Perspectives for Space Law in the Twenty-First Century /

The course evaluates the different phases of the development of space law against the background of the development of public international law. An analysis of current international space law investigates whether the body of law is ready for the challenges of outer space commercialisation and the rise of "New Space" in the 21st century. To accomplish this, it peruses through existing space law treaties, in particular the foundational Outer Space Treaty, as well as other sources of space law. Discovering that international space law developed as a permissive law that would enable the further evolution of space technology yet with sufficient foresight to understand that such evolution will require provisions for the preservation of the international common that is outer space, the author examines several avenues for the future evolution of space law. Among these, the author proposes several notions in order to preserve space law's initial character as a law for the protection of the international commons of "outer space" on the one hand, and pay attention to an equitable distribution of the benefits derived from the resources of outer space on the other hand.

Even though scholars have known of Neo-Babylonian legal texts almost since Assyriology's very beginnings, no comprehensive study of court procedure has been undertaken. This lack is particularly glaring in light of studies of court procedure in earlier periods of Mesopotamian history. With these studies as a model, this book begins by presenting a comprehensive classification of the text-types that made up the \'tablet trail\' of records of the adjudication of legal disputes in the Neo-Babylonian period. Religions challenged by contingency : theological and philosophical approaches to the problem of contingency /

In this volume, the relationship between religion and contingency is investigated. Its historical part comprises analyses of important philosophers' interpretations of this relationship, viz. that of Leibniz, Kant, Lessing, Jaspers, and Heidegger. Its systematic part analyses how this relationship should be currently (re-)interpreted. The upshot of the different interpretations is a re-evaluation of the traditional assumption that accepting contingency is detrimental to the pursuit of religion. It is shown that a number of the philosophers scrutinized are not as critical regarding the acceptance of (certain sorts of) contingency in the religious realm as is often thought, and the systematic contributions show that it may be unavoidable, sometimes even desirable, to accept contingency when dealing with religion. Ancient Jewish writings combine interpretive narratives of Israel's sacred history with legal prescriptions for a divinely ordered way of life. Two ancient Jewish societies have left us extensive textual corpora preserving interpenetrating legal and narrative interpretive teachings: the sectarian community of the Dead Sea Scrolls and the sage-disciple circles of the early Rabbis. This book comprises studies that explore specific aspects of the interplay of interpretative, narrative, and legal rhetoric with an eye to pedagogic function and social formation for each of these communities and for both of them in comparison. It addresses questions of how best to approach these writings for purposes of historical retrieval and reconstruction by recognizing the inseparability of literary-rhetorical textual analysis and a non-reductive historiography.

This book is based on extensive anthropological field-research in Kebkabiya, a town in Darfur, West-Sudan(1990-1995), when the Islamist government of Sudan had just come to power. The title of the book is a conflation of two main government perspectives on the role of women. These proved to be decisive for the ways in which two classes of working women - low-class market women and highly esteemed female teachers- negotiated their identities within the Islamist moral discourse on gender. The book focuses on the biographic narratives of one woman from each class, which are analysed as part of the multi-layered context in which the woman spoke and acted - and of which the author also formed part. Finally, the author reflects on the war in Darfur as part of a process of identities-in-construction.

Life at the Bottom of Babylonian Society is a study of the population dynamics, family structure, and legal status of publicly-controlled servile workers in Kassite Babylonia. It compares some of the demographic aspects proper to this group with other intensively studied past populations, such as Roman Egypt, Medieval Tuscany, and American slave plantations. It suggests that families, especially those headed by single mothers, acted as a counter measure against population reduction (flight and death) and as a means for the state to control this labor force. The work marks a step forward in the use of quantitative measures in conjunction with cuneiform sources to achieve a better understanding of the social and economic forces that affected ancient Near Eastern populations.

What is good, and what God demands : normative structures in Tannaitic literature /

The normative rhetoric of tannaitic literature (the earliest extant corpus of rabbinic Judaism) is predominantly deontological. Prior scholarship on rabbinic supererogation, and on points of contact with Greco-Roman virtue discourse, has identified non-deontological aspects of tannaitic normativity. However, these two frameworks overlook precisely the productive intersection of deontological with non-deontological, the first because supererogation defines itself against obligation, and the second because the Greco-Roman comparate discourages serious treatment of law-like elements. This book addresses ways in which alternative normative forms entwine with the core deontological rhetoric of tannaitic literature. This perspective exposes, inter alia, echoes of the post-biblical wisdom tradition in tannaitic law, the rich polyvalence of the category mitzvah, and telling differences between the schools of Akiva and Ishmael.

During the era of Sultan Abdülhamid II, modern state institutions were established in Palestine, while national identities had not yet developed. Hamidian Palestine explores how the inhabitants of the Ottoman District of Jerusalem interacted with each other and how they organised their interests in a historical moment before 'Arabs' and 'Jews' emerged as the central political categories in the country. Based on a wide range of Arabic, Turkish and Hebrew sources, the book examines the social and political relations of Palestinians from a wide variety of perspectives. By situating individual case studies within larger contexts such as modernisation, regionalisation and state-building, it allows Palestinian society to be compared with other local societies within the Ottoman Empire and beyond.
