Based on years of research in Saudi Arabia, this volume investigates the legal system of Saudi Arabia both for its own sake and as a case-study of an Islamic legal system. As a study of Saudi Arabia, it is the first extensive treatment in English of the constitution and Islamic court system of Saudi Arabia. As a study of an existing legal system in continuity with past Islamic law and practice, it sheds new light on Islamic legal doctrine, practice, and institutions, correcting for past scholarly neglect of Islamic law's application. The book develops a framework of concepts, rooted in both Islamic and western legal theory, useful for the comparative description and analysis of Islamic legal systems and applications, past and present.

The hajj and Europe in the Age of Empire /

The present volume focuses on the political perceptions of the Hajj, its global religious appeal to Muslims, and the European struggle for influence and supremacy in the Muslim world in the age of pre-colonial and colonial empires. In the late fifteenth century and early sixteenth century, a pivotal change in seafaring occurred, through which western Europeans played important roles in politics, trade, and culture. Viewing this age of empires through the lens of the Hajj puts it into a different perspective, by focusing on how increasing European dominance of the globe in pre-colonial and colonial times was entangled with Muslim religious action, mobility, and agency. The study of Europe's connections with the Hajj therefore tests the hypothesis that the concept of agency is not limited to isolated parts of the globe. By adopting the "tools of empires," the Hajj, in itself a global activity, would become part of global and trans-cultural history. In Caliphate and Kingship in a Fifteenth-Century Literary History of Muslim Leadership and Pilgrimage Jo Van Steenbergen presents a new study, edition and translation of al-Ḏahab al-Masbūk fī Ḏikr man Ḥağğa min al-Ḫulafāʾ wa-l-Mulūk , a summary history of the Muslim pilgrimage to Mecca by al-Maqrīzī (766-845 AH/ca. 1365-1442 CE). Traditionally considered as a useful source for the history of the ḥağğ , al-Ḏahab al-Masbūk is re-interpreted here as a complex literary construction that was endowed with different meanings. Through detailed contextualist, narratological, semiotic and codicological analyses Van Steenbergen demonstrates how these meanings were deeply embedded in early-fifteenth century Egyptian transformations, how they changed substantially over time, and how they included particular claims about authorship and about legitimate and good Muslim rule.

Chanfi Ahmed shows how West African ʿulamāʾ, who fled the European colonization of their region to settle in Mecca and Medina, helped the regime of King Ibn Sa'ud at its beginnings in the field of teaching and spreading the Salafῑ-Wahhabῑ's Islam both inside and outside Saudi Arabia. This is against the widespread idea of considering the spread of the Salafῑ-Wahhābῑ doctrine as being the work of ʿulamāʾ from Najd (Central Arabia) only. We learn here that the diffusion of this doctrine after 1926 was much more the work of ʿulamāʾ from other parts of the Muslim World who had already acquired this doctrine and spread it in their countries by teaching and publishing books related to it. In addition Chanfi Ahmed demonstrates that concerning Islamic reform and mission (daʿwa), Africans are not just consumers, but also thinkers and designers.

In The Religious and Spiritual Life of the Jews of Medina Haggai Mazuz offers an account of the halakhic character of the Jewish community of Medina in the seventh century CE. Making use of a unique methodology of comparison between Islamic and Jewish sources, Mazuz convincingly argues that the Jews of Medina were Talmudic-Rabbinic Jews in almost every respect. Their sages believed in using homiletic interpretation of the Scriptures, as did the sages of the Talmud. On many halakhic issues, their observations were identical to those of the Talmudic sages. In addition, they held Rabbinic beliefs, sayings and motifs derived from the Midrashic literature.
