Letting and hiring in Roman legal thought /
:
Commerce in the Roman Empire of the first three centuries CE operated within a well-established legal framework provided by Roman law. This framework was the product of both legal theory and legal practice. Centuries of Praetorian modification of the ancient ius civile , augmented by conceptual legal thought provided by the Roman jurists had produced a body of law which permitted commerce to flourish and to expand. Central to this body of law was the contract of letting and hiring, one of the four named \'consensual\' contracts in Roman law. Building on the pioneering work undertaken by Fiori (1999) on Roman conceptual thought about letting and hiring, this books fills an important gap in the current scholarly literature on this contract and its place in Roman commerce.

Ancient Roman trade was severely hampered by slow transportation and by the absence of a state that helped traders enforce their contracts. In Trading Communities in the Roman World: A Micro-Economic and Institutional Perspective Taco Terpstra offers a new explanation of how traders in the Roman Empire overcame these difficulties. Previous theories have focused heavily on dependent labor, arguing that transactions overseas were conducted through slaves and freedmen. Taco Terpstra shows that this approach is unsatisfactory. Employing economic theory, he convincingly argues that the key to understanding long-distance trade in the Roman Empire is not patron-client or master-slave relationships, but the social bonds between ethnic groups of foreign traders living overseas and the local communities they joined.

The present work comprises a collection of essays that explore the tensions and controversies that arise as a society moves from an oral to literate culture. Part 1 deals with both Homeric and other forms of epic; part 2 explores different ways in which texts and writing were manipulated for political ends. Part 3 and 4 deals with the controversies surrounding the adoption of writing as the accepted mode of communication; whereas some segments of society began to privilege writing over oral communication, others continued to maintain that the latter was superior. Part 4 looks at the oral elements of Athenian Law.

What is good, and what God demands : normative structures in Tannaitic literature /
:
The normative rhetoric of tannaitic literature (the earliest extant corpus of rabbinic Judaism) is predominantly deontological. Prior scholarship on rabbinic supererogation, and on points of contact with Greco-Roman virtue discourse, has identified non-deontological aspects of tannaitic normativity. However, these two frameworks overlook precisely the productive intersection of deontological with non-deontological, the first because supererogation defines itself against obligation, and the second because the Greco-Roman comparate discourages serious treatment of law-like elements. This book addresses ways in which alternative normative forms entwine with the core deontological rhetoric of tannaitic literature. This perspective exposes, inter alia, echoes of the post-biblical wisdom tradition in tannaitic law, the rich polyvalence of the category mitzvah, and telling differences between the schools of Akiva and Ishmael.
