Undesirable but Unreturnable Migrants: the Challenges of Dealing with Criminal Migrants in Need...

: This book studies how States regulate the situation of migrants in need of international protection who have a criminal background or pose a threat to public order. Regulating the situation of these migrants is a challenge to States, which may sometimes resort to measures that violate human rights. The book thus evaluates the solutions applied, identifying best practices and suggesting a possible human rights compliant solution for this situation.

Comparative Literature: Theory, Method, Application /

: This book serves several purposes, all very much needed in today's embattled situation of the humanities and the study of literature. First, in Chapter One, the author proposes that the discipline of Comparative Literature is a most advantageous approach for the study of literature and culture as it is a priori a discipline of cross-disciplinarity and of international dimensions. After a Manifesto for a New Comparative Literature, he proceeds to offer several related theoretical frameworks as a composite method for the study of literature and culture he designates and explicates as the systemic and empirical approach. Following the introduction of the proposed New Comparative Literature, the author applies his method to a wide variety of literary and cultural areas of inquiry such as Literature and Cultural Participation where he discusses several aspects of reading and readership (Chapter Two), Comparative Literature as/and Interdisciplinarity (Chapter Three) where he deals with theory and application for film and literature and medicine and literature, Cultures, Peripheralities, and Comparative Literature (Chapter Four) where he proposes a theoretical designation he terms inbetween peripherality for the study of East Central European literatures and cultures as well as ethnic minority writing, Women's Literature and Men Writing about Women (Chapter Five) where he analyses texts written by women and texts about women written by men in the theoretical context of Ethical Constructivism, The Study of Translation and Comparative Literature (Chapter Six) where after a theoretical introduction he presents a new version of Anton Popovic's dictionary for literary translation as a taxonomy for the study of translation, and The Study of Literature and the Electronic Age (Chapter Seven), where he discusses the impact of new technologies on the study of literature and culture. The analyses in their various applications of the proposed New Comparative Literature involve modern and contemporary authors and their works such as Dorothy Richardson, Margit Kaffka, Mircea Cartarescu, Robert Musil, Alfred Döblin, Hermann Hesse, Péter Esterházy, Dezsö Kosztolányi, Michael Ondaatje, Endre Kukorelly, Else Seel, and others.

Is the Sublime Sustainable? A Comparative Aesthetics Approach to the Sublime /

: Is the Sublime Sustainable? introduces the key points of debate around the sublime while opening new avenues for future inquiry, especially through its comparative aesthetics approach. In it, you will discover how thinking on the sublime emerged historically and then engage with the recent critical scholarship on the topic, including from the fields of theology, philosophy, and literature. The critiques of the sublime are then expanded in dialogue with perspectives from Japanese aesthetics and art, shaping the argument that what is needed today is a sublime that enriches human lives by cultivating profound, participative relationships.

Critiques : In Defence of Development /

: Critiques presented here in defence of development range across a number of issues, all of which are central to discussions about the desirability or undesirability of this historical process. These include one particular aspect - labour market competition - of the debate about racism, why the reproduction of this ideology is more acute at some historical conjunctures but not others, the same question that can also be asked of the industrial reserve. Equally contentious is the current dominance of populist and postmodern interpretations of rural development, in the misleading guise of new paradigms, the object of which is to exorcise two ghosts: not just development itself, but also Marxist theory about development. Untouchable Bodies, Resistance, and Liberation : A Comparative Theology of Divine Possessions /

: In Untouchable Bodies, Resistance, and Liberation, Joshua Samuel constructs an embodied comparative theology of liberation by comparing divine possessions among Hindu and Christian Dalits in South India. Critiquing the problems inherent in prioritizing texts when studying religious traditions, Samuel calls for the need to engage in body and people centered interreligious learning. This comparative theological reading of ecstatic experiences of the divine in Dalit bodies in Hinduism and Christianity brings out the powerful liberative potential inherent in the bodies of the oppressed, enabling us to identify alternative modes of resistance and new avenues of liberation among those who are dehumanized and discriminated, and to find deeper and meaningful ways of speaking about God in the context of oppression.

