The Legacy of the Wimbledon Case : Centenary of the First Judgment of the Permanent Court of International Justice /

: The book addresses the impact of the first judgment of the 'World Court' on the development of international law and its continuing relevance. The contributions to this book discuss the legal issues decided by the PCIJ in the Wimbledon case. In the Wimbledon judgment, the Court referred to the problems that are still important both for procedural and substantive international law, and which attract the attention of states, courts and the academia today. These include: state sovereignty, sources of international law, interpretation of legal rights and obligations following from treaties and custom, 'objective regimes', 'self-contained regimes', neutrality in armed conflicts, the status of international waterways, as well as the issues of jurisdiction such as third-party participation in international adjudication, or locus standi for the protection of community interests.

The text of the Hebrew Bible and its editions : studies in celebration of the fifth centennial of the complutensian polyglot /

: In The Text of the Hebrew Bible and its Editions some of the top world scholars and editors of the Hebrew Bible and its versions present essays on the aims, method, and problems of editing the biblical text(s), taking as a reference the Complutensian Polyglot, first modern edition of the Hebrew text and its versions and whose Fifth Centennial was celebrated in 2014. The main parts of the volume discuss models of editions from the Renaissance and its forerunners to the Digital Age, the challenges offered by the different textual traditions, particular editorial problems of the individual books of the Bible, and the role played by quotations. It thus sets a landmark in the future of biblical editions.

Conceptualizing friendship in time and place /

: The concept of friendship is more easily valued than it is described: this volume brings together reflections on its meaning and practice in a variety of social and cultural settings in history and in the present time, focusing on Asia and the Western, Euro-American world. The extension of the group in which friendship is recognized, and degrees of intimacy (whether or not involving an erotic dimension) and genuine appreciation may vary widely. Friendship may simply include kinship bonds-solidarity being one of its more general characteristics. In various contexts of travelling, migration, and a dearth of offspring, friendship may take over roles of kinship, also in terms of care.

Biblical argument in Manichaean missionary practice : the case of Adimantus and Augustine /

: The use and appreciation of Scripture by the Manichaeans is a field of research with many unanswered questions. This study offers an investigation into the role of the Bible in the writings of the important Manichaean missionary Addas Adimantus (flor. circa 250 CE), one of Mani's first disciples. A major part of the book is dedicated to the reconstruction of the contents of his Disputationes, in which writing Adimantus attempted to demonstrate that the Old and New Testaments are absolutely irreconcilable. The most important source in this connection is Augustine, who refuted a Latin translation of Adimantus' work. A thorough analysis of the contents of the Disputationes brings to the fore that Adimantus was a Marcionite prior to his going over to Mani's church.

Ecclesial identification beyond late modern individualism? : a case study of life strategies in growing late modern churches /

: Why do some late modern churches grow, counter to the trend in Western Europe? Why do people identify with such churches - and does identification lead to morally transforming commitments beyond late modern consumerism? This case study investigates these questions based on 'real life' or empirical research, which include both the level of individual life strategies and organisational practice in two growing European churches. This innovative and interdisciplinary study draws on recent findings in theology, moral philosophy, sociology and organisational psychology. Its findings may prove useful not only for scholars in these disciplines, it may also enrich the reflection of practitioners who seek to perform the difficult art of transformational leadership in a late modern context.

Judge Manfred Lachs and Judicial Law-Making : Opinions on the International Court of Justice, 1967-1993 /

: This volume, the second in the series The Judges , which collects and synthesizes the opinions of leading international contemporary judges who have contributed significantly to the progressive development of international law, is devoted to the work of Judge Manfred Lachs, who was elected to the International Court of Justice in 1967. In his Foreword to the study, UN Secretary General Boutros Boutros-Ghali says of Lachs that ` His contribution to jurisprudence is especially noteworthy. He initiated a significant part of the jurisprudence of the Court in the area of human rights. He contributed to the formulation of the right to self-determination, helped to develop the law of the sea, and participated in the work of the Court in many other areas. But, above all, he was at the forefront of the most progressive battles of the Court, demonstrating great personal courage and great analytical rigour. As President of the Court, he showed a constant interest in improving its procedures and developing relations between the judicial organ and other organs of the United Nations. ' Edward McWhinney's masterly essay, which precedes extracts from Manfred Lachs' Opinions and from some Judgements in which he played a crucial role, is essential reading for all those interested in the World Court, as well for Manfred Lachs' countless admirers, students and colleagues. The ancient synagogue from its origins to 200 C.E. : a source book /

