Law and property in Algeria : anthropological perspectives /

In spite of its privileged place on the African continent, in the Muslim world and in the Middle East and North Africa region, Algeria remains poorly known, and the works relating to contemporary Algerian society published outside of Algeria are rare. This book seeks to contribute to our understanding of Algerian society today, through its relationships to property and to law. Beyond this, the objective is to propose, in a comparative perspective proper to anthropology, new theoretical and methodological perspectives by which to apprehend the anthropology of law in a Muslim context. Algeria, as a post-colonial and post-Socialist State, whose population is overwhelmingly Muslim, proves to be a particularly interesting case to study. This book examines Heidegger's controversial relation to politics as it grows out of his understanding of his predecessors in German Idealism, most notably, Hegel. This way of developing a dialogue between Heidegger and Hegel on the issue of politics provides an important context for questioning the former's link with National Socialism. Yet the book does not simply condemn Heidegger for his Nazi involvement nor claim that his thinking is free from dangerous political implications. On the contrary, a second level of questioning asks whether Heidegger's philosophy can be appropriated in alternative contexts which permit the affirmation of democratic principles. Thus the book concludes by examining the import which Heidegger's thought has on cultivating such democratic motifs as freedom of speech and civil disobedience. In Rethinking Islamic Legal Modernism Ron Shaham challenges the common opinion that Islamic legal modernism, as represented by Rashid Rida (d. 1935), is of poor intellectual quality and should not be considered an authentic development within Islamic law. The book focuses on the celebrated Sunni jurist, Yusuf al-Qaradawi (b. 1926), whom Shaham perceives as a close follower of Rida. By studying the coherence of Qaradawi's Wasati theory of ijtihad and the consistency of its application in his legal opinions (fatwas), Shaham argues that Qaradawi, by means of eclecticism and synthesis, conducts a bold dialogue with the Islamic juristic heritage and brings it to bear on modern developments, in particular the institutional framework of the nation-state.

Celebrated today for his groundbreaking work in logic and the foundations of mathematics, Bernard Bolzano (1781-1848) was best known in his own time as a leader of the reform movement in his homeland (Bohemia, then part of the Austrian Empire). As professor of religious science at the Charles University in Prague from 1805 to 1819, Bolzano was a highly visible public intellectual, a courageous and determined critic of abuses in Church and State. Based in large part on a carefully argued utilitarian practical philosophy, he developed a non-violent program for the reform of the authoritarian institutions of the Empire, which he himself set in motion through his teaching and other activities. Rarely has a philosopher had such a great impact on the political culture of his homeland. This volume contains a substantial collection of Bolzano's writings on ethics and politics, translated into English for the first time.
