Extraterritoriality in Comparative Perspective /

: Extraterritoriality is often understood as an exceptional, sometimes even illegitimate, form of state lawmaking-yet it is pervasive in contemporary practice. Countries around the world rely on extraterritorial regulation to protect local markets, in areas including competition law and data privacy. It is also recognized as a useful strategy to promote international human rights, and to address shared challenges as diverse as transnational crime, tax base erosion, and climate change. The normalization of extraterritoriality as a legal technique, however, has by no means resolved longstanding debates about its place in the international legal order. Containing in-depth studies of fifteen legal systems, this volume provides a critical comparative perspective on those debates.

Islamic Ethics and the Trusteeship Paradigm : Taha Abderrahmane's Philosophy in Comparative Perspectives /

: Islamic Ethics and the Trusteeship Paradigm explores the emerging ethical theory of the trusteeship paradigm as developed by the Moroccan philosopher Taha Abderrahmane (b. 1944). The volume, with contributions in English and Arabic, examines the development of this modern Islamic theory of ethics and how it permeates various disciplines: philosophy, theology, legal theory, moral theory, sociology and anthropology, communication, environment and biomedical ethics. The trusteeship paradigm aims to make ethics the compass of human thinking and action in order to overcome the predicaments humanity faces and realize a more just and balanced world. This makes of it one of the principal and profound ethical theories in Islamic scholarship that engages both classical and modern thought.

Japanese Art - Transcultural Perspectives /

: The transcultural approach to Japanese art history embraced by the contributors to this volume centers on the dynamic aesthetic, artistic, and conceptual negotiations across cultural, temporal, and spatial boundaries. It not only acknowledges material objects, people, and technologies as agents, but also intangible practices such as knowledge and concepts as vital agencies of interaction in transcultural processes. With its premise on connectivity, trans-territoriality, networks, and their transformative potential, this research destabilizes categorical configurations such as "center vs. periphery" and "high vs. low," calling into question the classical canon of Japanese art history. Philosophical and Theological Perspectives on the Figure of Job : The Disruptive Challenges of God /

: The Book of Job remains one of the most profound and unsettling texts in religious and philosophical thought, raising timeless questions about suffering, justice, and the human relationship with the divine. Philosophical and Theological Perspectives on the Figure of Job brings together a diverse collection of essays that explore Job's narrative from multiple perspectives-philosophical, theological, comparative, and literary-without reducing its complexity or imposing a singular interpretation. Engaging with thinkers such as Kant, Kierkegaard, and René Girard, as well as Islamic kalām , William Blake's visual reinterpretations, and María Zambrano's poetic reason, this volume examines Job both as a subject of inquiry and as a figure that continues to challenge and inspire. Rather than offering definitive answers, these essays preserve the tensions within Job's story, demonstrating its enduring relevance in contemporary debates on suffering, justice, and the limits of human understanding.

Israel Among the Nations : International and Comparative Law Perspectives on Israel's 50th Anniversary /

: This book, written on the occasion of Israel's 50th Anniversary, underlines the tension between Israel, the unique Jewish State among nations, and Israel, a nation like many others. On the one hand, it analyzes her special features: the founding of the State, Israel's contributions to the development of the Law of Nations, and her complex relations with the United Nations. On the other hand, it cautions against originality where harmony is required. Citizens can only enjoy their rights and freedoms if constitutionalism and constitutional values are given a firm legal basis. Legislation and jurisprudence must provide them with the certainty and the security needed to acquire rights, conduct their affairs and engage in transactions both domestic and foreign. The experience gained in the European Community and other European States on their road to harmonization could provide helpful guidance.

Perspectives for Space Law in the Twenty-First Century /

: The course evaluates the different phases of the development of space law against the background of the development of public international law. An analysis of current international space law investigates whether the body of law is ready for the challenges of outer space commercialisation and the rise of "New Space" in the 21st century. To accomplish this, it peruses through existing space law treaties, in particular the foundational Outer Space Treaty, as well as other sources of space law. Discovering that international space law developed as a permissive law that would enable the further evolution of space technology yet with sufficient foresight to understand that such evolution will require provisions for the preservation of the international common that is outer space, the author examines several avenues for the future evolution of space law. Among these, the author proposes several notions in order to preserve space law's initial character as a law for the protection of the international commons of "outer space" on the one hand, and pay attention to an equitable distribution of the benefits derived from the resources of outer space on the other hand.

