The book reveals that beneath the oft-repeated storyline of the poor health of tribal communities lies a more nuanced reality of varied experiences across different tribal communities; and within-group differentials among the same community. The book also forcefully brings home the inadequacy of commonly used health indicators such as morbidity and mortality to describe the multiple dimensions of lack of well-being experienced by the tribal communities. With the help of thick qualitative descriptions, the book captures the everyday violence of loss of livelihoods, displacement, insecurity, poverty, and hunger, not to mention the overt violence of ethnic conflicts. It argues that these consequences to people's well-being can hardly be captured in terms of disease and death alone. The book delineates the pathways through which health inequities experienced by the tribal communities have come about and have persisted. It highlights, among other factors, the failure of the public health system to reach out to the tribal communities and, worse still, the public health system's systematic marginalisation of tribal communities owing to the 'equity-blindness' of its very design, structure, and organisation. The book ends with reflections on the implications of the studies for policies, programmes, and research.

Beleaguered Nation : The Making and Unmaking of the Assamese Nationality /

The multi-ethnic state of Assam emerged to be a minefield of conflict and violence over assertions of autonomy in the 1980s. While the Assamese leaders were fighting a battle against the Bengali and the fear of immigrant Muslim domination after independence, one by one other tribal groups challenged the hegemony of the Assamese and broke free from the state: the Naga, the Khasi-Jyntia, the Mizo and the Arunachalis. They were followed by the Bodos, Dimasas and the Karbis who despite having got their autonomy are still fighting a fierce battle for complete statehood. There is a growing demand for a Ahom and Kamatapur state as well as from the smaller communities like the Rabhas, Hasong, Tiwa, Mishing, Sonowal Kachari, Thangal Kachari and Deuris, and even domiciled Gorkhas which if conceded would reduce the size of the Assamese nationality and Assamese territory to only a few pockets. There are extremist outfits like the United Liberation Front of Assam which saw secession from India as the solution to the problem of Assamese nationality, others like the Karbi National Volunteers, United Peoples Democratic Solidarity, Dima Haloa Daoga (two factions), Kuki National Front and Kuki National Army, Bodo Security Force, National Democratic Front of Bodoland resorted to violence as a mode of their assertions. Unprecedented turbulence, instability, violence, and internal displacement engulfed the entire region creating a severe crisis for the Indian state. Submerged in this ethnic cauldron, the Assamese were indeed a beleaguered nation fighting for survival amidst such multiple ethnic challenges. This book is about contradictions, conflicts, machinations, subversions, nature of state intervention and the intricate process of making and unmaking of Assamese nationality vis-a-vis north east India.

Focusing on key cases such as Bemba , Gbagbo , and Ongwen , the book identifies recurring challenges, including the tendency to confuse procedural rules with the rigorous reasoning process required by evidence law. It challenges the continental assumption that evidence law is merely a set of admissibility rules. It redefines it as a body of law that offers a structured method of reasoning, supporting a principled approach to the admissibility of evidence at the trial stage and its evaluation at the judgment stage. The lack of consistent, robust reasoning in the case law of the ICC on evidence issues has resulted in reasoning contradictions, exposing it to criticism. Fairness, transparency, and legitimacy have been compromised, particularly as the principle of free evaluation of evidence, is conceptually incompatible with the prosecutorial burden of proof. However, it continues to be regarded as a safeguard of the presumption of innocence, even during the weighing process at the end of the trial. The book proposes a bespoke evidence law for the ICC: one that is neither transplanted from national legal orders nor eclectic in design, but uniquely crafted to meet the specific needs of each case. It offers legal scholars, judges, prosecutors, and practitioners a comprehensive analysis of the conceptual misunderstandings that affect evidentiary reasoning at the Court. It argues that a principled approach to evaluating international criminal evidence is essential for developing a consistent body of evidence law for International Criminal Tribunals.