Rewriting the ancient world : Greeks, Romans, Jews and Christians in modern popular fiction /

: Rewriting the Ancient World looks at how and why the ancient world, including not only the Greeks and Romans, but also Jews and Christians, has been rewritten in popular fictions of the modern world. The fascination that ancient society holds for later periods in the Western world is as noticeable in popular fiction as it is in other media, for there is a vast body of work either set in, or interacting with, classical models, themes and societies. These works of popular fiction encompass a very wide range of society, and the examination of the interaction between these books and the world of classics provides a fascinating study of both popular culture and example of classical reception.

The Political Economy of South Africa's Post-apartheid Transition : The Rejection of Alternatives to Neoliberalism Critical Reconstructions of Political Economy, Volume 7 /

: South Africa's post-apartheid transition has proven disastrous. It is marked by the emergence of a black elite of enriched capitalists out of the globalisation, neoliberalisation and financialisation of the economy in general and of its Minerals-Energy and Financial Complex in particular. By contrast, inequalities, poverty and failing social provision have persisted. Recent attention has shifted to how this disastrous trajectory was initiated, some suggesting a lack of available alternative policy options at the time of transition. This is shown to be false with a full range of progressive alternatives being rejected with corresponding consequences, from "state capture" to electoral defeat.

Work and Smell : Literature in Comparison /

: Literature responds and contributes to the ways in which societies imagine their condition in general and economic life in particular. However, the weighty contribution made by smell motifs to the literary evaluation of working lives has remained underexplored. Work-related smells play an important role in contexts of social inclusion and exclusion, and they can impact strongly on the scope and limits for the fulfillment of needs at work and its surroundings. As emotionally powerful devices, olfactory motifs are also used imaginatively to counter culturally habitualised views on work. The book explores four issues which underpin the nexus of smell and work in literature: the social othering of smelly workers, a sense of social belonging mediated by smell, negative health effects of smelly work environments, and work-related smell in ambivalent contexts of sensual indulgence. The chapters cover European, American and Asian texts and also open up new perspectives for comparative studies.

Religious identity and national heritage : empirical-theological perspectives /

: In some parts of our world, religion is on the wane, losing its thrust of doctrinal authority and communal bonds. In other regions, it is gaining public significance as a powerful social, cultural and political force. Secularization theories are less successful in accounting for these differences in religion's role. Other theories describe religion in terms of social capital to be invested whenever it offers certain personal, social or political benefits and market opportunities allow smart choices. Still other theories simply hold that religion corresponds to an inborn need or stable disposition that guarantees a culture's identity and reflects a natural equilibrium of social cohesion. There are also critical theories that point to the intrinsic relationship of religion with power and identify it as a major cause of tension and conflict. In this book distinguished scholars reflect on these questions and present empirical research about religious identity and national heritage.

Handbook of Scientology /

: The Handbook of Scientology brings together a collection of fresh studies of the most persistently controversial of all contemporary New Religions. In recent years, increasing scholarly attention has been directed at the Church of Scientology, resulting in a small tsunami of new scholarship. We have finally reached a point in time where a book on Scientology need not restrict itself to basics. Thus, for example, the historical chapters in the present volume are not really aimed at providing elementary facts on Scientology's background, but, rather, focus on understanding how the Church of Scientology developed over the years. In short, the Handbook of Scientology will provide a wealth of new information on a topic that one might otherwise have thought exhausted.

Annual Review of the Sociology of Religion. Volume 15 (2024) : Change and Its Discontents. Religious Organizations and Religious Life in Central and Eastern Europe /

: This volume presents a comparative study on the pivotal role of religion in social transformation of Central and Eastern Europe (CEE) over the past three decades. Organized into four thematic sections, it examines divergent patterns of religiosity and non-religious worldviews, secularization, religious presence in public life, and processes of identity formation. Comparison across the countries in the CEE reveals the absence of uniform and synchronic dynamics in the region. The geopolitical and cultural heterogeneity, the need to understand post-1989 social processes in the context of a much longer historical development of the region, and the importance of incorporating religious factors - are central to all contributions in this volume. Contributors are: Mikhail Antonov, Olga Breskaya, Zsuzsanna Demeter-Karászi, Jan Kaňák, Alar Kilp, Zsófia Kocsis, Tobias Koellner, Valéria Markos, András Máté-Tóth, Jerry G. Social identity and sectarianism in the Qumran movement /

: 'Identity' and 'sectarianism', two crucial and frequently used concepts in Qumran studies, are here problematized, appraised, and redefined. Two social-scientific theories inform the investigation of the serakhim (rule documents) and pesharim (commentaries). The sociology of sectarianism is presented in retrospect in order to identify appropriate methodological tools for speaking about sectarianism in the ancient context, and for comparing sectarian stances in the serakhim . Furthermore, a social-psychological perspective into identity is introduced for the first time for appreciating the dynamic and context-dependent nature of a person's social identity. The final chapter takes a fresh approach to the study of the pesharim , arguing for the need to read each Pesher as a whole. It analyses the prototypical 'teacher' and brings forward new interpretations of this captivating and cloudy figure.