: Despite the recent explosion of research on ancient synagogues, investigators in the field have hitherto been forced to cull relevant evidence from a vast assortment of scholarly publications. This volume gathers for the first time all of the primary source material on the early synagogues up through the Second Century C. E. In the case of literary, epigraphic and papyrological evidence, catalog entries contain the texts in their original language and in English translation. For archaeological remains, entries provide technical descriptions along with plans and photographs. All listings are accompanied by bibliographic citations and interpretative comments. An Introduction frames the current state of synagogue research, while extensive indices and cross-references allow for easy location of specific allusions. An appendix to the catalog contains source materials on Jewish temples outside of Jerusalem.

The Cultural Heritage of Psychiatry and Its Literary Transformations : Middle Ages to the Present /

: This volume investigates the role of English, British, Irish, American, Canadian and Nigerian anglophone literary conceptualizations of mental and social distress, its diagnosis and treatment as transformative parts of the cultural heritage of psychiatry. Demonstrating that the history of psychiatry is not a narrative of unbridled, unequivocal progress, the volume explores how literary texts negotiate and critique dominant and alternative forms and traditions of treatment and care, how they challenge the medicalization of non-normative thoughts and behaviour and how they bear witness to and fragmentarily retrieve and imagine suppressed voices, thereby producing counter-cultural memories.

International Law and Business : Comparative Methods and Global Case Studies /

: This book introduces law in the context of international business. The basics of law are explored using a clear comparative methodology. International and regional economic institutions are discussed, next to the fundaments of private law. These include contract law, liability law, labour law, company law, privacy law, intellectual property law and international private law. The book goes beyond the usual focus on Western legal systems and uses examples from all over the world to provide students with comprehensive knowledge of business law. It is set up rather broadly, so that it can be used by teachers throughout their entire curriculum. Each chapter ends with a clear summary. With its colourful cases, this book is accessible and fun to read.

Indigenous Knowledge Systems : Towards a Holistic Inclusive Conservation /

: Although there has been, in recent times, a widespread interest in preservation and promotion of Indigenous Heritage or Knowledge Systems from a variety of disciplines and sectors, from across the globe - the design principles or modalities of a holistic conservation remains largely unexplored. This volume explores this lacunae and proposes the concept of Ecosemiotic Community Museuology (ECM), and a road map for it, through theory and practice. Based on the trajectories of conservation - natural, cultural and museological - down time, and indigenous epistemological premises brought forth from previous research, the treatise proposes the concept of ECM as a paradigm for successful community-based conservation of indigenous knowledge systems or indigenous biocultural heritage in its holistic wholeness. While taking into cognizance the issues of interfacing - namely, cross-cultural knowledge integration, Information and Communication Technologies (ICT) and Intellectual Property Rights (IPR), the volume attempts to add value to its basic ecosemiotic museological proposition, and strengthen its case, through presentation of, and comments on, a diverse range of secondary case studies of ongoing conservational initiatives from across the globe that highlight the ingredients of success as well as non-performance of such efforts. The ultimate goal of the historical surveys, intellectual exercises and the case studies in this volume are to capture the nuances that can help decolonize not just 'museology' or 'conservation' but 'development' and 'sustainability' itself. And, hopefully, help make advances towards a decentralized museological governance for the invaluable indigenous biocultural heritage that still lies strewn across the globe, in various stages of decimation.

