A partir de l'affirmation, par la Cour internationale de Justice, que les droits de l'homme s'appliquent en période de conflits armés, l'ouvrage explore ce qu'implique cette irruption des droits de l'homme et de leurs mécanismes de surveillance dans un champ qui, pendant longtemps, a été considéré comme exclusivement ou principalement conduit par le droit des conflits armés. Au-delà de l'humanisation de ce dernier, l'approche des conflits en termes de droits subjectifs individuels ou collectifs, opposables aux Etats et justiciables, constitue un vecteur puissant de l'autonomisation et d'autodétermination de l'individu, même dans des contextes de violences généralisées. L'ouvrage vise aussi à présenter les insuffisances et limites du droit international des droits de l'homme pour appréhender les comportements des groupes non étatiques et des organisations internationales par exemple, ou bien encore la réparation intégrale des violations graves et massives. S'appuyant sur une analyse approfondie et comparée de la pratique judiciaire et quasi judiciaire internationale, le cours invite à réfléchir de manière critique au rôle potentiellement préventif, protecteur et transformateur du droit international des droits de l'homme face aux conflits armés.

The first application to the European Commission of Human Rights was received in 1955. In over forty years, the Commission has registered more than 40 000 applications. Its published decisions run to around 150 volumes - 46 in the Collection of decisions (1960 to 1974) and nearly 100 in Decisions and reports (1975 onwards). From this mass of case-law, the authors have distilled the essential elements to produce a one-volume guide to the jurisprudence of the Convention and its protocols. In an article-by-article approach focused on the Court's case-law, they present key, passages from the judgments relevant to each article, putting them in context with their own commentary. The arrangement by article, the extensive extracts from the case-law, the detailed table of contents, and the index give the reader different ways of approaching the book, making it a useful tool for both the newcomer to Convention law and the more experienced researcher. La mobilité des individus à travers le monde les expose à l'intervention désordonnée de multiples régimes juridiques et autorités juridictionnelles. Des incertitudes en résultent, parfois des blocages ou des pesanteurs injustifiées. A travers le droit « international », les pouvoirs politiques ont conçu des modes de coopération entre autorités parallèlement compétentes et d'articulation de leurs points de vue. Ce savoir-faire millénaire permet d'atténuer les risques de désordre et de paralysie au détriment des personnes privées. Sous le concept de cohérence, cet ouvrage étudie les techniques de résolution des conflits de lois, de juridictions ou d'autorités et leur évolution à mesure des transformations du matériau juridique. Non limités aux situations relevant du pur droit privé, ces mécanismes appréhendent aussi les discordances en droit public ou dans les domaines hybrides ; ils n'ignorent pas les régimes juridiques transnationaux et modes privés de règlement des différends (tel l'arbitrage). La cohérence est ici classiquement analysée dans les rapports horizontaux entre sphères juridiques indépendantes, puis dans l'axe vertical lorsque, exceptionnellement, des institutions œuvrent en surplomb des États et permettent, à travers leurs procédures, de questionner la rationalité du droit appliqué aux individus sur la scène mondiale.

This collective volume, in honor of Aharon Layish, deals with the main components in the laws of Islamic societies, past and present: sharīʿa , custom, and statute. Some chapters focus on one of these components, other discuss the interplay between two or even all three of them. The seminar on `Freedom of Association' was held in Reykjavik (Iceland) from 26 to 28 August 1993. It was organised by the Directorate of Human Rights of the Council of Europe in cooperation with the Ministry of Justice of Iceland, and dealt with the following four themes: freedom of association and political democracy; freedom of association and civil society; freedom of association and social democracy; freedom to form and join or not to join trade unions. Written communications were presented on the following subjects: case law of Article 11 of the European Convention on Human Rights, freedom of association and the freedom of associations, freedom of association of immigrants in Europe, freedom of association and public service and freedom of association, labour law and the needs of a democratic society. About one hundred personalities took part: representatives of governments of member States, representatives of non-governmental organisations, members of the European Commission and Court of Human Rights, professors and other interested persons from Central, Western and Eastern Europe competent in the fields covered by the themes of the Seminar. This publication contains the Proceedings of the Seminar: the official speeches made at the opening ceremony, the reports and written communications, the interventions, the final report and the list of participants. Le Séminaire sur la `Liberté d'association' a eu lieu à Reykjavik (Islande) du 26 au 28 août 1993. Il a été organisé par la Direction des Droits de l'Homme du Conseil de l'Europe en collaboration avec le Ministère de la Justice de l'Islande. Les travaux du Séminaire de Reykjavik ont été axés sur les quatre thèmes suivants: liberté d'association et démocratie politique; liberté des associations et société civile; liberté d'association et démocratie sociale; liberté de fonder avec d'autres des syndicats et de s'y affilier. Des communications écrites ont été présentées sur les questions suivantes: jurisprudence de l'Article 11 de la Convention européenne des Droits de l'Homme, liberté d'association et libertés des associations, liberté d'association des immigrés en Europe, liberté d'association et fonction publique et liberté d'association, droit du travail et les besoins d'une société démocratique. Through their work for the protection and realisation of human rights, injustices by authorities are unmasked, public awareness is raised and democratic control is exercised. The colloquy "Protecting and supporting human rights defenders in Europe", held in Strasbourg under the auspices of the Council of Europe, proved an ideal opportunity for frank and constructive exchanges between representatives of civil society and governments from the 46 member states of the Council of Europe on the obstacles encountered by human rights defenders in their work and the responses by the Council of Europe and other international actors to their concerns. This collection of papers addresses two main themes: firstly, whether there is a distinctively European contribution to or even leadership in the contemporary formation and evolution of international law; secondly, the extent to which non-governmental actors (e.g. NGOs, international organizations, companies, individuals) contribute decisively to the formation of international law at the present time. These issues are explored within a number of different contexts of contemporary significance, in particular: the protection of human and minority rights; protection of the environment; control of transnational organized crime; prosecution of war crimes and crimes against humanity; the definition of statehood and the right to self-determination; transnational commercial and economic activity. The discussion is firmly located within the theory of international law and relations and also the continuum of international history. Comparisons are drawn with both global and other regional developments to test the hypothesis of a 'European international law'. The work will be of interest to teachers, students and practitioners (legal and otherwise) in the field of international law and relations.

In order to further scientific knowledge of human rights, the Council of Europe holds high-level meetings, such as colloquies, round tables and seminars. Every five years an important Colloquy on the European Convention on Human Rights takes place in a town of a member State. The Eighth International Colloquy on the European Convention on Human Rights, organised by the Secretariat General of the Council of Europe in collaboration with the Ministry of Justice of Hungary and the Hungarian Institute for Legal and Administrative Sciences, was held in Budapest from 20 to 23 September 1995. This volume contains the Proceedings of the Budapest Colloquy, which covered the following themes: The European Convention on Human Rights and cultural rights 1st session: Cultural rights: universal, indivisible, and legally enforceable rights; 2nd session: Cultural rights and the management of particular situations to ensure democratic security in Europe; The European Convention on Human Rights in the new architecture of Europe 3rd session: Effects on the European Convention on Human Rights of the enlargement of the number of Contracting Parties; 4th session: Implementation of the reform of the European Convention on Human Rights control machinery.
