Maṣlaḥa and the purpose of the law : Islamic discourse on legal change from the 4th/10th to 8th/14th century /

Focusing on writings of legal theory by leading jurisprudents from al-Jaṣṣāṣ (d. 370/980) to al-Shāṭibī (d. 790/1388), this study traces the Islamic discourse on legal change. It looks at the concept of maṣlaḥa (people's well-being) as a method of extending and adapting God's law, showing how it evolves from an obscure legal principle to being interpreted as the all-encompassing purpose of God's law. Discussions on maṣlaḥa's epistemology, its role in the law-finding process, the limits of human investigation into divinecommands, and the delineation of the sphere of religious law in Muslim society highlight the interplay between law, theology, logic, and politics that make maṣlaḥa a viable vehicle of legal change up to the present.

The Gospel "according to Homer and Virgil " cento and canon /

In the fourth century C.E. some Christians paraphrased the stories about Jesus' life in the style of classical epics. Imitating the genre of centos, they stitched together lines taken either from Homer (Greek) or Virgil (Latin). They thus created new texts out of the classical epics, while they still remained fully within the confines of their style and vocabulary. It is the aim of this study to put these attempts into a historical and rhetorical context. Why did some Christians rewrite the Gospel stories in this way, and what came out of this? On the basis of these Christian centos, it is natural to address the view held by some scholars, namely that New Testaments narratives are imitations of the epics.

The Virgin and her Lover : Fragments of an Ancient Greek Novel and a Persian Epic Poem /

Starting from the authors' discovery that the Persian epic poem Vāmiq and ʿAdhrā by ʿUnṣurī (11th century AD) derives from the ancient Greek novel of Mētiokhos and Parthenopē, the book contains critical editions of the Greek and Persian fragments and testimonia, with English translation and comments. The exciting story of the modern recovery of the two texts is told, and the transformations of the productive theme of The ardent lover and the virgin are traced from Greek novel to Persian poem, and through later Persian and Turkish literature. Of particular importance is the authors' attempt to reconstruct the common plot and individual variations, adding a new work to the limited corpus of ancient novels and shedding new light on the genre of Persian epic poetry.

This publication by Muto Kazuo is a significant Christian contribution to the predominantly Buddhist "Kyoto School of Philosophy." Muto proposes a philosophy of religion in order to overcome the claim for Christian exclusivity, as proposed by Karl Barth and others. On such a foundation, he investigates the possibilities for mutual understanding between Buddhism and Christianity. Thereby he engages in a critical exchange with the Kyoto School philosophers Nishida, Tanabe, and Nishitani. Throughout his discourse, Muto applies their method of logical argument (the "dialectic" of soku ) to the dialogue between Christianity and Buddhism. He thus opens up new perceptions of Christian faith in the Asian context and, together with his Buddhist teachers, challenges the modern Western dialectical method of reasoning.

The 'spiritual death' of Jesus : a Pentecostal investigation /

Winner of the Award of Excellence of the Foundation for Pentecostal Scholarship 2010. The teaching of Kenyon, Hagin and Copeland that Jesus 'died spiritually' (JDS) is important because of the influence of these men, not least on Pentecostalism. JDS originated with Kenyon, and has been taught in the Word-faith movement by Hagin and Copeland, despite much criticism. It incorporates three elements: in this death, Jesus was separated from God; partook of a satanic nature; and was Satan's prey. This theological appraisal takes research far further than previous works, both in method and in scope. It concludes that adoption of JDS by Pentecostalism would be damaging in several respects, and thus draw the latter away from its moorings in traditional Christianity. Pentecostals and others are advised to reject the bulk of this teaching.

The original notebook's authorship is unknown, but whoever took the notes did a meticulous job, and the 62 sermons contained in the notebook are nearly all complete. The present work uncovers the pivotal role translations in the periodical Hawar played in the formation of a Kurdish cultural identity. In this light, it foregrounds translators' agency and their contributions in novel contexts and thus fills a crucial gap in this area.This work provides new insights into identity formation, focusing on translations in a key magazine published in a minoritized language in the 1930s and 1940s. In this context, it particularly underscores the agency of Celadet Alî Bedirxan as the leading translator and writer as well as the founder and chief editor of the magazine. His vision of Kurdish cultural identity in Hawar had a multilayered characteristic: It was oriented toward a dialogic relationship between Kurdish and western cultures. It proposed the Roman script for Kurdish language dialects and introduced a simple prose style. It also embraced a plural Kurdish religious aspect and led the way to the development of modern Kurdish literature.

Generative Grammar's Grave Foundational Errors /

This work critically examines Noam Chomsky's widely accepted ontological assumptions-now referred to as "biolinguistics"-and demonstrates that they are internally inconsistent. Notably, Chomsky himself has, at least once, acknowledged this issue. Additionally, we challenge a fundamental claim from Chomsky's linguistic theories of the 1950s: that natural languages, particularly English, operate on constructive (proof-theoretic) grammars, also known as generative grammars. This assertion fails to account for numerous linguistic structures that fall outside its framework. Finally, we scrutinize Chomsky's frequent assertion that "there is essentially only one language on Earth," revealing it to be more rhetorical than substantive. By exposing these foundational flaws, this work calls for a reassessment of key aspects of Chomskyan linguistics.

Several decades ago canonical criticism came to dominate the study of the canon and even indeed all of biblical studies by its emphasis on the biblical canon's dogmatic content. An investigation of this canonical criticism brings its weak points to light: most notably the insufficient attention that is given to the canon's historical development. This new historical study begins with the earliest stages of the process of forming the canon rather than its final stages as most studies do. It shows how the canon, in essence, was already formed in the early stages of its historical development. It is essentially, synchronically, an authoritative unification of a range of traditions within the faith community, and diachronically, the guide that draws the dynamics of these traditions beyond their discontinuities to produce a continuity.

The discovery of the Babatha archive provided scholars with unique opportunities for reconstructing the life of Jews in second-century Arabia. Although legal issues and especially the question of the relationship between Roman and local law have received attention in a number of publications, this study presents the first complete overview of the legal situation as presented in the Babatha as well as the Salome Komaise archive, using references to law in the documents' texts as the key element for understanding what law is applicable to these documents. By distinguishing between two levels in the papyri, of substantive and of formal law, a new understanding is reached of the part both Roman and local law played in legal reality.
