This book introduces readers to the legal epistemology that is advocated within Twelver Shiʿite uṣūl al-fiqh (legal theory). It critically surveys the epistemological underpinnings upheld by post-19th century Uṣūlī clerics that impel them to mainly deduce and interpret Sharia using scripture and literalist hermeneutical methods. An evaluation of these underpinnings uncovers the important juxtaposition that exists between the seminarian discourses of uṣūl al-fiqh and philosophy. The book hypothesises that uṣūl al-fiqh has both space and historical precedence to accept alternative epistemological theories that may enable orthodox Shiʿite clerics to display greater dynamism in deducing and interpreting Sharia.

They enquire into the boundaries between debate, polemics, and intolerance, and address their manifestations in both philosophy and religion. This cross-cultural and inclusive approach shows that debate and polemics are not so different as often assumed, since polemics may also indicate that ultimate values are at stake. Polemics can also have a positive effect, stimulating further cultural development. Intolerance is more straightforwardly negative. Religious intolerance is often a justification for politics, but also elite rationalism can become totalitarian. The volume also highlights the importance of the fluency of minorities in the dominant discourses and of their ability to develop contrapuntal lines of thought within a common cultural discourse.

Individualization of believing and the logic of pluralism today inevitably bring a redefinition of the role of religion in the lives of individuals as well as societies themselves. New concepts and new theories are necessary to try to describe and understand how such processes work: this is without doubt the most problematic and intriguing aspect of the processes of change that characterize our era. This is a difficulty that makes us use only partially, and often with much caution, words, concepts and theories that until not long ago had a convincing heuristic and explanatory power and were, at least apparently, indisputable. Once it is established that under the sacred vaults of religion nothing is created and nothing is destroyed, but everything is preserved and transformed, what are the connections that are now being established with the sacred in society? Modern, liberal democracies in the West living under the rule of law and protection of human rights cannot articulate the very values from which they derive their legitimacy. These pre-political and pre-legal preconditions cannot be guaranteed, let alone be enforced by the state, but constitute nevertheless its moral and spiritual infrastructure. Until recently, a common background and horizon consisted in Christianity, but due to secularisation and globalisation, society has become increasingly multicultural and multireligious. The question can and should be raised how religion relates to these sources of normative order in society, how religion, politics and law relate to each other, and how social cohesion can be attained in society, given the growing varieties of religious experiences. In this book, a philosophical account of this question is carried out, on the one hand historically from Plato to the Enlightenment, on the other hand systematically and practically.