The reception of Aeschylus' plays through shifting models and frontiers /

: The Reception of Aeschylus' Plays through Shifting Models and Frontiers addresses the need for an integrated approach to the study and staging of Aeschylus' plays. It offers an invigorating discussion about the transmission and reception of his plays and explores the interrelated tasks of editing, translating, adapting and remaking them for the page and the stage. The volume seeks to reshape current debates about the place of his tragedies in the curriculum and the repertory in a scholarly manner that is accessible and innovative. Each chapter makes a significant and original contribution to its selected topic, but the collective strength of the volume rests on its simultaneous appeal to readers in theatre studies, classical studies, performance studies, comparative studies, translation studies, adaptation studies, and, naturally, reception studies.

The Devotion and Promotion of Stigmatics in Europe, c. 1800-1950 : Between Saints and Celebrities /

: In the nineteenth century a new type of mystic emerged in Catholic Europe. While cases of stigmatisation had been reported since the thirteenth century, this era witnessed the development of the 'stigmatic': young women who attracted widespread interest thanks to the appearance of physical stigmata. To understand the popularity of these stigmatics we need to regard them as the 'saints' and religious 'celebrities' of their time. With their 'miraculous' bodies, they fit contemporary popular ideas (if not necessarily those of the Church) of what sanctity was. As knowledge about them spread via modern media and their fame became marketable, they developed into religious 'celebrities'.

Pesher and hypomnema : a comparison of two commentary collections from the Hellenistic-Roman period /

: In Pesher and Hypomnema Pieter B. Hartog compares ancient Jewish commentaries on the Hebrew Bible with papyrus commentaries on the Iliad . Hartog shows that members of the movement which produced and preserved the Dead Sea Scrolls adopted classical commentary writing and adapted it to their own needs. The connection between the Qumran Pesharim and Hypomnemata on the Iliad resulted from exchanges of scholarly knowledge across Hellenistic-Roman Egypt and Palestine. Analysing the effects of these knowledge exchanges, Pesher and Hypomnema demonstrates that members of the Qumran movement were thoroughly embedded within their Hellenistic and Roman environment.

International Criminal Evidence Law : Legal Traditions in Conflict: Common and Continental Law at the ICC /

: This book examines how the International Criminal Court (ICC) evaluates evidence within its hybrid legal framework, providing a comparative analysis of continental and common law traditions as applied in trial practice. It illustrates how the legal backgrounds of judges influence both conceptual and practical understanding of the prosecutorial burden of proof, the presumption of innocence, and the principle of free evaluation of evidence. These disparities create tensions in the way evidence is assessed. Focusing on key cases such as Bemba , Gbagbo , and Ongwen , the book identifies recurring challenges, including the tendency to confuse procedural rules with the rigorous reasoning process required by evidence law. It challenges the continental assumption that evidence law is merely a set of admissibility rules. It redefines it as a body of law that offers a structured method of reasoning, supporting a principled approach to the admissibility of evidence at the trial stage and its evaluation at the judgment stage. The lack of consistent, robust reasoning in the case law of the ICC on evidence issues has resulted in reasoning contradictions, exposing it to criticism. Fairness, transparency, and legitimacy have been compromised, particularly as the principle of free evaluation of evidence, is conceptually incompatible with the prosecutorial burden of proof. However, it continues to be regarded as a safeguard of the presumption of innocence, even during the weighing process at the end of the trial. The book proposes a bespoke evidence law for the ICC: one that is neither transplanted from national legal orders nor eclectic in design, but uniquely crafted to meet the specific needs of each case. It offers legal scholars, judges, prosecutors, and practitioners a comprehensive analysis of the conceptual misunderstandings that affect evidentiary reasoning at the Court. It argues that a principled approach to evaluating international criminal evidence is essential for developing a consistent body of evidence law for International Criminal Tribunals.
