State, religion, and Muslims : between discrimination and protection at the legislative, executive, and judicial levels /

: "State, Religion and Muslims: Between Discrimination and Protection at the Legislative, Executive and Judicial Levels brings together the academics from different academic disciplines and offers an in-depth analysis of discrimination against Muslims in western countries affecting them in specific areas of life. The volume provides a comprehensive look at the legislative, executive and judicial dimensions of discrimination across the 12 Western countries situating discriminatory practices in their institutional framework with a multidisciplinary look. Exploring the most formidable aspects of the discrimination against Muslims - education, employment, exercise of religion, state relations with religious communities and hate crime and hate speech - the volume illustrates that the individual, structural and institutional discrimination against Muslims living in western countries has become a routine".

Looking Within: Finding an Environmental Justice and Global Citizenship Lens /

: Can we adopt human rights concepts, long used to frame problems of social justice, to define environmental justice? Can existing social institutions provide models and tools for achieving environmental justice? This volume views old models of agency through new lenses and examines how several social institutions, such as law, education and health care, address specific environmental problems. The volume presents arguments for human obligations towards the environment and future generations. Scholars assess the limitations of existing models and others point to recent failures in protecting the interests of indigenous groups or species. And on a hopeful note, examples are given of institutions that promise some success in effecting environmental goals. As this discussion of citizenship suggests, much like environmental justice, a global context both in definition and application is required.

Jerusalem: Points of Friction - And Beyond /

: The material in this publication was compiled over an 18-month period and includes a variety of local, national and international issues and disaggregating Jerusalem's intricate problems. It offers meaningful models that even though they may not yield solutions acceptable to all parties in the Israeli - Palestine conflict, will at least clearly demarcate common ground and draw the 'red lines' that may not (yet) be crossed. The result is an enormously valuable resource that cannot fail to attract the attention of anyone concerned with the future of the Mideast region.

The International Status of Taiwan in the New World Order: Legal and Political Considerations /

: This book examines the most important issues determining the international status of Taiwan today: its international legal status, the viability of its flexible democracy, its efforts to gain participation or membership in international organizations, most notably the United Nations, and its future relations with mainland China, ranging from reunification to declared independence. Issues of American and European foreign policy and of domestic Chinese and Taiwanese politics are also addressed where relevant. This book is unique in that it looks at the question of Taiwan from the perspective of both international law and politics as it confronts the imperatives of law and the limitations of real world politics. As a result it offers insights and strategies that are both sensible and feasible. This book is aimed at scholars and practitioners of international law and international relations alike.

Renegotiating Westphalia : Essays and Commentary on the European and Conceptual Foundations of Modern International Law /

: This collection of papers addresses two main themes: firstly, whether there is a distinctively European contribution to or even leadership in the contemporary formation and evolution of international law; secondly, the extent to which non-governmental actors (e.g. NGOs, international organizations, companies, individuals) contribute decisively to the formation of international law at the present time. These issues are explored within a number of different contexts of contemporary significance, in particular: the protection of human and minority rights; protection of the environment; control of transnational organized crime; prosecution of war crimes and crimes against humanity; the definition of statehood and the right to self-determination; transnational commercial and economic activity. The discussion is firmly located within the theory of international law and relations and also the continuum of international history. Comparisons are drawn with both global and other regional developments to test the hypothesis of a 'European international law'. The work will be of interest to teachers, students and practitioners (legal and otherwise) in the field of international law and relations.

Judge Manfred Lachs and Judicial Law-Making : Opinions on the International Court of Justice, 1967-1993 /

: This volume, the second in the series The Judges , which collects and synthesizes the opinions of leading international contemporary judges who have contributed significantly to the progressive development of international law, is devoted to the work of Judge Manfred Lachs, who was elected to the International Court of Justice in 1967. In his Foreword to the study, UN Secretary General Boutros Boutros-Ghali says of Lachs that ` His contribution to jurisprudence is especially noteworthy. He initiated a significant part of the jurisprudence of the Court in the area of human rights. He contributed to the formulation of the right to self-determination, helped to develop the law of the sea, and participated in the work of the Court in many other areas. But, above all, he was at the forefront of the most progressive battles of the Court, demonstrating great personal courage and great analytical rigour. As President of the Court, he showed a constant interest in improving its procedures and developing relations between the judicial organ and other organs of the United Nations. ' Edward McWhinney's masterly essay, which precedes extracts from Manfred Lachs' Opinions and from some Judgements in which he played a crucial role, is essential reading for all those interested in the World Court, as well for Manfred Lachs' countless admirers, students and colleagues.
