This is the third volume of the new series Social, Political, andamp; Legal Philosophy and it deals with the relationship between Law and The Philosophy of Action. In this volume a number of legal issues are illuminated by resource to the analysis of mental concepts. Issues in Criminal Law, Contract Law, Acceptance of Legal Systems, and the nature of Legal Norms are some of the main issues dealt in the papers that constitute the volume. Conceptual analysis is used and new overtures are made into current findings in the Cognitive Sciences. All of this results in illuminating accounts that throw new light on traditional fundamental legal issues. This volume is a precursor in the powerful theorizing of the Cognitive Sciences that is being brought to bear in the Philosophy of Mind and in the theory of Law, and this theorizing will increase in the coming years.

God's acting, man's acting : tradition and philosophy in Philo of Alexandria /

The topic tackled in this book is Philo's account of the complex, double-sided nature of God's acting - the two-sided coin of God as transcendent yet immanent, unknowable yet revealed, immobile yet creating - and also the two sides of acting in humans - who, in an attempt to imitate God, both contemplate and produce. In both contexts, divine and human, Philo considers that it would not be proper to give precedence to either side - the result would be barren. God's acting and man's acting are at the same time both speculative and practical, and it is precisely out of this co-presence that the order of the world unfolds. Philo considers this two-sided condition as a source of complexity and fertility. Francesca Calabi argues that, far from being an irresolvable contradiction, Philo's two-fold vision is the key to understanding his works. It constitutes a richness that rejects reduction to apparently incompatible forms and aspects.

More than being a volume about the philosophy of Bernard Harrison, this volume is about how Harrison conceptualizes the creation of the human world. One might be tempted to classify Harrison as a major voice in many diverse discussions-philosophy of literature, philosophy of language, philosophy of mind, color studies, epistemology, metaphysics, moral philosophy, philosophy of culture, Wittgenstein, antisemitism, and more-without recognizing a unifying strand that ties them together. Nothing could be farther from the truth. Harrison contests and destabilizes a persistent and misleading alignment of culture with subjectivity-whether found in unexamined distinctions between nature and culture or appearance and reality. His general aim has been to undermine the belief that human culture deals in smoke and mirrors, and that the only realities are those of extra-human nature. German idealism has attempted to think an absolute ground to self-conscious I-hood. As a result it has been theologically disqualified as pantheistic or even atheistic since many maintain that such a ground cannot be reconciled with a personal God. In the early writings of Friedrich Schelling (1775-1854), it is clear that he and his contemporaries were aware of this difficulty. His Tübinger fellow student, Friedrich Hölderlin (1770-1843), was convinced of the ultimate inadequacy of any philosophical system to grasp the unitary ground of all that is and turned to poetry. The metaphysical insights expressed in his poetry have been largely neglected in both philosophical and theological scholarship. Drawing on the 20th century metaphysics of Dieter Henrich and Karl Rahner, this book elaborates on Hölderlin's poetry. This results in a novel concept of God as both unitary and personal ground of I-hood.

Philosophy of language and other matters in the work of Anton Marty : analysis and translations /

One of the most important students of Franz Brentano was Anton Marty, who made it his task to develop a philosophy of language on the basis of Brentano's analysis of mind. It is most unfortunate that Marty does not receive the attention he deserves, primarily due to his detailed and distracting polemics. In the analysis presented here his philosophy of language and other aspects of his thought, such as his ontology (which ultimately diverges from Brentano's), are examined first and foremost in their positive rather than critical character. The analysis is moreover supplemented by translations of four important works by Marty, including his entire work On the Origin of Language . These are in fact the first English translations of any substantial writings by him. The resulting picture that emerges from the analysis and translations is that Marty has much to say that proves to be of enduring interest for the philosophy of language on a range of topics, especially the meanings of statements, of emotive expressions, and of names as regards both their communicative and their ontological aspects. The volume will be of interest not only to philosophers and historians of philosophy, but also to historians of linguistics and psychology.
