The formation of the Sudanese Mahdist state ceremony and symbols of authority : 1882-1898 /

: This book is the first analysis of the Sudanese Mahdiyya from a socio-political perspective that treats how relationships of authority were enunciated through symbol and ceremony. The book focuses on how the Mahdi and his second-in-command and ultimate successor, the Khalifa Abdallahi, used symbols, ceremony and ritual to articulate their power, authority and legitimacy first within the context of resistance to the imperial Turco-Egyptian forces that had been occupying the Nilotic Sudan since 1821, and then within the context of establishing an Islamic state. This study examines five key elements from a historical perspective: the importance of Islamic mysticism as manifested in Sufi brotherhoods in the articulation of power in the Sudan; ceremony as handmaids of power and legitimacy; charismatic leadership; the routinization of charisma and the formation of a religious state purportedly based upon the first Islamic community in the seventh century C.E.

Neo-Babylonian court procedure /

: Even though scholars have known of Neo-Babylonian legal texts almost since Assyriology's very beginnings, no comprehensive study of court procedure has been undertaken. This lack is particularly glaring in light of studies of court procedure in earlier periods of Mesopotamian history. With these studies as a model, this book begins by presenting a comprehensive classification of the text-types that made up the \'tablet trail\' of records of the adjudication of legal disputes in the Neo-Babylonian period. In presenting this text-typology, it considers the texts' legal function within the adjudicatory process. Based on this, the book describes the adjudicatory process as it is attested in private records as well as in records from the Eanna at Uruk. \'This study of textual typologies and adjudication processes will be of immense value to Assyriologists, biblical scholars and historians of law alike. This is without mentioning the wealth of social and economic insights evident in each case, let alone the valuable identification of Neo-Babylonian formulaic legal expressions.\' S. Jacobs "Overall, Holtz's work is replete with important data, insightful in its analysis and judicious in its interpretive decisions. It should serve not only as an important resource but also as a significant statement on the function of law and judicial procedure at an important time in Mesopotamian history." A Functional Approach to the Legal Review of Autonomous Weapon Systems /

: Autonomous Weapon Systems (AWS) are no longer limited to science fiction. Conflicts in the Ukraine and Gaza demonstrate an increased trend toward the use of autonomy in the use of force in armed conflict. This book analyses the art 36 legal review obligation and assesses how states can determine the legality of AWS. It proposes a new 'functional' approach to legal review that considers both weapons law and targeting rules engaged by the autonomous functionality.

Nonnus' Paraphrase between Poetry, Rhetoric and Theology : Rewriting the Fourth Gospel in the Fifth Century /

: This book investigates the various paraphrastic techniques employed by Nonnus of Panopolis (5th century CE) for his poetic version of the Gospel of John. The authors look at Nonnus' Paraphrase , the only extant poetic Greek paraphrase of the New Testament, in the light of ancient rhetorical theory while also exploring its multi-faceted relationship with poetic tradition and the theological debates of its era. The study shows how interpretation, cardinal both in ancient literary criticism and in theology, is exploited in a poem that is exegetical both from a philological and a Christian point of view and adheres, at the same time, to the literary principles of Hellenistic times and late antiquity.

Protocols, Truth and Convention /

: The continuing philosophical interest in the famous 'Protocol Sentence Debate' in the Vienna Circle of Logical Positivists is, to a large measure, due to the focus on the epistemological issues in the dispute, and the neglect of differences among the leading players in their philosophical views of logic and language. In Protocols, Truth and Convention , the current understanding of the debate is advanced by developing the contemporaneous views of logic and language held by the principal disputants. Rudolf Carnap and Moritz Schlick. It is argued - largely on the basis of unpublished manuscripts and correspondence - that, despite apparent differences in their respective conceptions of language, there are nonetheless striking similarities, particularly with respect to the conventionality of language. Nonetheless, one key issue - concerning the syntacticism inherent in Carnap's early Thirties' philosophy - separates the two viewpoints in the clash over protocols. Finally, it is argued that Carnap's syntacticism is untenable, a conclusion that Carnap himself finally reached in the closing exchanges of the protocol sentence controversy.

Cultural heritage in the crosshairs : protecting cultural property during conflict /

: The protection of cultural property during times of armed conflict and social unrest has been an on-going challenge for military forces throughout the world even after the ratification and implementation of the 1954 Hague Convention and its two Protocols by participating nations. This volume provides a series of case studies and "lessons learned" to assess the current status of Cultural Property Protection (CPP) and the military, and use that information to rethink the way forward. The contributors are all recognized experts in the field of military CPP or cultural heritage and conflict, and all are actively engaged in developing national and international solutions for the protection and conservation of these non-renewable resources and the intangible cultural values that they represent.

Reimagining Legal Pluralism in Africa : Balancing Indigenous, State, and Religious Laws /

: This collection challenges the prevailing conflict of laws approach to the interaction of state and indigenous legal systems. It introduces adaptive legal pluralism as an alternative framework that emphasises dialogue and engagement between these legal systems. By exploring a dialogic approach to legal pluralism, the authors shed light on how it can effectively address the challenges stemming from the colonial imposition of industrial legal systems on Africa's agrarian political economies.
