The Origins of Islamic Jurisprudence : Meccan Fiqh before the Classical Schools /

: The current view among Western scholars of Islam concerning the early development of Islamic jurisprudence was shaped by Joseph Schacht's famous study on the subject published 50 years ago. Since then new sources became available which make a critical review of his theories possible and desirable. This volume uses one of these sources to reconstruct the development of jurisprudence at Mecca, virtually unknown until now, from the beginnings until the middle of the second Islamic century. New methods of analysis are developed and tested in order to date the material contained in the earliest compilations of legal traditions more properly. As a result the origins of Islamic jurisprudence can be dated much earlier than claimed by Schacht and his school.

: Reading Talmudic Sources as Arguments: A New Interpretive Approach elucidates the unique characteristics of Talmudic discourse culture. Approaching Talmudic literature from a linguistic perspective, the book shows the extensive and hidden ways in which later rabbis used early formulations. Applying Quentin Skinner's interpretive question "What was the author doing in composing the text in this particular way?" to Talmudic literature reveals that Talmudic debate is not only about ideas, concepts and laws but also about the latter's connection to pre-existing formulations. These early traditions, rather than only being accepted or not, are used by later generations to build their own arguments. The book articulates the function of tradition at the time that Rabbinic Judaism was forged.

: At the core of Scripture and Knowledge lies the problem of the nature of religious knowledge. The author argues that religion is a particular framework rather than a particular content or defined set of performances. He sees this framework as epistemological, that is, as one that furnishes believers with a conception of knowledge alternative to that of philosophical reasoning. The thesis on the epistemological nature of religion will be developed by the examination of the concept of scripture as a body of authoritative and even infallible texts. The concept of scripture is presented as one of the constitutive concepts of the epistemological framework of religion. The author argues that the various scriptures and their commentaries should be understood as the arena within which the epistemological process of religion takes place and the central epistemological means by which religious knowledge is made possible.

: The Horizons of Being explores the teachings of Ibn al-ʿArabī by examining Dāwūd al-Qayṣarī's (d. 1350) Prolegomena ( muqaddima ) to his commentary, Maṭlaʿ khuṣūṣ al-kilam fī maʿānī Fuṣūṣ al-ḥikam (A Preamble of Select Discourse on the Meanings of the Fuṣūṣ al-ḥikam), referred to simply as Muqaddimat al-Qayṣarī. While his commentary represents the third in a direct line going back to Ibn al-ʿArabī through Kāshānī, Jandī and Qūnawī, it remains one of the most popular due to its thorough and accessible treatment of the Fuṣūṣ that frequently synthesizes the ideas of his predecessors. The Muqaddima stands on its own as an independent work and has been the subject of careful study. If the al-Futūḥāt al-makkiyya contains the entirety of Ibn al-ʿArabī's metaphysics which is distilled in the Fuṣūṣ, then Qayṣarī's Muqaddima can be read not just as a precis of the Fuṣūṣ but a summary of Ibn al-ʿArabī's doctrine.
