This is a book about the law and life of Rome-in which contributors respond to John Crook's injunction to 'think like lawyers' by ranging as far as ancient Greece, ancient Persia and modern Denmark to expound their themes and draw comparisons. An opening section focuses on Civil Law, more or less as conventionally conceived, with chapters on the peculium, on municipal law at Irni in Roman Spain, on advisers of Roman provincial governors, and on violent crime. Roman perceptions of the physical and human worlds are the focus of a second section, and comparisons between Greek, Roman and modern ways of thinking about law and government come into the third section. In the final section, contributors argue the history of law and life from refractions of real and imagined Rome.

Lucretius and the late Republic : an essay in Roman intellectual history /

The crisis Rome experienced in the last decades of the Republic was intellectual as well as political, social and military. This crisis was marked by conflicts over values and a growing dichotomy between words and things, as a result of which the key words of the Roman tradition lost their anchor in the inherited, commonly-held percepetion of reality known as the mos maiorum . The crisis was therefore also one of the Latin language itself. The monograph explores this thesis in discussions of the background and character of Roman intellectual history, the nature of the mos maiorum , the relationship of the Late Republic to the Mediterranean world, the roles of Julius Caesar, Catullus, Cicero, and Lucretius in the crisis, and its Augustan and later consequences. The major portion of the discussion is devoted to Lucretius, because the De Rerum Natura is the clearest example of the extent and nature of the crisis, from which it took its origin and gained its form and purpose. A principal goal of the essay is to relate Lucretius to the structure of Roman literary and intellectual history. It finds the explanation for his work in the nature of that history and the characteristic Roman modes and categories of thought rather than in the general history fo Greek philosophy. It also offers a new explanation of the relationshiop of the authors of the Late Republic to each other. In so doing, it indicates the foundation for a new history of Roman literature and a new conception of the reality and importance of the intellectual history of Rome.

In this investigation of the treatment of battle trauma in antiquity, 'treatment' is used in a double sense, both as actual medical treatment and literary 'treatment' in non-medical sources. East and West in Late Antiquity combines published and unpublished articles by emeritus professor Wolf Liebeschuetz. The collection concerns aspects of what Gibbon called 'the Decline and Fall of the Roman Empire'. This interpretation is now much criticized, but the author agrees with Gibbon. Topics discussed are defensive strategies, the settlement inside the Empire of invaders and immigrants, and the modification of identities with the formation of new communities. Liebeschuetz is interested in both the eastern and the western halves of the Empire. It aims at an extensive grammatical, stylistic and historical interpretation of the letters and the ancient testimonies on Fronto. Detailed source criticism of Tacitus, Suetonius, Dio Cassius, and others demonstrates that the passages thematizing citizens are primarily narrative in function. This approach further sharpens our understanding of the plebs' actual historical actions both regarding their causes, forms, and extent, as well as their attitude towards the emperors. This reappraisal allows for new insights and corrects numerous prior assessments, especially with regard to the function assigned the plebs as part of the so-called 'system of acceptance'.
