Poznań School of Legal Theory /

: "This book grew out of the conviction that the original concepts of the Poznań School of Legal Theory are still perfectly suited for application in the era of moral pluralism and multicentric legal systems. Moreover, the legal-theoretical proposals put forward by the circle of Poznań legal theorists, and supported by firm methodological foundations, have not, by any means, lost their value. Although each of the authors tackles issues from different perspectives, there is a discernible unity in their approaches, expressed in the conviction that modest analysis makes more sense than ambitious analysis of the concept of law or the nature of law. The Poznań School has made several valuable contributions to contemporary legal theory: Its works have drawn from Polish philosophy of language and therefore embedded its theoretical and legal considerations in the Polish philosophical culture; it created an original model method which consists of considering ideal situations in which dependencies are not disturbed by the influence of other factors; and it treats the human being as a rational person, and thus as a cognizing subject and a rational agent"--

: Raffaele Pettazzoni (1883-1959), Professor of the History of Religions at the University of Rome and one of the leading historians of religions in the twentieth century, maintained a long correspondence with Herbert Jennings Rose (1883-1961), the gifted Canadian scholar who was Professor of Greek at St Andrews and is best known for his work in the field of ancient religion and folklore. These letters, spanning the years 1927 to 1958, bear witness to the close relationship between the two scholars and focus on two of Pettazzoni's books, both translated by Rose: Essays on the History of Religions (1954) and The All-Knowing God (1956). They also shed light on Pettazzoni's initiative to the foundation of the journal NVMEN (1954), and reveal Rose's brilliant personality.

Religion, politics and law : philosophical reflections on the sources of normative order in society /

: Modern, liberal democracies in the West living under the rule of law and protection of human rights cannot articulate the very values from which they derive their legitimacy. These pre-political and pre-legal preconditions cannot be guaranteed, let alone be enforced by the state, but constitute nevertheless its moral and spiritual infrastructure. Until recently, a common background and horizon consisted in Christianity, but due to secularisation and globalisation, society has become increasingly multicultural and multireligious. The question can and should be raised how religion relates to these sources of normative order in society, how religion, politics and law relate to each other, and how social cohesion can be attained in society, given the growing varieties of religious experiences. In this book, a philosophical account of this question is carried out, on the one hand historically from Plato to the Enlightenment, on the other hand systematically and practically.

Wittgenstein on the human spirit /

: Wittgenstein on the Human Spirit provides a new understanding of Wittgenstein's discourse as an insightful philosophy of culture, pursued through self-reflection. It offers an edifying perspective on the conceptual underpinnings of culture as a shared expressive spiritual form of life. The ideas investigated in it are highly relevant for discussions in philosophy, aesthetics, anthropology, and cultural studies. The book embraces three studies: The Spirit of Jews , The Spirits of Culture and Civilization , and The Common Spirit of Human Beings . The first discusses Wittgenstein's remarks about Jews, focusing on their place within his philosophical thinking, self-reflection, and European discourse about culture and Jews. It shows how overcoming the anti-Semitic attitude implicit in them set off the major change in his philosophy. The second discusses Wittgenstein's reflections on the "deterioration of culture" in the modern period, showing how they are related to his remarks about following rules. The third discusses Wittgenstein's insights regarding the symbolic nature of myth, magic and religion. It suggests that modern human beings and those of ancient cultures possess a common expressive spiritual nature. This enables us to understand expressive practices in other cultures without interpretation. Nonetheless religious belief during the modern period is problematic.

Shakespeare and philosophy : lust, love, and law /

: This book is an interdisciplinary work that weaves literary interpretation, legal theory, and philosophical doctrine about sex and love into a coherent mosaic in the context of two of Shakespeare's plays: The Merchant of Venice and Measure for Measure . In the process, the work advances literary interpretations of the plays including character studies of some of the main protagonists. The aim is partly theoretical but mostly practical: to demonstrate what we can learn about living a robustly meaningful and significant human life by taking Shakespeare's work seriously from contemporary philosophical and legal vantage points. Shakespeare does not reveal a tightly defined moral system that he is trying to urge upon his audience. Instead, Shakespeare challenges his audience to struggle with moral complexity as they confront conflicting elements surrounding legal and moral issues presented in his work and within the souls of his characters. His issues and their conflicts are also ours. Much of Shakespeare's work consists of raising weighty questions inextricably connected to the human condition and inviting his audience to ponder possible answers. The philosophical lessons about living our lives meaningfully and significantly that we can derive from Shakespeare are simple yet powerful.

The limits of science : an analysis from "barriers" to "confines" /

: The problem of the limits of science is twofold. First, there is the problem of demarcation, id est, the boundaries or "barriers" between what is science and what is not science. Second, there is the problem of the ceiling of scientific activity, which leads to the "confines" of this human enterprise. These two faces of the problem of the limits - the "barriers" and the "confines" of science - require a new analysis, which is the task of this book. The authors take into account the Kantian roots but they are focused on the current stage of the philosophical and methodological analyses of science. This vision looks to supersede the Kantian approach in order to reach a richer conception of science.

Russian Philosophy in the Twenty-First Century : An Anthology /

: Russian Philosophy in the Twenty-First Century: An Anthology provides the English-speaking world with access to post-Soviet philosophic thought in Russia for the first time. The Anthology presents the fundamental range of contemporary philosophical problems in the works of prominent Russian thinkers. In contrast to the "single-mindedness" of Soviet-era philosophers and the bias toward Orthodox Christianity of émigré philosophers, it offers to its readers the authors' plurality of different positions in widely diverse texts. Here one finds strictly academic philosophical works and those in an applied, pragmatic format-secular and religious-that are dedicated to complex social and political matters, to pressing cultural topics or insights into international terrorism, as well as to contemporary science and global challenges.

