The Legacy of the Wimbledon Case : Centenary of the First Judgment of the Permanent Court of International Justice /
:
The book addresses the impact of the first judgment of the 'World Court' on the development of international law and its continuing relevance. The contributions to this book discuss the legal issues decided by the PCIJ in the Wimbledon case. In the Wimbledon judgment, the Court referred to the problems that are still important both for procedural and substantive international law, and which attract the attention of states, courts and the academia today. These include: state sovereignty, sources of international law, interpretation of legal rights and obligations following from treaties and custom, 'objective regimes', 'self-contained regimes', neutrality in armed conflicts, the status of international waterways, as well as the issues of jurisdiction such as third-party participation in international adjudication, or locus standi for the protection of community interests.

A new model of religious conversion : beyond network theory and social constructivism /
:
Based on the analysis of 52 conversion narratives to various religious groups, A New Model of Religious Conversion utilizes case studies for comparison of converts' backgrounds, network influence, and conversion narratives. The author convincingly illustrates a \'fit\' between the converts' background and the religion they convert to, such as between disorganized family backgrounds and highly structured religions. Conversely, those from highly structured backgrounds often convert to more \'open\' groups. The book also makes it clear that not all conversions are influenced by networks or align themselves with a social constructivist view of a conversion as an \'account.\' Taking converts' trajectories seriously, the author makes a strong case for the application of biographical sociology to the study of conversion and (American) sociology overall.

The Rome Statute and Islamic Law : A Comparative Analysis with Special Reference to Saudia Arabia /
:
This book examines in depth the degree of compatibility and incompatibility between the general principles and jurisdiction of Islamic law and international criminal law (the Rome Statute). It discusses the controversy related to the non-ratification of the Rome Statute by some Islamic and Arab countries. The author analyses arguments that maintain that Islamic law cannot be compatible with international criminal law, and makes it clear that there are no fundamental differences between the principles of Islamic law and the principles of international criminal law. The book considers Saudi Arabia as a case for reference. See Less

Jews and Christians in the Roman World : From Historical Method to Cases /
:
Roman Judaea, Christian origins, and Roman-Judaean-Christian relations are flourishing fields of endless fascination. Amid the flurry of new research, however, which uses ever new methods in the humanities and social sciences, basic questions about what happened and how people then understood events are easily obscured. This book argues that a simple but consistent historical method can throw new light - and challenge entrenched views - on such familiar topics as Roman provincial governance, the Jewish War, Flavian politics, Judaea after King Herod, Jewish and Christian historiography, Pharisees and Essenes, John the Baptist, the apostle Paul, and Luke-Acts.

Judge Manfred Lachs and Judicial Law-Making : Opinions on the International Court of Justice, 1967-1993 /
:
This volume, the second in the series The Judges , which collects and synthesizes the opinions of leading international contemporary judges who have contributed significantly to the progressive development of international law, is devoted to the work of Judge Manfred Lachs, who was elected to the International Court of Justice in 1967. In his Foreword to the study, UN Secretary General Boutros Boutros-Ghali says of Lachs that ` His contribution to jurisprudence is especially noteworthy. He initiated a significant part of the jurisprudence of the Court in the area of human rights. He contributed to the formulation of the right to self-determination, helped to develop the law of the sea, and participated in the work of the Court in many other areas. But, above all, he was at the forefront of the most progressive battles of the Court, demonstrating great personal courage and great analytical rigour. As President of the Court, he showed a constant interest in improving its procedures and developing relations between the judicial organ and other organs of the United Nations. ' Edward McWhinney's masterly essay, which precedes extracts from Manfred Lachs' Opinions and from some Judgements in which he played a crucial role, is essential reading for all those interested in the World Court, as well for Manfred Lachs' countless admirers, students and colleagues. This original work makes a significant contribution to the international academic community, by describing Japan's climate cases, previously little known internationally.

Arbitral Awards of the Cairo Regional Centre for International Commercial Arbitration - Arbitral Awards of CRCICA Volume 2 (1997-2000) /
:
The cases are edited and translated by the prominent legal scholar, arbitrator and lawyer Dr. Mohie Eldin I. Alam-Eldin. His in-depth commentary on the thirty-four cases included in this volume encompasses discussion of emerging new arbitral trends and principles, such as the alter ego and contra preferentum doctrines, and new approaches to arbitration engendered by the ever-growing and changing practises and patterns of internatuional trade. He also analyses many of the new issues raised by the decisions of the court of appeal in cases where arbitral awards proved unsatisfactory. Many of these court of appeal decisions are included in the text, as are relevant decisions of the Supreme Court of Egypt. This second series of cases brought before the Cairo Regional Centre for International Commercial Arbitration covers the period 1997-2002, years which witnessed a major growth in confidence in the Centre and a corresponding expansion in scope, procedure, and legal principles. Perhaps most notable among these important developments is the evolution of hybrid procedures that permit the harmonization of legal cultures among parties. In this book will be found a number of cases which successfully blend common law, civil law, and Sharia principles while rigorously adhering to the agreements between the parties, all applicable law, and guarantees of defence. The subject matter of the international disputes arbitrated includes the following: - Supply - Hotel management - Software contracts - Oil contracts - Distributorship contracts - Insurance contracts - Credit risk management contracts - Construction - Commercial agency The significance of the Cairo Regional Centre for International Commercial Arbitration, as a forward-looking and innovative institution directly influencing business activity in some of the most important areas of global commerce, can hardly be overstated. This book validates and reinforces the Centre pivotal role, and will be of inestimable value to the international commercial arbitration community.

Arbitral Awards of the Cairo Regional Centre for International Commercial Arbitration /
:
The Arbitral Awards of the Cairo Regional Centre for International Commercial Arbitration addresses many significant issues and questions, including the following: * Do rules of limitation have a role in arbitration? * How greatly do administrative contracts differ from civil contracts in the closing years of this century? * Obtaing permissions of works - is this the task of the employer or the contractor? * What can the arbitrator do if several exchange rates apply to the consideration of a contract? It is expected that by the end of 1999 the number of international arbitration cases registered with the Centre will have reached 200. While individual CRCICA awards have occasionally been published, there has never been an independent compilation of all the awards issued by the Centre. This important new volume contains a collection of arbitral awards made up to 1996, with those made originally in Arabic translated into English. The editors have summarised each award and included commentary where appropriate, and the awards are followed by legislative or statutory articles as relevant.

The scriptural tale in the fourth gospel : with particular reference to the prologue and a syncretic (oral and written) poetics /
:
A more nuanced view of the Fourth Gospel's media nature suggests a new and promising paradigm for assessing expansive and embedded uses of scripture in this work. The majority of studies exploring the Fourth Evangelist's use of scripture to date have approached the Fourth Gospel as the product of a highly gifted writer, who carefully interweaves various elements and figures from scripture into the canvas of his completed document. The present study attempts to calibrate a literary approach to the Fourth Gospel's use of scripture with an appreciation for oral poetic influences, whereby an orally-situated composer's use of traditional references and compositional strategy could be of one and the same piece. Most importantly, pre-formed story-patterns-thick with referential meaning-were used in the construction of new works. The present study makes the case that the Fourth Evangelist has patterned his story of Jesus after a retelling of the story of Adam andamp; Israel in two interrelated ways: first in the prologue, and then in the body of the Gospel as a whole.
