Legal pluralism in Muslim contexts /

: Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. The volume is based on papers presented at a conference in Münster (Germany) in 2016 and comprises contributions by Judith Koschorke, Karen Meerschaut, Yvonne Prief, Ulrike Qubaja, Werner de Saeger, Ido Shahar, Katrin Seidel, Konstantinos Tsitselikis, Vishal Vora and Ihsan Yilmaz.

The Winter Missal of Arnold of Rummen : Huis van het boek, Ms. 10 A 14 /

: The Hundred Years' War, the Plague, the van Artevelde uprising, conflict between a count and an aspiring count, Corpus Christi and the Eucharist--these are the context for the enigmatic manuscript studied in this book. Above all, this missal from Ghent is outstanding for its rich and inventive penwork flourishing, given life by the prayer-pulses of the text and enriched by cycles of development. The lowly two-line initial emerges as the primary locus of creative interaction between painting and flourishing. Illumination, produced by a priest and a layman, is notable for its theological richness and is enlivened by distinctive gorgons.

African and European readers of the Bible in dialogue : in quest of a shared meaning /

: Far too long, the relationship between European and African biblical scholarship has been a non-relationship. Divergent insights into how biblical texts should be interpreted and made fruitful for the current context, cultural differences, colonial past and post-colonial future, radically different social situations - this all made companionship and real interaction difficult. This rich and multilayered volume (result of a Stellenbosch conference 2006) attempts to disclose new modes of dialogue between readers of the Bible from those two worlds. More than twenty theologians from Africa and Europe reflect together on how readers from radically different contexts - professional and ordinary alike -, may become allies in an ethically accountable way of relating the biblical text to their current (global) situations and how a process of mutual learning may be established. This book provides important insights in intercultural hermeneutics, the relationship between classical historico-literary approaches and new forms of interpretation. It also gives examples of new forms of how to read the Bible in the secularised European context and the HIV/Aids stricken Africa. Particularly enriching is that every contribution is followed by a personal letter of response of another contributor to the book, giving impulses for further dialogue and debate. The book is useful for all biblical scholars and students, in particular for those interested in how to do contextual exegesis in a manner that also takes into account the context of the other.

Self, Soul and Body in Religious Experience /

: The papers in this volume were delivered at the first international colloquium by the Jacob Taubes Minerva Center for Religious Anthropology at Bar Ilan University, held in February 1995. Concepts of Self, Soul and Body are so close to the physiological layers of life that we may imagine them to be biological as well; but in fact, they are social constructs, and a source of fundamental metaphors for the classification of experience. They thus help organize the world, at the same time as they express basic human identity. They vary from culture to culture and can productively be compared and contrasted from one setting to another. We intend these papers to be a test case of the benefit to be gained from attention to Religious Anthropology.

Jesuit Rhetoric across Space and Time : Local and Global Perspectives /

: A product of Renaissance educational thought, Jesuit rhetoric has trained generations of churchmen and lay citizens right up to the present day. This book aims to show the wealth of current international research on Jesuit rhetoric, in its pedagogical dimension (from sixteenth-century manuals to today's university writing courses), its practical implementation (in speeches, music or theology). These dialogues span both religious contexts-engagements with Protestants, Jews, Orthodox Christians, and Dominicans-and geographical ones, including encounters between Europe and regions such as Sri Lanka, China, and Japan.

Homer and the Bible in the eyes of ancient interpreters /

: Thus far intepretations of Homer and the Bible have largely been studied in isolation even though both texts became foundational for Western civilisation and were often commented upon in the same cultural context. The present collection of articles redresses this imbalance by bringing together scholars from different fields and offering prioneering essays, which cross traditional boundaries and interpret Biblical and Homeric interpreters in light of each other. The picture which emerges from these studies in highly complex: Greek, Jewish and Christian readers were concerned with similar literary and religious questions, often defining their own position in dialogue with others. Special attention is given to three central corpora: the Alexandrian scholia, Philo, Platonic writers of the Imperial Age, rabbinic exegesis.

God in the courtroom : the transformation of courtroom oath and perjury between Islamic and Franco-Egyptian law /

: This volume compares the courtroom oaths of both Islamic and modern Egyptian legal systems, blending elements of legal history, comparative law, theology, philosophy and culture. Until now, academic research has paid little attention to the subject of the courtroom oath in the Islamic or Egyptian legal systems. As such, it might appear as if modern legislation in the Arab world on this subject forms the natural continuation of Islamic law, or that there are no significant differences between these two legal approaches. This unique study seeks to rectify this impression by examining the institution of the courtroom oath on the basis of three criteria: Islamic law, which discusses the oath in the context of the judicial proceeding, including debate between different schools and interpreters; the sources and approach of Arab law on this subject; and, lastly, the core of this book - a detailed legal comparison between the Islamic oath and the Arab oath. In itself, this is a study in legal history examining the origins, character, sources, and doctrines of the oath in Arab law and at the same time, it is a comparative study of Islamic and contemporary Arab law in this field.
