Known as one of the few Muslim theologians to have proposed a philosophical interpretation of the Qurʾān, Rāzī appears here as an innovative thinker, deeply convinced of the need to rely on rational methods to understand revelation. His formal rejection of literalism and his multiple borrowings from Avicenna's philosophy are explained as a consequence of a conception of knowledge in which reason plays a decisive role. Richly infused with illustrative texts and original translations from Arab sources, Oulddali's book offers an overview of the philosophical, theological and exegetical issues to which the thinking of Rāzī responds.

À partir d'une analyse de recueils de fatwas inédits et d'autres manuscrits arabes provenant des oasis du Grand Touat (Sud algérien), Droit musulman et société au Sahara prémoderne remet en question cette vision des choses. L'ouvrage explore la diffusion d'institutions juridiques islamiques dans la région entre le XVIIe et le XIXe siècles, ainsi que l'interaction entre communautés villageoises et juristes musulmans. Pour sonder ce processus, Ismail Warscheid adopte une approche dialectique : il reconstitue les modalités de l'application de la charia par les cadis et muftis locaux et s'interroge sur les usages que les populations oasiennes font des tribunaux islamiques, de l'écriture notariale et de la consultation juridique. Pre-modern Islamic legal practice is most often considered an essentially urban phenomenon. Relying on unedited fatwa collections and other Arabic manuscripts from the oasis of Tuwāt in southern Algeria, Droit musulman et société au Sahara prémoderne challenges this vision. The book explores the spread of Islamic legal institutions in the region between the seventeenth and the nineteenth centuries, and the interaction between village communities and Muslim jurists. This volume examines the process through which a historical character named al-Ḥasan al-Baṣrī was transformed into a myth by several groups in medieval Islam. Al-Ḥasan lived in the city of Basra, southern Iraq, and was famed for his piety, which attracted to him a large number of disciples who went on to play important roles in the formation of several religious trends. The literary corpus (sayings, stories and letters) ascribed to him has been used as a window into early Islamic religious and intellectual thought. But as this study shows, this corpus was largely forged in different periods, in some cases even a thousand years after al-Ḥasan's death. It tells us more about the beliefs of those who forged the sayings, stories and letters rather than about al-Ḥasan's thought and time.