Quantification : transcending beyond Frege's boundaries : a case study in transcendental-metaphysical logic /

: In his attempt to give an answer to the question of what constitutes real knowledge, Kant steers a middle course between empiricism and rationalism. True knowledge refers to a given empirical reality, but true knowledge has to be understood as necessary as well, and so consequently, must be a priori. Both demands can only be reconciled if synthetic a priori judgments are possible. To ground this possibility, Kant develops his transcendental logic. In Frege's program of providing a logicistic basis for true knowledge the same problem is at issue: his logicist solution places the quantifier into the position of the basic element connected to the truth of a proposition. As the basic element of a theory of logic, it refers at the same time to something in reality. Mołczanow argues that Frege's program fails because it does not pay sufficient attention to Kant's transcendental logic. Frege interprets synthetic a priori judgments as ultimately analytic, and thus falls back onto a Leibnizian rationalism, thereby ignoring Kant's middle course. Under the title of the transcendental analytic of quantification Mołczanow discusses Frege's concept of quantification. For Frege, the proper analysis of number words and the categories of quantity raises problems which can only be solved, according to Mołczanow, with the help of Kant's transcendental logic. Mołczanow's book thus deserves its places in the series Critical Studies in German Idealism because it provides a further elaboration of Kant's transcendental logic by bringing it into conversation with contemporary logic. The result is a new conception of the nature of quantification which speaks to our time.

Purity and the forming of religious traditions in the ancient Mediterranean world and ancient Judaism /

: Purity is a cultural construct that had a central role in the forming and the development of religious traditions in the ancient Mediterranean. This volume analyzes concepts, practices and images associated with purity in the main cultures of Antiquity, and discusses from a comparative perspective their parallel developments and transformations. The perspective adopted is both synchronic and diachronic; the comparative approach takes into account points of contact and mutual influences, but also includes major transcultural trends. A number of renowned specialists contribute a large variety of perspectives and approaches, combining archaeology, epigraphy and social history; in addition, particular attention is given to concepts of purity in ancient Israel and early Judaism as a 'test-case' of sorts. Through its extensive coverage, the volume contributes decisively to the present discussion about the forming of religious traditions in the ancient Mediterranean world.

Ancient Greek ekphrasis : between description and narration ; five linguistic and narratological case studies /

: In Ancient Greek Ekphrasis: Between Description and Narration Niels Koopman offers a thorough linguistic and narratological analysis of five canonical ancient Greek ekphraseis from the archaic to the Hellenistic period: Achilles' shield in Homer's Iliad (18.478-608), Heracles' shield in pseudo-Hesiod's Shield (139-320), the goatherd's cup in Theocritus' first Idyll (27-60), Jason's cloak in Apollonius Rhodius' Argonautica (1.721-68) and Europa's basket in Moschus' Europa (37-62). Ekphrasis, as the verbal representation of visual representation, is both text and image, which makes it a complex yet fascinating phenomenon. By investigating its descriptive and narrative properties, this study sheds light on the interplay between text and image at work in ekphrasis.

Coping with Evil in Religion and Culture : Case Studies /

: The various Christian, Muslim, traditional (African), and secular (Western) ways of imagining and coping with evil collected in this volume have several things in common. The most crucial perhaps and certainly the most striking aspect is the problem of defining the nature or characteristics of evil as such. Some argue that evil has an essence that remains constant, whereas others say its interpretation depends on time and place. However much religious and secular interpretations of evil may have changed, the human search for sense and meaning never ends. Questions of whom to blame and whom to address-God, the devil, fate, bad luck, or humans-remain at the center of our explanations and our strategies to comprehend, define, counter, or process the evil we do and the evil done to us by people, God, nature, or accident. Using approaches from cultural anthropology, religious studies, theology, philosophy, psychology, and history, the contributors to this volume analyze how several religious and secular traditions imagine and cope with evil.