The 'Abbasid and Carolingian Empires : comparative studies in civilizational formation /

: Circa AD 750, both the Islamic world and western Europe underwent political revolutions; these raised to power, respectively, the ʿAbbasid and Carolingian dynasties. The eras thus inaugurated were similar not only in their chronology, but also in the foundational role each played in its respective civilization, forming and shaping enduring religious, cultural, and societal institutions. The ʿAbbāsid and Carolingian Empires: Studies in Civilizational Formation , is the first collected volume ever dedicated specifically to comparative Carolingian-ʿAbbasid history. In it, editor D.G. Tor brings together essays from some of the leading historians in order to elucidate some of the parallel developments in each of these civilizations, many of which persisted not only throughout the Middle Ages, but to the present day. Contributors are: Michael Cook, Jennifer R. Davis, Robert Gleave, Eric J. Goldberg, Minoru Inaba, Jürgen Paul, Walter Pohl, D.G. Tor and Ian Wood.

World Literature as Geoculture /

: World Literature as Geoculture applies a geopolitical perspective to literature. It considers literature, along with all other cultural elements, as both formed by and constitutive of a region's, nation's, or continent's global position. The book opens with a chapter discussing the general relation between geopolitics and world literature. It then turns to more detailed discussions of the relations between nation and literature, European literature, comparative literature and translation, global south relations, the rise and fall of literary movements or currents as reflecting geopolitical shifts, and the position of small or minor literatures. Specific chapters focus on magical realism, Edward Said, Chinese comparative literature scholarship, and Flemish literature.

Adventure at Arms : On the Narrative Formation of Violence /

: Adventure fiction suggests that social conflicts can be displaced from the centre to the periphery of culture in order to be settled there by violent means. Its protagonists are endowed with extraordinary physical agency and a strange resilience to bodily and psychic wounds. This volume proposes a critical analysis of adventurous violence that foregrounds narratological issues as well as their socio-historical, political, and anthropological implications. Predicated on a broad diachronic perspective that challenges simple generalizations, the articles presented here cover a wide array of genres from ancient romance to the swashbuckling novel and a variety of contexts ranging from early modern state-building to colonialism, imperialism, and modern warfare.

Sunni Communities in the Islamic Republic of Iran, 2013-2021 : Securitization, Secularization and Privatization /

: Sunni-Shia relations in Iran offer an analytical guide for the interpretation of inequality, securitization, and immigration. This book reorients our understanding of contemporary Iran by answering still unacknowledged questions: how is the relationship, the interaction and socio-political behaviour between the Islamic Republic and its Sunni minorities? Using unexamined sources and fieldwork, Hessam Habibi Doroh shows a clear insight into the life of Iranian Sunnis, their contention and cooperation with the state during Hasan Rouhani´s presidency. Comparison with the wider region complements this nuanced portrayal of impacts of privatization, secularization, and securitization on the sectarian relations between the state and its minorities. .

Purity and the forming of religious traditions in the ancient Mediterranean world and ancient Judaism /

: Purity is a cultural construct that had a central role in the forming and the development of religious traditions in the ancient Mediterranean. This volume analyzes concepts, practices and images associated with purity in the main cultures of Antiquity, and discusses from a comparative perspective their parallel developments and transformations. The perspective adopted is both synchronic and diachronic; the comparative approach takes into account points of contact and mutual influences, but also includes major transcultural trends. A number of renowned specialists contribute a large variety of perspectives and approaches, combining archaeology, epigraphy and social history; in addition, particular attention is given to concepts of purity in ancient Israel and early Judaism as a 'test-case' of sorts. Through its extensive coverage, the volume contributes decisively to the present discussion about the forming of religious traditions in the ancient Mediterranean world.

