This collective volume, in honor of Aharon Layish, deals with the main components in the laws of Islamic societies, past and present: sharīʿa , custom, and statute. Some chapters focus on one of these components, other discuss the interplay between two or even all three of them. The geographical coverage of the volume is wide, from the Balkans to Yemen, and from Iraq to the Maghrib. The chapters are based on a variety of sources: fiqh literature, fatwās , court decisions, judicial circulars, biographical dictionaries and chronics. The volume will be of special interest to historians, social scientists and lawyers working on Islamic and Israeli laws, and to those interested in gender studies, the Israeli-Palestinian conflict and Islamic cultures at large.

La pratique du droit musulman est généralement considérée comme un phénomène urbain. À partir d'une analyse de recueils de fatwas inédits et d'autres manuscrits arabes provenant des oasis du Grand Touat (Sud algérien), Droit musulman et société au Sahara prémoderne remet en question cette vision des choses. L'ouvrage explore la diffusion d'institutions juridiques islamiques dans la région entre le XVIIe et le XIXe siècles, ainsi que l'interaction entre communautés villageoises et juristes musulmans. Pour sonder ce processus, Ismail Warscheid adopte une approche dialectique : il reconstitue les modalités de l'application de la charia par les cadis et muftis locaux et s'interroge sur les usages que les populations oasiennes font des tribunaux islamiques, de l'écriture notariale et de la consultation juridique. Pre-modern Islamic legal practice is most often considered an essentially urban phenomenon. Relying on unedited fatwa collections and other Arabic manuscripts from the oasis of Tuwāt in southern Algeria, Droit musulman et société au Sahara prémoderne challenges this vision. The book explores the spread of Islamic legal institutions in the region between the seventeenth and the nineteenth centuries, and the interaction between village communities and Muslim jurists. Ismail Warscheid investigates this process from a dialectical perspective: how were sharʿī norms applied by local qadis and muftis, and how did local populations made use of court litigation, notarial certification, and legal consultation?

Even though scholars have known of Neo-Babylonian legal texts almost since Assyriology's very beginnings, no comprehensive study of court procedure has been undertaken. This lack is particularly glaring in light of studies of court procedure in earlier periods of Mesopotamian history. With these studies as a model, this book begins by presenting a comprehensive classification of the text-types that made up the \'tablet trail\' of records of the adjudication of legal disputes in the Neo-Babylonian period. In presenting this text-typology, it considers the texts' legal function within the adjudicatory process. En dehors d'analyses de type sociologique, les déclamations latines n'ont généralement que peu retenu l'attention des spécialistes de l'Antiquité. Pourtant, ces discours fictifs constituaient le couronnement de l'éducation rhétorique et un élément central de l'activité littéraire. De ce fait, ils appartiennent de plein droit au domaine de la littérature antique. Ce livre veut mieux faire connaître les déclamations latines et leur fonction dans le système éducatif romain. Il s'attache à mettre en lumière leur littérarité, en analysant les techniques narratives mises en œuvres et en soulignant leurs liens avec la poésie et le roman. L'ouvrage se penche également sur la question des rapports que ces textes entretiennent avec la réalité et sur celle de la pertinence de leur utilisation comme sources historiques. Il en ressort une réévaluation des déclamations, susceptible de susciter un nouvel intérêt pour ce genre littéraire majeur de l'Antiquité. The Latin declamations have, except for sociological analysis, drawn but little attention from specialists of Antiquity. However, these fictional discourses represented the highlight of the rhetorical education and were a central element in literary activity. This book strives to draw the Latin declamations and their role in the Roman educational system from the shadows. It will bring to light their literary nature and underline their ties with poetry and the novel. It also investigates the relation between these texts and reality and the pertinence of their use as historical sources. The result is a revaluation of the declamations, liable to provoke a new interest in this major literary genre of Antiquity.

Un premier chapitre expose le nombre de statues par règne et la fréquence des types auxquels elles correspondent, y compris les statues remployées sous la XIXe dynastie et celles qui lui sont attribuées. This publication is a synthesis of research on the royal statuarv of the Nineteenth Dynasty. It accompanies the catalogue of these statues that appeared on line in 2019.The present volume contains the results of observations on the royal statues, which are presented by type. The first chapter presents the statues by reign and by the types of statues within each reign, including statues reused by kings of the Nineteenth Dynasty as well as ones attributed to them.The succeeding chapters follow the evolution of statue types alongside the development of costume, coiffure and attributes. The frequency of these features in group statues and in two dimensional representations as well as their parallels in ritual scenes are also studied. The investigation defines the position of each type of statue in the temple and ends with an attempt to understand the rote of each statue type within the temple furniture. The next chapters deal with provenances, dimensions, materials, and techniques of the statues, followed by those on the accessories, and finally the style and the iconography are discussed, accompanied by comments on dating criteria.
