Legal pluralism in Muslim contexts /

: Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. Human rights and the impact of religion /

The Animal Names of the Arab Ancestors : Explaining the Non-human Names of Arab Kinship Groups, Volume 2-1 Appendices /

: In the Arab world, people belong to kinship groups (lineages and tribes). Many lineages are named after animals, birds, and plants. Why? This survey evaluates five old explanations - "totemism," "emulation of predatory animals," "ancestor eponymy," "nicknaming," and "Bedouin proximity to nature." It suggests a new hypothesis: Bedouin tribes use animal names to obscure their internal cleavages. Such tribes wax and wane as they attract and lose allies and clients; they include "attached" elements as well as actual kin. To prevent outsiders from spotting "attached" groups, Bedouin tribes scatter non-human names across their segments, making it difficult to link any segment with a human ancestor. Young's argument contributes to theories of tribal organization, Arab identity, onomastics, and Near Eastern kinship.

: Purity is a cultural construct that had a central role in the forming and the development of religious traditions in the ancient Mediterranean. This volume analyzes concepts, practices and images associated with purity in the main cultures of Antiquity, and discusses from a comparative perspective their parallel developments and transformations.
