This volume compares the courtroom oaths of both Islamic and modern Egyptian legal systems, blending elements of legal history, comparative law, theology, philosophy and culture. Until now, academic research has paid little attention to the subject of the courtroom oath in the Islamic or Egyptian legal systems. As such, it might appear as if modern legislation in the Arab world on this subject forms the natural continuation of Islamic law, or that there are no significant differences between these two legal approaches. This unique study seeks to rectify this impression by examining the institution of the courtroom oath on the basis of three criteria: Islamic law, which discusses the oath in the context of the judicial proceeding, including debate between different schools and interpreters; the sources and approach of Arab law on this subject; and, lastly, the core of this book - a detailed legal comparison between the Islamic oath and the Arab oath. In itself, this is a study in legal history examining the origins, character, sources,and doctrines of the oath in Arab law and at the same time, it is a comparative study of Islamic and contemporary Arab law in this field.

The Sacred Bonds of Commerce : Religion, Economy, and Trade Society at Hellenistic Roman Delos /

This study analyzes the religious mentality, commercial practices, and social composition of Roman trade society at the celebrated Hellenistic Greek, Roman Republican emporium of Delos, 166-87 B.C. The remains of this site date largely to the late second and early first centuries B.C., when Delos was the nerve center of the trans-Mediterranean luxury and slave trade of Roman Italy. Repeated military assaults be-tween 87 and 69 B.C. de-stroyed the community and its trade importance declined. But as an archaeological site it offers the earliest and most detailed remains of a Roman trade community to survive anywhere in the Mediterranean world, including the city of Rome itself. This study marks the first re-assessment and interpretation of these remains from the vantage point of Roman trade in more than seventy years. Among the subjects discussed are the religious character of the remains of Delian marketplaces and their likely commercial function; the role of oaths and, more particularly, of the gods, Mercury and Hercules, in Roman commerce; the tendency of Roman traders to organize themselves according to religious fraternities and the manner in which this enhanced trade activities such as finance; the social status of these traders in wider Roman society as reflected by their house remains; and, finally the identity of the mysterious Agora of the Italians. Promises to keep : the oath in biblical narrative /

While many studies explore the literary role of the oath in general literature, none have contended with the role of the oath in the biblical narratives. This study seeks to fill that vacuum. The first section of this study examines the literary significance of the various oath formulae that appear in biblical narratives, focusing on anomalous formulations of the respective oath formulae. The second section of this study explores the narratives surrounding two characters, Saul and David, both of whom frequently engage in oath-making. The oaths taken by, to and about these characters mirror the narrative itself, and function as a prism through which the character's career is refracted. This study demonstrates that by perceiving the oath as a literary device for plot and character development, additional or more precise meanings may be revealed in the biblical stories.
