Extraterritoriality is often understood as an exceptional, sometimes even illegitimate, form of state lawmaking-yet it is pervasive in contemporary practice. Countries around the world rely on extraterritorial regulation to protect local markets, in areas including competition law and data privacy. It is also recognized as a useful strategy to promote international human rights, and to address shared challenges as diverse as transnational crime, tax base erosion, and climate change. The normalization of extraterritoriality as a legal technique, however, has by no means resolved longstanding debates about its place in the international legal order. Containing in-depth studies of fifteen legal systems, this volume provides a critical comparative perspective on those debates.

This book examines how the International Criminal Court (ICC) evaluates evidence within its hybrid legal framework, providing a comparative analysis of continental and common law traditions as applied in trial practice. It illustrates how the legal backgrounds of judges influence both conceptual and practical understanding of the prosecutorial burden of proof, the presumption of innocence, and the principle of free evaluation of evidence. These disparities create tensions in the way evidence is assessed. Focusing on key cases such as Bemba , Gbagbo , and Ongwen , the book identifies recurring challenges, including the tendency to confuse procedural rules with the rigorous reasoning process required by evidence law. It challenges the continental assumption that evidence law is merely a set of admissibility rules. It redefines it as a body of law that offers a structured method of reasoning, supporting a principled approach to the admissibility of evidence at the trial stage and its evaluation at the judgment stage. The lack of consistent, robust reasoning in the case law of the ICC on evidence issues has resulted in reasoning contradictions, exposing it to criticism. Fairness, transparency, and legitimacy have been compromised, particularly as the principle of free evaluation of evidence, is conceptually incompatible with the prosecutorial burden of proof. However, it continues to be regarded as a safeguard of the presumption of innocence, even during the weighing process at the end of the trial. The book proposes a bespoke evidence law for the ICC: one that is neither transplanted from national legal orders nor eclectic in design, but uniquely crafted to meet the specific needs of each case. It offers legal scholars, judges, prosecutors, and practitioners a comprehensive analysis of the conceptual misunderstandings that affect evidentiary reasoning at the Court. It argues that a principled approach to evaluating international criminal evidence is essential for developing a consistent body of evidence law for International Criminal Tribunals.

What is the relationship between the earliest Gospel-Mark-and the first congregational letters of the apostle Paul? Heidrun E. Mader provides a comprehensive overview of the relationship between the Pauline epistles and the Gospel of Mark. She addresses several themes that Paul and Mark treat in similar ways and integrates them into a consistent overall picture. The following themes are addressed: the universalistic concept of the gospel; the integration of gentiles in Christ; the place of the Torah in early Christian community life; the central role of the cross. Mader shows that there are specific and exclusive similarities between Paul and Mark that go beyond commonalities with other ancient writings. However, the results do not necessarily suggest direct literary dependence. Pauline theology could also have been transmitted orally, especially if we accept the hypothesis that Mark lived in Rome, where he could have encountered Paul himself in the early 60s.

Legal pluralism in Muslim contexts /

Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. In A Dialogue between Haizi's Poetry and the Gospel of Luke Xiaoli Yang offers a conversation between the Chinese soul-searching found in Haizi's (1964-1989) poetry and the gospel of Jesus Christ through Luke's testimony. It creates a unique contextual poetic lens that appreciates a generation of the Chinese homecoming journey through Haizi's poetry, and explores its relationship with Jesus Christ. As the dialogical journey, it names four stages of homecoming-roots, vision, journey and arrival. By taking an interdisciplinary approach-literary study, inter-cultural dialogue and comparative theology, Xiaoli Yang convincingly demonstrates that the common language between the poet Haizi and the Lukan Jesus provides a crucial and rich source of data for an ongoing table conversation between culture and faith.