Middle Kingdom Palace Culture and Its Echoes in the Provinces : Regional Perspectives and Realities /

: "Middle Kingdom Palace Culture and Its Echoes in the Provinces addresses the significant gaps that remain in scholarly understanding about the origins and development of Egypt's "Classical Age". The essays in this volume are the end result of a conference held at the University of Jaén in Spain to study history, archaeology, art, and language of the Middle Kingdom. Special attention is paid to provincial culture, perspectives, and historical realities. The distinguished group of Egyptologists from around the world gathered to consider the degree of influence that provincial developments played in reshaping the Egyptian state and its culture during the period. This volume aims to take a step towards a better understanding of the cultural renaissance, including the ideological transformations and social reorganization that produced the Middle Kingdom"--

Probing the depths of evil and good : multireligious views and case studies /

: In the few years since the attack on the World Trade Center on September 11, 2001, evil has become a central theme in the media and human consciousness: the evil of terrorism, the evil of secular culture, concern for poverty, and climate change... Yet different cultures and religious traditions have different ideas of what evil is and what its root causes are. Although there is no massive clash of cultures, many disagreements and also conflicts in the world arise from the deep differences in views of evil. This volume explores religious views of evil. Scholars from different religions and from various parts of the world describe how people probe the depths of evil-and by necessity that of good-from their own background in various worldviews. In their explorations, almost all address the need to go beyond morality, and beyond legalistic definitions of evil and of good. They point to the radical depths of evil in the world and in human society and reinforce our intuition that there is no easy solution. But if we can gain a better understanding of what people from other worldview traditions and cultures consider evil, we are that much closer to a more peaceful world.

The Nadars of Tamilnad : The Political Culture of a Community in Change /

: Among the various communities of South India, the Nadars have perhaps most clearly evidenced the impact of change over the past 200 years. Considered by high-caste Hindus in the early nineteenth century to be of extremely low status, the Nadars-toddy-tappers, climbers of the palmyra palm-suffered severe social disabilities and were among the most depressed communities in the Tamil country. Because of their sensitive response to social and economic change over the past century and a half, the Nadars have today become one of the most successful groups in the South, in both economic and political terms, and considerable command respect. From among their numbers have come leaders in business, industry, and the professions; and in politics, Kamaraj, their illustrious son, brought fame to the caste as Chief Minister of Madras and as President of the Indian National Congress. The Nadars have had a turbulent and colourful history. Their struggle to rise above their depressed condition assumed dramatic forms in a series of escalating confrontations between the caste and its antagonists. From the breast-cloth controversy through the sack of Sivakasi to the Nadar Mahajana Sangam, the Nadars' rise, exemplifying the processes of mobilization in Indian society, provides rich material for an analysis of the political life of a community in change. When the book was first published in 1969, Lloyd Rudolph wrote, 'Hardgrave illuminates in ways hitherto unexplored the processes of social and political change that have so profoundly affected India. I judge his book to be one of the most important and exciting studies in the Indian field in recent years'. With this reissue, The Nadars of Tamilnad is again available, and its compelling portrayal of a caste in transition stands as, one reviewer wrote, 'one of the landmarks in South Indian social history'.

Euripides' Bacchae : the play and its audience /

: The purpose of this book is to investigate what it was Euripides intended to convey to the theatre-going public of his day when he wrote his most exciting and most gruesome play, the Bacchae . The meanings which are to be attached to the action of a play are woven by an audience, both during and after the performance, into a single dramatic experience, labelled in this book as 'audience response'. After some introductory chapters dealing with the history of the interpretation of the Bacchae and with the theory of audience response, the main part of the book is devoted to a detailed analysis of the action of the play (chapters 4 and 5), and to a study of Dionysus in his various apects in Athenian life and in his appearances in earlier literature and on the tragic stage. The discussion of the choruses concentrates on the choruses' repeated utterances about cleverness and wisdom, which form the core of the Dionysian propaganda of the play. The most immediate results of this new interpretation of the Bacchae are that the widely-accepted view of Pentheus as a dark puritan, a man possessed by the Dionysian qualities of his divine opponent, proves to be untenable, and that that which in the past has been rightly called the overriding theme of the play - the god's epiphany - also contains the poet's most serious and ironical discussion of divinity and of man's treatment of it. The problems of the Greek text are given full discussion, mainly in the nots and appendices. In many cases new solutions are proposed; some new problems are however added.
