Virtue, Piety and the Law : A Study of Birgivī Meḥmed Efendī's al-Ṭarīqa al-muḥammadiyya /

: In Virtue, Piety and the Law Katharina Ivanyi examines Birgivī Meḥmed Efendī's (d. 981/1573) al-Ṭarīqa al-muḥammadiyya , a major work of pietist exhortation and advice, composed by the sixteenth-century Ottoman jurist, Ḥadīth scholar and grammarian, who would articulate a style of religiosity that had considerable reformist appeal into modern times. Linking the cultivation of individual virtue to questions of wider political, social and economic concern, Birgivī played a significant role in the negotiation and articulation of early modern Ottoman Ḥanafī piety. Birgivī's deep mistrust of the passions of the human soul led him to prescribe a regime of self-surveillance and control that was only matched in rigor by his likewise exacting interpretation of the law in matters of everyday life, as much as in state practices, such as the cash waqf, Ottoman land tenure and taxation.

The Birth of a Legal Institution : The Formation of the Waqf in Third-Century A.H. Ḥanafī Legal Discourse /

: This book present the first sustained analysis of the earliest legal treatises on the Islamic trust, or waqf -- the Aḥkām al-Waqf of Hilāl al-Ra᾿y and the Aḥkām al-Awqāf of al-Khaṣṣāf. The book situates the treastise and their authors within third/ninth century legal culture, and then undertakes a systematic textual analysis of the treatises, examining both the attributes of Ḥanafī legal discourse and how the waqf came to be defined and situated within existing categories of charitable giving, inheritance, bequest and death-sickness. The final chapter focuses on how the waqf was legitimated hermeneutically through traditions of the Prophet and his Companions. The close textual analysis of these treatises is especially important for historians of early Islamic law.

Ḍawʼ al-sârî li-maʻrifat ḫabar Tamîm al-Dârî =(On Tamim al-Dari and his waqf in Hebron) : critical edition, annotated translation and introduction /

: The present book investigates three short late Mamluk treatises about land properties (waqf) in the Palestinian city of Hebron, which the prophet Muhammad granted to Tamīm al-Darī. The treatise entitled Ḍawʾ al-sārī li-maʿrifat ḫabar Tamīm al-Dārī by al-Maqrīzī (d. 845/1442) is the core of the book. It is edited here for the first time on the sole basis of the copy corrected by the author. A facsimile of the manuscript is also provided at the end of the book. In order to illuminate the discourse on property rights and donation that prevailed in the Mamluk period and al-Maqrīzī's position, two additional treatises dealing with the same issue are included. The first is al-Ǧawāb al-ǧalīl ʿan ḥukm balad al-Ḫalīl by Ibn Ḥaǧar al-ʿAsqalānī (d. 852/1448). The second is al-Faḍl al-ʿamīm fī iqṭāʿ Tamīm by al-Suyūṭī (911/1505). The three texts are fully translated and annotated and preceded by a thorough introduction.

Waqf in Zaydi Yemen : legal theory, codification, and local practice /

: Islamic foundations ( waqf , pl. awqāf ) have been an integral part of Yemeni society both for managing private wealth and as a legal frame for charity and public infrastructure. This book focuses on four socially grounded fields of legal knowledge: fiqh , codification, individual waqf cases, and everyday waqf -related knowledge. It combines textual analysis with ethnography and seeks to understand how Islamic law is approached, used, produced, and validated in selected topics of waqf law where there are tensions between ideals and pragmatic rules. The study analyses central Zaydī fiqh works such as the Sharḥ al-azhār cluster, imamic decrees, fatwā s, and waqf documents, mostly from Zaydī, northern Yemen.