Rooted in the experience of women, her feminist Jewish theology reflects the impact of several philosophical strands, including hermeneutics, dialogical philosophy, critical theory, and process philosophy. Most active in the American Academy of Religion, she has shaped the academic discourse on women in religion while critiquing Christian feminism for lingering forms of anti-Judaism.

Entanglements and Weavings: Diffractive Approaches to Gender and Love /

: This edited volume focuses on gender and love as phenomena that emerge through complex "entanglements and weavings". At a point where constructionist ideas are losing support, we interrogate theoretical paradigms to assess if constructionist notions still hold value or if new approaches are needed to address the effects of materiality and non-human agency on gender and love. Without claiming any unison or definite answers, we offer situated, agential cuts into Biblical and Rabbinic literature, ecosexual performance art, the writings of Ursula Le Guin and Angela Carter, butch identities, Bengali folktales, Ferzan Özpetek's cinema, Golem literature, sexual pursuits in Danish nightlife, mother-daughter relationships, women warriors in the PKK, and BDSM performances. Artistic photographer, Sara Davidmann, has contributed to the book with the cover illustration and a creative afterword including seven photographs on the effects of her photography studio on LGBTQ+ people.

Religion or halakha : the philosophy of Rabbi Joseph B. Soloveitchik /

: Joseph B. Soloveitchik's philosophy plays a significant role in twentieth century Jewish thought. This book focuses on the first stages of Soloveitchik's philosophy, through a systematic and detailed discussion of his essay Halakhic Man. Schwartz analyzes this essay at three main levels: first, he considers its complex writing style and relates it to Soloveitchik's aims in the writing of this work. Second, the author compares Halakhic Man to other contemporary writings of Soloveitchik. Third, he lays out the essay's philosophical background. Through this analysis, Schwartz successfully exposes hidden layers in Halakhic Man, which may not be immediately evident. This book is also available in paperback.

Plato and the moving image /

: This book shows how and why debates in the philosophy of film can be advanced through the study of the role of images in Plato's dialogues, and, conversely, why Plato studies stands to benefit from a consideration of recent debates in the philosophy of film. Contributions range from a reading of Phaedo as a ghost story to thinking about climate change documentaries through Plato's account of pleonexia . They suggest how philosophical aesthetics can be reoriented by attending anew to Plato's deployment of images, particularly images that move. They also show how Plato's deployment of images is integral to his practice as a literary artist. Contributors are Shai Biderman, David Calhoun, Michael Forest, Jorge Tomas Garcia, Abraham Jacob Greenstine, Paul A. Kottman, Danielle A. Layne, David McNeill, Erik W. This book focuses on the first and the second stages of Soloveitchik's philosophy (1945-1965), through a systematic and detailed discussion of some of his essays, including "From There You Shall Seek" and "The Lonely Man of Faith". Schwartz analyzes these essays according to this thesis: in the mid 40s Soloveitchik used the phenomenology of religion to express his views, while in the 50s he added the existential theory.

Jews and Christians in the first and second centuries : how to write their history /

: The papers in this volume are organized around the ambition to reboot the writing of history about Jews and Christians in the first two centuries CE. Many are convinced of the need for a new perspective on this crucial period that saw both the birth of rabbinic Judaism and apostolic Christianity and their parting of ways. Yet the traditional paradigm of Judaism and Christianity as being two totally different systems of life and thought still predominates in thought, handbooks, and programs of research and teaching. As a result, the sources are still being read as reflecting two separate histories, one Jewish and the other Christian. The contributors to the present work were invited to attempt to approach the ancient Jewish and Christian sources as belonging to one single history, precisely in order to get a better view of the process that separated both communities. In doing so, it is necessary to pay constant attention to the common factor affecting both communities: the Roman Empire. Roman history and Roman archaeology should provide the basis on which to study and write the shared history of Jews and Christians and the process of their separation. A basic intuition is that the series of wars between Jews and Romans between 66 and 135 CE - a phenomenon unrivalled in antiquity - must have played a major role in this process. Thus the papers are arranged around three focal points: (1) the varieties of Jewish and Christian expression in late Second Temple times, (2) the socio-economic, military, and ideological processes during the period of the revolts, and (3) the post-revolt Jewish and Christian identities that emerged. As such, the volume is part of a larger project that is to result in a source book and a history of Jews and Christians in the first and second centuries.

Creative actualization : a meliorist theory of values /

: This book presents a major new value theory, value as creative actualization. The book takes a radically new approach to values. All potential values, whether artistic, scientific, political, or economic must be creatively actualized in the world. The theory argues for an active view in which value involves creation of novelties and thereby changes the world in some respect. Thus value is neither transcendent nor subjective, as a good of some sort has emerged in the world. Moreover, creative actualization means we can actualize standards, ideals, kinds and other norms. Creative actualization thereby dissolves the distinction between idealism and realism, since value changes the "real" with novel goods. The ideal is made real by creative actualization. The book examines traditional issues such as inherent value, modes, and meaning in the light of value as creative actualization. The later part of the book critically evaluates the history of value theory, arguing that it is insensitive to the environment and inconsistent with inherent values. Creative actualization extends historical pragmatism in novel ways. This value theory includes an ecocentric ethic, tying value theory to debates in environmental philosophy. The theory attempts to take the environment into consideration in ethics.