Lectures on the Origin and Growth of Religion : As Illustrated by Some Points in the History of Indian Buddhism /

: This book was published under the Hibbert Lecture Series, 1881. The volume talks about Buddhism, its origins, and its development as a mainstream religion. The first lecture talks about philosophy during its emerging stage, and it is discussed in parallel to certain concepts which were prevalent before Buddhism such as monotheism, transmigration, pantheism, animism, polytheism, and other reformation made before the establishment of Buddhism, etc. This series also covers the assessment of certain Buddhist canons like Pali pitakas and discusses the fundamental Buddhist concepts such as karma. Also, the hagiographical literature of Buddha and various forms of Buddhism practiced post-Buddha's death are discussed in this lecture series. Overall, this book is written from the perspective of comparative studies with non-Buddhist traditions prevalent during the Buddha's period and afterward.

Social identity and sectarianism in the Qumran movement /

: 'Identity' and 'sectarianism', two crucial and frequently used concepts in Qumran studies, are here problematized, appraised, and redefined. Two social-scientific theories inform the investigation of the serakhim (rule documents) and pesharim (commentaries). The sociology of sectarianism is presented in retrospect in order to identify appropriate methodological tools for speaking about sectarianism in the ancient context, and for comparing sectarian stances in the serakhim . Furthermore, a social-psychological perspective into identity is introduced for the first time for appreciating the dynamic and context-dependent nature of a person's social identity. The final chapter takes a fresh approach to the study of the pesharim , arguing for the need to read each Pesher as a whole. It analyses the prototypical 'teacher' and brings forward new interpretations of this captivating and cloudy figure.

Connectors and Dividers : The Challenges and Prospects for Conflict Transformation in Kashmir and Sri Lanka /

: South Asia is characterised by a change in the nature of contemporary armed conflict, a shift from interstate to intrastate armed conflict. This change is closely enmeshed in post-colonial concerns of competing national identities, historical memories, politics of deprivation and legitimacy. It creates challenges for scholars, policymakers and practitioners alike, who are to develop responses to conflicts in South Asia. The liberal, state-centric emphasis in the fields of political science and international relations often precludes a civil society-initiated contextual analysis that focuses on societal tensions. Therefore, there is a significant lacuna in the literature that can inform policy on a practical level. This monograph aims to compensate for this lacuna by providing a comparative analysis of societal Connectors and Dividers (C&D) in Kashmir and Sri Lanka that have the potential to inform policy. This empirical work utilises the C&D analytical tool within the Do No Harm Framework (Anderson 1999), in order to uncover the hidden potential within the tool to aid policy implementation at a national level, and to provide pathways for Conflict Transformation in Kashmir and Sri Lanka. The C&D tool is widely utilised in evaluating humanitarian projects, to assess whether any of the actions may result in an unintended negative repercussion, while progressing with the project outcomes. However, at a national policy-setting level, this tool is unused. It is argued that sustainable conflict transformation hinges on imaginative capacities to transcend vicious cycles of violence. Contemporary International Law Issues: Opportunities at a Time of Momentous Change /

: Contemporary International Law Issues: Opportunities at a Time of Momentous Change is the record of the Second Joint Conference of The American Society of International Law and the Nederlandse Vereniging voor Internationaal Recht, which was held in The Hague, on July 22--24, 1993. At this event international scholars, practitioners and experts gathered to discuss the latest developments in such areas as trade and investment, the environment, human rights, law of the sea, settlement of disputes, international criminal law, NAFTA, the European Community, and commercial arbitration with particular reference to Central and Eastern Europe. The content of these Proceedings bears evidence of the wide range of dialogue that occurred during the Joint Conference and directs the reader to issues which might form suitable subjects for further research and elaboration in other scholarly work. The book will be of interest to academics and diplomats, as well as legal practitioners.

Immanenz and Einheit : Festschrift zum 70.

Based on the oeuvre of Michel Henry, the contributions collected in the Festschrift "Immanenz und Einheit" examine the relation between immanence and unity under general systematic and practical aspects. First, the foundation of this relation in occidental metaphysics and in phenomenology, especially in the thinking of Michel Henry, is analysed. Then, the view of Michel Henry is compared with those of Meister Eckhard, Fichte, Christian theology and eastern religions in order to develop the perspectives of this relation for the Philosophy of Religion. Furthermore, the consequences of the relation between immanence and unity for ethics and its existential significance are considered. Thus, the Festschrift offers a significant contribution to the understanding of the relationship between immanence and unity which is especially relevant for the thinking of Michel Henry.
