Studies in Migration : Internal and International Migration in India /

: This book represents a multi-disciplinary attempt to analyze and understand the problems relating to migration, both internal and international. Migration is assuming extremely critical significance in contemporary times in the context of rapid industrialization and economic development. Its significance expands well beyond regional geography, urban planning and housing policies, etc., into problems of law and order, conduct of national integration and management of human relations. Not only demographers and urban specialists, but other social scientists are now finding migration to be an area of absorbing and sustained academic interest. This book brings together twelve essays focussing on the historical, demographic and sociological dimensions of migration. A wide range of migration situations from the rural - rural to international are explored and many conceptual, theoretical and empirical aspects of the phenomenon are explored. The principal focus of analysis throughout is on human aspects of migration - poverty, deprivation and subsistence. The book constitutes by its multi-disciplinary perspective a pioneering contribution to the sociology of migration and will be useful for social scientists as well as administrators, politicians and social workers.

The impact of mobility and migration in the Roman empire : proceedings of the twelfth workshop of the International Network Impact of Empire (Rome, June 17-19, 2015) /

: Following on previous workshops of the Impact of Empire network which looked at frontiers (Impact 9), integration (Impact 10) and the world(s) beyond the borders of the Roman empire (Impact 11), the twelfth meeting of the network focused on movement within the Roman world. The Impact of Mobility and Migration in the Roman Empire assembles a series of papers on key themes in the study of Roman mobility and migration. It discusses legal frameworks, the mobility of the army (both at war and in peace-time), ethnic identity, the mobility of women, the mobility of senators, diplomatic mobility, war-induced mobility, and deportations. The papers vary in geographical scope, ranging from empire-wide approaches to reconstructions of patterns at particular sites. It employs a rich variety of sources, ranging from classical authors to documentary papyri, from legal sources to shipwrecks.

Selim III, social control and policing in Istanbul at the end of the eighteenth century : between crisis and order /

: In Selim III, Social Order and Policing in Istanbul at the End of the Eighteenth Century Betül Başaran examines Sultan Selim III's social control and surveillance measures. Drawing mainly from a set of inspection registers and censuses from the 1790s, as well as court records she paints a colorful picture of the city's residents and artisans. She argues that the period constitutes the beginnings of large-scale population control and crisis management and urges us to think about the Ottoman Empire as a polity that was increasingly becoming a "statistical" state, along with its contemporaries in Europe, and to go beyond mechanistic models of borrowing that focus primarily on military reform and European influence in our discussions of Ottoman reform and "modernity".

Renegotiating Westphalia : Essays and Commentary on the European and Conceptual Foundations of Modern International Law /

: This collection of papers addresses two main themes: firstly, whether there is a distinctively European contribution to or even leadership in the contemporary formation and evolution of international law; secondly, the extent to which non-governmental actors (e.g. NGOs, international organizations, companies, individuals) contribute decisively to the formation of international law at the present time. These issues are explored within a number of different contexts of contemporary significance, in particular: the protection of human and minority rights; protection of the environment; control of transnational organized crime; prosecution of war crimes and crimes against humanity; the definition of statehood and the right to self-determination; transnational commercial and economic activity. The discussion is firmly located within the theory of international law and relations and also the continuum of international history. Comparisons are drawn with both global and other regional developments to test the hypothesis of a 'European international law'. The work will be of interest to teachers, students and practitioners (legal and otherwise) in the field of international law and relations.

International Institutional Law : Seventh Revised Edition /

: This seventh, revised edition of International Institutional Law covers the most recent developments in the field. Although public international organizations such as the United Nations, the World Trade Organization, the World Health Organization, the African Union, ASEAN, the European Union, Mercosur, NATO and OPEC have widely divergent objectives, powers, fields of activity and numbers of member states, they also have many institutional characteristics in common. There is unity within diversity. Rather than being a handbook for specific organizations, the book offers a comparative analysis of the institutional law of international organizations. It includes chapters on the rules and practices concerning membership, institutional structure, decision-making, financing, legal order, supervision and sanctions, legal status and external relations. The books theoretical framework and extensive use of examples from practice is designed to appeal to both academics and practitioners.

The European Union and Regionalism : Conceptual and Contextual Perspectives /

: While the EU is the most emblematic Regional International Organization (RIO), the 'regional' perspective is largely absent in debates about the EU's identity and external posture. What does the 'regional' lens offer to the study of EU law? How is the regional dimension reflected in EU policymaking, and how does it impact norm production? This book offers the first critical, legal account of the EU as a RIO. It brings together scholars from different disciplines to reflect on the construction, use and misuse of the 'region' in EU law and practice and to examine how this dimension interacts with other RIOs.

The Dimension of Time in WTO Law : A Qualitative and Quantitative Analysis /

: This book is an original work that explores the universe of time elements in WTO Law and tracks their existence and formation. It addresses three fundamental questions: (1) how these time elements can be identified in legal texts; (2) how they may be associated with legal events; and (3) how they may be changed in practice. Taken together, this book offers a systematic reflection on the role of time in WTO Law and sheds new light on the broader theory of legalization within its four‐dimensional framework.

Interpretation of Customary International Law : Of Methods and Limits /

: In international law interpretation is ubiquitous. However, whereas in the case of treaty interpretation, this process has been codified in Articles 31-33 of the Vienna Convention on the Law of Treaties, the interpretation of rules of customary international law has remained largely unexplored. This monograph demonstrates not only that rules of customary international law can be interpreted but also that they have continuously been interpreted by international and domestic courts. Through an examination of this case-law, the various methods of interpretation of customary rules and their limits are identified as well as the similarities and differences with the rules of treaty interpretation.
