This work more than fulfills the requirement of a comprehensive volume on political processes and the structure of polities in pre-colonial India. It cuts across time and space, and provides the reader with an anthology of seminal contributions on the varied regions and different stages of Indian history. This book examines how the International Criminal Court (ICC) evaluates evidence within its hybrid legal framework, providing a comparative analysis of continental and common law traditions as applied in trial practice. It illustrates how the legal backgrounds of judges influence both conceptual and practical understanding of the prosecutorial burden of proof, the presumption of innocence, and the principle of free evaluation of evidence. These disparities create tensions in the way evidence is assessed. Focusing on key cases such as Bemba , Gbagbo , and Ongwen , the book identifies recurring challenges, including the tendency to confuse procedural rules with the rigorous reasoning process required by evidence law. It challenges the continental assumption that evidence law is merely a set of admissibility rules. It redefines it as a body of law that offers a structured method of reasoning, supporting a principled approach to the admissibility of evidence at the trial stage and its evaluation at the judgment stage. The lack of consistent, robust reasoning in the case law of the ICC on evidence issues has resulted in reasoning contradictions, exposing it to criticism. Fairness, transparency, and legitimacy have been compromised, particularly as the principle of free evaluation of evidence, is conceptually incompatible with the prosecutorial burden of proof. However, it continues to be regarded as a safeguard of the presumption of innocence, even during the weighing process at the end of the trial. The book proposes a bespoke evidence law for the ICC: one that is neither transplanted from national legal orders nor eclectic in design, but uniquely crafted to meet the specific needs of each case. It offers legal scholars, judges, prosecutors, and practitioners a comprehensive analysis of the conceptual misunderstandings that affect evidentiary reasoning at the Court. It argues that a principled approach to evaluating international criminal evidence is essential for developing a consistent body of evidence law for International Criminal Tribunals.

The essays collected in this book deal with the question how, throughout the history of Christianity, Christian communities have tried to construct their identity by anchoring their views in authoritative and normative sources. The main focus is upon the problem of historical foundation through textual traditions but other authoritative sources ( role of religious leaders; ritual traditions) are taken into consideration as well. The book takes as its point of departure the fact that with the rise of modernity the former dependence of western church and society on authoritative sources was called into question. Ever since, appeal to such sources is no longer self-evident; at times it is even regarded as problematic. Based on this radical change brought about by modernity, the book is divided in two main parts. The first part deals with the question how Christian churches and confessions ( Roman-Catholic and Protestant) confronted modernity and which role was played by authoritative sources in the tradition to the modern era. Special attention will be paid to the way in which Judaism reacted to many of the same impulses, both societal and religious ones. The second part deals with the premodern period, from early Christianity to the post-Reformation era, and focuses on the role authoritative traditions, textual or otherwise, have played in providing various Christian communities with a relative stable identity. The aim of the book is to elucidate processes resulting in the formation of authoritative traditions as well as the effects of these traditions on the identity of Christian and Jewish communities. In addition, the book attempts to clarify the various ways in which Christian and Jewish communities have reacted to the growing suspicion authoritative traditions aroused in the western world since the rise of modernity.

The book of Ezekiel has long astonished its readership. In the history of exegesis, the book's (supposed) author has often been regarded as mad or ill, or as suffering from \'Post-Traumatic Stress Disorder\' according to a recent diagnosis. The present study radicalizes this approach by investigating the book of Ezekiel as trauma literature. On the basis of a multi-faceted trauma hermeneutics the peculiarities as well as the inconsistencies of the book are shown to be material aspects of a fictionalised trauma process in the context of Israel's experiences of siege warfare and mass deportation in the early 6th century bce. The analysis demonstrates that the potential for violence inherent in the catastrophe has created not only an intense discourse about blame and punishment but also a theologically disturbing picture of a traumatized deity; in both cases the purpose is to assure the survival of Yhwh and the people. Das Ezechielbuch hat seine Leserschaft seit jeher verwundert und verwirrt. Den vermeintlichen Autor des Buches hat man im Laufe der Auslegungsgeschichte immer wieder pathologisiert - zuletzt ist Ezechiel mehrfach die Diagnose "Posttraumatische Belastungsstörung" attestiert worden. Die vorliegende Studie nimmt diesen Krankheitsansatz auf und radikalisiert ihn, indem sie das Ezechielbuch konsequent als fiktionale Trauma-Literatur analysiert. Vor dem Hintergrund einer mehrdimensionalen Trauma-Hermeneutik erschließt sie die Ezechielprophetie neu als literarisch-theologische Auseinandersetzung mit den traumatisierenden Kriegsereignissen, die Juda und Jerusalem zu Beginn des 6. Jh.s volumeu.Z. getroffen haben. Es zeigt sich, dass die ungeheure Gewaltfülle der Exilskatastrophe nicht nur einen massiven Schuld-Strafe-Diskurs, sondern auch das theologisch erschütternde Bild einer traumatisierten Gottheit aus sich herausgesetzt hat - beides mit dem Ziel, das Überleben JHWHs und des Volkes zu sichern.
