This collective volume, in honor of Aharon Layish, deals with the main components in the laws of Islamic societies, past and present: sharīʿa , custom, and statute. Some chapters focus on one of these components, other discuss the interplay between two or even all three of them. The geographical coverage of the volume is wide, from the Balkans to Yemen, and from Iraq to the Maghrib. The chapters are based on a variety of sources: fiqh literature, fatwās , court decisions, judicial circulars, biographical dictionaries and chronics. Neo-Babylonian court procedure /

Even though scholars have known of Neo-Babylonian legal texts almost since Assyriology's very beginnings, no comprehensive study of court procedure has been undertaken. This lack is particularly glaring in light of studies of court procedure in earlier periods of Mesopotamian history. With these studies as a model, this book begins by presenting a comprehensive classification of the text-types that made up the \'tablet trail\' of records of the adjudication of legal disputes in the Neo-Babylonian period. In presenting this text-typology, it considers the texts' legal function within the adjudicatory process. Based on this, the book describes the adjudicatory process as it is attested in private records as well as in records from the Eanna at Uruk. \'This study of textual typologies and adjudication processes will be of immense value to Assyriologists, biblical scholars and historians of law alike. In order to further scientific knowledge of human rights, the Council of Europe holds high-level meetings, such as colloquies, round tables and seminars. Every five years an important Colloquy on the European Convention on Human Rights takes place in a town of a member State. The Eighth International Colloquy on the European Convention on Human Rights, organised by the Secretariat General of the Council of Europe in collaboration with the Ministry of Justice of Hungary and the Hungarian Institute for Legal and Administrative Sciences, was held in Budapest from 20 to 23 September 1995. This volume contains the Proceedings of the Budapest Colloquy, which covered the following themes: The European Convention on Human Rights and cultural rights 1st session: Cultural rights: universal, indivisible, and legally enforceable rights; 2nd session: Cultural rights and the management of particular situations to ensure democratic security in Europe; The European Convention on Human Rights in the new architecture of Europe 3rd session: Effects on the European Convention on Human Rights of the enlargement of the number of Contracting Parties; 4th session: Implementation of the reform of the European Convention on Human Rights control machinery. Perspectives for Space Law in the Twenty-First Century /

The course evaluates the different phases of the development of space law against the background of the development of public international law. An analysis of current international space law investigates whether the body of law is ready for the challenges of outer space commercialisation and the rise of "New Space" in the 21st century. To accomplish this, it peruses through existing space law treaties, in particular the foundational Outer Space Treaty, as well as other sources of space law. Discovering that international space law developed as a permissive law that would enable the further evolution of space technology yet with sufficient foresight to understand that such evolution will require provisions for the preservation of the international common that is outer space, the author examines several avenues for the future evolution of space law. Among these, the author proposes several notions in order to preserve space law's initial character as a law for the protection of the international commons of "outer space" on the one hand, and pay attention to an equitable distribution of the benefits derived from the resources of outer space on the other hand.

Our understanding of the operation of law beyond the nation State has been deeply shaped by two great disciplines: public and private international law. Yet surprisingly little systematic attention has been devoted to the relationship between the two. The public-private divide operates to separate the law that is concerned with the exercise of political power by States and the policy choices that we make for public purposes - the domain of public international law - from the exercise of economic power by corporations, regulated largely by private international law. In this first panoptic survey of the relation between the two fields, McLachlan argues that the neglect of this interface is highly consequential for our understanding of law's capacity to control the State and the corporation. Both are constructs of the law. But the function of law is not merely to empower and clothe these artificial persons with legal authority; it is also to impose legal responsibility, where the exercise of power gives rise to a breach and causes injury to others. Only by placing these two great systems side-by-side, can we see clearly where that responsibility lies and the necessary development of the law.

Panopolis, the modern town of Akhmîm in Southern Egypt, was in Graeco-Roman times an important religious and cultural centre. Its gigantic temple was a stronghold of traditional Egyptian religion. In Late Antiquity it became a major centre of Hellenistic literature and learning and, at the same time, of Coptic monasticism. The sources for Graeco-Roman Panopolis are numerous and diverse. They not only include numerous texts of all genres in various scripts and languages, but archaeological artefacts too. This volume brings together seventeen contributions, dealing with epigraphy, both hieroglyphic and Greek, Greek papyri, Demotic funerary texts, Coptic literature and local monastic architecture. Without neglecting the heuristic problems which these various sources pose, they conjure up a vivid picture of a world marked by profound religious and cultural change.
