Legal pluralism in Muslim contexts /

Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. However, academic historians and anthropologists usually take little notice of them. This volume takes a comparative look at local historical writing. Based on an assessment of the extensive oriental collections in the Leiden University Library, the various sewing techniques, constructions and the application of covering materials are described in great detail. A comparative analysis of the historic treatises on bookbinding provides further insight into the actual making of the Islamic book. In addition, it is demonstrated that variations in time and place can be established with the help of distinctive material characteristics. Karin Scheper's work refutes the perception of Islamic bookbinding as a weak structure, which has generally but erroneously been typified as a case-binding. Instead, the author argues how diverse methods were used to create sound structures, thus fundamentally challenging our understanding of the Islamic bookbinding practice. Karin Scheper has been awarded the De La Court Award 2016 by The Royal Netherlands Academy of Arts and Sciences for her study of the bookbinding tradition in the Islamic world.

Today, most intellectuals agree that (a) Christianity has profoundly influenced western culture; (b) members from different cultures experience many aspects of the world differently; (c) the empirical and theoretical study of both culture and religion emerged within the West. The present study argues that these truisms have implications for the conceptualization of religion and culture. More specifically, the thesis is that non-western cultures and religions differ from the descriptions prevalent in the West, and it is also explained why this has been the case. The author proposes novel analyses of religion, the Roman 'religio', the construction of 'religions' in India, and the nature of cultural differences.
