Beyond the Code : Muslim Family Law and the Shari'a Judiciary in the Palestinian West Bank /

Legal issues of personal status - including those implicating women's rights - continue to be a focal area of shari'a judicial practice in the Muslim world. Changing ideas of marriage, relations between the spouses, divorce, and the rights of divorcees and widows challenge the courts around the Arab world. In this context, the areas that came under the Palestinian Authority in 1994 command particular attention: the particular political and socio-economic circumstances that surround Palestine's progress toward full statehood have created a remarkable crucible for the synthesis of a new family law in the Arab world. This rigorous study of the interpretation and application of personal status law in the Palestinian West Bank (and to a lesser extent in the Gaza Strip) is the most extensive yet attempted. It presents a systematic analysis of the application of Islamic family law in nearly 10,000 marriage contracts, 1000 deeds of talaq (unilateral divorce) or khul' (divorce with renunciation), and 2000 judicial rulings over a time span that includes Jordanian rule and Israeli military occupation, updating this with material from the beginning of the jurisdiction of the Palestinian Authority. Taken into account are the sources of law used in the shari'a courts of the West Bank: the successive codes of family law (the Jordanian Law of Personal Status 1976 and its predecessor the Jordanian Law of Family Rights 1951), and traditional Hanafi rules and texts, along with commentaries by prominent contemporary shari'a scholars and Appeal Court decisions - as well as the amendments and modifications being sought by civil society actors (notably women's groups) in the West Bank and Gaza Strip, as well as in Jordan.

A lawyer by profession and an Urdu and Persian poet by vocation, Muḥammad Iqbāl (1877-1938) is the spiritual father of Pakistan. Born in Sialkot, he received his pre-college education in his hometown, after which he went to study in Lahore. In 1905, after several years of teaching (Arabic, English and philosophy) in Lahore, he travelled to Cambridge to study philosophy and law. Two years later, he went to Heidelberg, where he received his PhD in 1907 with a thesis entitled The Development of Metaphysics in Persia . He then returned to Lahore, working as a lawyer for most of his life. From around 1910 onwards, Iqbāl's poetry and prose works show an increased commitment to the cause of Islam and its political and societal ramifications, culminating in his idea of an Islamic state in northern India, the future Pakistan. The articles published in this volume all highlight different aspects of Iqbāl's life, work, and thought.

This is a collection of research notes, personal recollections, interviews with colleagues, and professional letters, sent and received, compiled by the Pakistani specialist of Islamic manuscripts ʿĀrif Nawshāhī (b. 1955). They cover a period of over 35 years of professional activity (1974-2011), mostly in Pakistan, India, and Iran. The work consists of five chapters, of which the research notes contained in chapters one and two are perhaps the most informative ones. Especially interesting is the information on the holdings of some of the libraries in India and Pakistan in chapter one and the codicological notes in chapter two. The notes, memoirs, anecdotes, interviews, and letters of chapters three to five give a fine impression of how this prominent scholar experienced the world of manuscripts and codicologists in which he was active for so many years. And here too, useful information may be found, especially in his long series of very short notes in chapter three.
