Drawing on legal and ḥadīth texts from the formative and classical periods of Islamic legal history, this book offers an overview of the development of the questions prominent jurists asked and answered about women's issues. All assumed a woman would marry and thus the book concentrates on women's family life. The introduction establishes the historical framework within which the jurists worked. A chapter on Qurʾān verses devoted to women's lives is followed by chapters on marriage and divorce which compare the views of jurists during the formative period. The fourth chapter describes the evolution from the formative to the classical periods. The fifth uses material from both periods to describe the array of legal opinion about other aspects of women's lives in and outside their homes. Throughout, jurists' opinions are juxtaposed with relevant quotations from contemporaneous ḥadīth collections.

"In the first of these important books in 1899, he started from the premise that liberation of women was an essential prerequisite for the liberation of Egyptian society from foreign domination, and used arguments based on Islam to call for an improvement in the status of women. In doing so, he promoted the debate on women in Egypt from a side issue to a major national concern, but he also subjected himself to severe criticism from the khedival palace, as well as from religious leaders, journalists, and writers. In response he wrote The New Woman, published in 1900, in which he defended his position and took some of his ideas further. In The New Woman, Amin relies less on arguments based on the Quran and Sayings of the Prophet, and more openly espouses a Western model of development. In Palestine, family law is a controversial topic publicly debated by representatives of the state, Sharia establishment, and civil society. Yet to date no such law exists. This book endeavors to determine why by focusing on the conceptualization of gender and analyzing "law in the making" and the shifts in debates (2012-2018). In 2012, a ruling on khulʿ -divorce was issued by the Sharia Court and was well received by civil society, but when the debate shifted in 2018 to how to "harmonize" international law with Islamic standards, the process came to a standstill. These developments and the various power relations cannot be properly understood without taking into consideration the terminology used and redefined in these debates.

Nawab Faizunnesa's Rupjalal /

Nawab Faizunnesa (1834-1903) challenged established notions regarding women's position in a Muslim society in colonial Bengal. Her RupJalal was the first literary text written by a Bengali Muslim woman. The translated text is placed in the historical context of colonialism and the nationalist movement of colonial Bengal. An analysis of the text is also included in order to invite readers to explore the woman question in context of Islam and/in imperial society. With the translated text, along with a critical overview and textual analysis, this book traces in Faizunnesa's life and works the emergence of a self-conscious female voice by addressing the issues of social, political, and economic marginality of women in an Islamic, nationalist, and imperialist culture of colonial Bengal.

In A Social History of the Late Ottoman Women: New Perspectives , Duygu Köksal and Anastasia Falierou bring together new research on women of different geographies and communities of the late Ottoman Empire. Making use of archives, literary works, diaries, newspapers, almanacs, art works or cartoons, the contributors focus particularly on the ways in which women gained power and exercised agency in late Ottoman Empire and early Republican Turkey. The articles convincingly show that women's agency cannot be unearthed without narrating how women were involved in shaping their own and others' lives even in the most unexpected areas of their existence. The women's activities described here do not simply reflect modernizing trends or westernizing attitudes-or their defensive denial. They provide an array of local responses where 'the local' can never be found (and should never be conceptualized) in its initial, unchanged, or authentic state.
