Dostoevsky's legal and moral philosophy : the trial of Dmitri Karamazov /

This work closely examines the trial of Dmitri Karamazov as the springboard to explaining and critically assessing Dostoevsky's legal and moral philosophy. The author connects Dostoevsky's objections to Russia's acceptance of western juridical notions such as the rule of law and an adversary system of adjudication with his views on fundamental human nature, the principle of universal responsibility, and his invocation of unconditional love. Central to Dostoevsky's vision is his understanding of the relationship between the dual human yearnings for individualism and community. In the process, the author related Dostoevsky's conclusions to the thought of Plato, Augustine, Anselm, Dante, Kierkegaard, Schopenhauer, Nietzsche, and Sartre. Throughout the work, the author compares, contrasts, and evaluates Dostoevsky's analyses with contemporary discussions of the rule of law, the adversary system, and the relationship between individualism and communitarianism.

Polarization simplifies and deforms language, ideas, and people. Polarization reduces the complexities of social life into an oppositional binary based on crude distinctions revolving around partial and harmful reified conceptions of self and other. Since the egocentric ''us versus them" narratives catalyze conflicts which tend to violence, polarization is itself a cause of violence. The project of peace, then, is aided by the project of depolarization. But what can we do to bring about a transformation away from polarity to peace? Audacity of the Spirit by A.F. Losev (1893-1988) dares us to think holistically, dialectically. Translated from the Russian original Дерзание духа (Politizdat Moskva, 1988) by Peter R. Weisensel and Vitali I. Betaneli, the book falls into three parts: the dialectical method; Losev's application of dialectics to history and culture; and his personal reflections on studying philosophy. Losev's insatiable intellectual curiosity probes a remarkable variety of areas. Positions he considers, though, are not always easily reconcilable, as with Marxism-Leninism and Orthodox Christianity. In Losev's conception of culture, however, culture and the intrinsic unity of any given cultural order is the common element that underlies everything living, even the order's incompatibles. The given culture cannot be reduced to any single position nor to all of them taken together. Audacity of the Spirit is an introduction to dialectics for beginners, but it is also a major philosopher's summing-up of his reflections to a non-specialized audience.
