herat. After the capture of Herat by the Uzbeks in 912/1507 and their ousting by the Safavids in 916/1510, Khwāndamīr held no further public office there. In 927/1520 he went to Agra where he entered the service of the founder of the Mughal dynasty Bābūr (d. 937/1530) and, following the latter's death, his son Humāyūn (d. 963/1556). He died in India, where he was also laid to rest. Khwāndamīr is especially known for his Ḥabīb al-siyar , a universal history from the beginning of time until the reign of Shāh Ismāʿīl I (d. 930/1524). The present work, written at the beginning of his career, is a monument to the greatness of his first patron, the vizier Mīr ʿAlī Shīr Nawāʾī (d. 906/1501). Khwāndamīr's personal involvement in many of the events that it describes lends this work its special interest.

The Exoteric Aḥmad Ibn Idrīs : A Sufi's Critique on the Madhāhib and the Wahhābīs /

: The Moroccan mystic and theologian Aḥmad b. Idrīs (1749-1837) was one of the most dynamic personalities in the Islamic world of the 19th century. Through his teachings and the activity of his students important Sufi orders were founded which exerted wide-ranging social and political influence, orders such as the Sanūsiyya in Libya and the Khatmiyya in the Sudan. To date, publications dealing with him have especially focused on his biography and particular aspects of his mystical doctrines. In the present work an Arabic edition and translation with commentary of two texts are made available which throw light on Ibn Idrīs' attitude towards the religious-dogmatic questions of his day and age. The first text, Risālat al-Radd 'alā ahl al-ra'y , provides information about Ibn Idrīs' relation to the Islamic schools of jurisprudence, in particular his position regarding the ijtihād-taqlīd debate which was so significant in the 18th and 19th centuries. Like many similarly minded scholars of his time, Aḥmad b. Idrīs categorically rejects the authority of the established schools of jurisprudence and favors instead the application of personal methods in deriving a legal judgement. The second text presented here is a vivid report by one of his students describing a debate which Ibn Idrīs, at an advanced age, entered into with a Wahhābī theologian in the Yemenite city of sabyā in 1832. The text makes clear with regard to which points Ibn Idrīs hoped to establish agreement with the Wahhābīs, and where it was not possible to reach any mutual understanding. The introduction of the present book examines the tumultuous political circumstances in which both Arabic texts were composed and sketches the larger cultural and intellectual context which shaped Ibn Idrīs' world of ideas.

A Jewish philosopher of Baghdad : 'Izz al-Dawla Ibn Kammuna (d. 683/1284) and his writings /

: For a long time, the study of the life and work of the Jewish thinker ʿIzz al-Dawla Ibn Kammūna (d. 683/1284) remained limited to a very small number of texts. Interest in Ibn Kammūna in the Western Christian world dates back to the 17th century, when Barthélemy d'Herbelot (1624-1695) included information on two of Ibn Kammūna's works - his examination of the three faiths ( Tanqīḥ al-abḥāth li-l-milal al-thalāt ), id est Judaism, Christianity and Islam, and his commentary on Avicenna's al-Ishārāt wa l-tanbīhā t - in his Bibliothèque orientale . Subsequent generations of Western scholars were focused on Ibn Kammūna's Tanqīḥ al-abḥāth , whereas his fame in the Eastern lands of Islam was based exclusively on his philosophical writings. These include a commentary on the Kitāb al-Talwīḥāt by the founder of Illumationist philosophy, Shihāb al-Dīn al-Suhrawardī (d. 587/1191) and numerous independent works on philosophy and logic. Since most of the manuscripts of Ibn Kammūna's philosophical writings are located in the public and private libraries of Iran, Iraq, and Turkey, they were (and are) out of reach for the majority of Western scholars. The volume gives a detailed account of the available data of Ibn Kammūna's biography, provides an outline of his philosophcial thought and studies in detail the reception of his thought and his writings among later Muslim and Jewish philosophers. An inventory of his entire œuvre provides detailed information on the extant manuscripts. The volume furthermore includes editions of nine of his writings.

: Ottoman-Southeast Asian Relations: Sources from the Ottoman Archives, is a product of meticulous study of İsmail Hakkı Kadı, A.C.S. Peacock and other contributors on historical documents from the Ottoman archives. The work contains documents in Ottoman-Turkish, Malay, Arabic, French, English, Tausung, Burmese and Thai languages, each introduced by an expert in the language and history of the related country. The work contains documents hitherto unknown to historians as well as others that have been unearthed before but remained confined to the use of limited scholars who had access to the Ottoman archives. The resources published in this study show that the Ottoman Empire was an active actor within the context of Southeast Asian experience with Western colonialism. The fact that the extensive literature on this experience made limited use of Ottoman source materials indicates the crucial importance of this publication for future innovative research in the field.
