Ignaz Goldziher wrote his book 'Die Zahiriten' in 1883. The English translation of this standard work on Islamic jurisprudence appeared in 1971. The book has been in print ever since. This new edition in the Brill Classics in Islam series shows that The Ẓāhirīs has not lost any of its actuality. The individual that adheres to the principles of madhhab al-Ẓāhir, the Islamic legal school, is called Ẓāhirī. Goldziher gives an extensive presentation of the Ẓāhirīte school, its doctrine and the position of its representatives within orthodox Islam. Ẓāhirism accepts only the facts clearly revealed by sensible, rational and linguistic intuitions, controlled and corroborated by Qurʾānic revelation. This history of Islamic theology sheds light on the Ẓāhirīte legal interpretation vis-à-vis other legal schools and gives an interesting insight in questions like 'are all prescriptions and prohibitions in Islamic law commanded or forbidden?'

The discovery of the Babatha archive provided scholars with unique opportunities for reconstructing the life of Jews in second-century Arabia. Although legal issues and especially the question of the relationship between Roman and local law have received attention in a number of publications, this study presents the first complete overview of the legal situation as presented in the Babatha as well as the Salome Komaise archive, using references to law in the documents' texts as the key element for understanding what law is applicable to these documents. By distinguishing between two levels in the papyri, of substantive and of formal law, a new understanding is reached of the part both Roman and local law played in legal reality.

Enduring exil e the metaphorization of exile in the Hebrew Bible /

During the Second Temple period, the Babylonian exile came to signify not only the deportations and forced migrations of the sixth century B.C.E., but also a variety of other alienations. These alienations included political disenfranchisement, dissatisfaction with the status quo, and an existential alienation from God. Enduring Exile charts the transformation of exile from a historically bound and geographically constrained concept into a symbol for physical, mental, and spiritual distress. Beginning with preexilic materials, Halvorson-Taylor locates antecedents for the metaphorization of exile in the articulation of exile as treaty curse; continuing through the early postexilic period, she recovers an evolving concept of exile within the intricate redaction of Jeremiah's Book of Consolation (Jeremiah 30-31), Second and Third Isaiah (Isaiah 40-66), and First Zechariah (Zechariah 1-8). The formation of these works illustrates the thought, description, and exegesis that fostered the use of exile as a metaphor for problems that could not be resolved by a return to the land- and gave rise to a powerful trope within Judaism and Christianity: the motif of the "enduring exile."

Nawab Faizunnesa's Rupjalal /

Nawab Faizunnesa (1834-1903) challenged established notions regarding women's position in a Muslim society in colonial Bengal. Her RupJalal was the first literary text written by a Bengali Muslim woman. The translated text is placed in the historical context of colonialism and the nationalist movement of colonial Bengal. An analysis of the text is also included in order to invite readers to explore the woman question in context of Islam and/in imperial society. With the translated text, along with a critical overview and textual analysis, this book traces in Faizunnesa's life and works the emergence of a self-conscious female voice by addressing the issues of social, political, and economic marginality of women in an Islamic, nationalist, and imperialist culture of colonial Bengal.

God, beyond me : from the I's absolute ground in Hölderlin and Schelling to a contemporary model of a personal God /

German idealism has attempted to think an absolute ground to self-conscious I-hood. As a result it has been theologically disqualified as pantheistic or even atheistic since many maintain that such a ground cannot be reconciled with a personal God. In the early writings of Friedrich Schelling (1775-1854), it is clear that he and his contemporaries were aware of this difficulty. His Tübinger fellow student, Friedrich Hölderlin (1770-1843), was convinced of the ultimate inadequacy of any philosophical system to grasp the unitary ground of all that is and turned to poetry. The metaphysical insights expressed in his poetry have been largely neglected in both philosophical and theological scholarship. Drawing on the 20th century metaphysics of Dieter Henrich and Karl Rahner, this book elaborates on Hölderlin's poetry. This results in a novel concept of God as both unitary and personal ground of I-hood.

The dynamics of long-term economic growth were temporarily disturbed by the wartime economy while realignment in center-periphery relations affected the local power structure and practices of status management. Meanwhile, the local elite continued to dominate public life, hence the lives of commoners. This study opens a window onto this world through a close examination of the court records of the town.

The Risāla of al-Shāfiʿī (d. 204/820), the earliest preserved work of Islamic legal theory, has been understood in previous scholarship as either the elaboration of a hierarchy of sources of law (Qurʾān, Sunna, consensus, and analogical reasoning) or an extended defense of the Sunna. Through a careful rereading of this celebrated text, this book offers a comprehensive reinterpretation of the Risāla , in which Shāfiʿī formulated an all-encompassing hermeneutic that portrays the law as a tightly interlocking structure organized around defined interactions of the Qurʾān and the Sunna. Topics covered include Shāfiʿī's creative account of the law's architectonics, hermeneutical techniques, legal epistemology, relationship to kalām , and the role of consensus ( ijmāʿ ).

A people tall and smooth-skinned : the rhetoric of Isaiah 18 /

This volume delivers an analysis of the persuasive artistry of Isaiah 18, id est how Isa 18 is designed in order to persuade an ancient audience. The analysis is pursued from four angles: the textual design, the motifs, the rhetoric of the text and finally, it is shown how the various strophes within each stanza of Isa 18 relate to one another. The present analysis demonstrates that Isa 18 is an example of Hebrew rhetoric, and that the text can be read as a coherent whole - even though the majority of scholars analysing Isa 18 have found this chapter confusing. In this volume, it is argued that Isa 18 is shaped in a confusing way in order to make the audience believe that someone else is judged (the Cushites, 18:1-2.7), and not themselves. This volume sheds new light on the understanding of and old text, and the volume is important for exegetes interested in the persuasive artistry of Isa 18.

Prior studies of incubation have approached it from a history of religions perspective, with a view to historically reconstruct the actual practice of incubation in ancient Near East. However, this approach has proven unfruitful, not due to the dearth of relevant data, but because of the confusion with regard to the definition of the term incubation. Suggesting a way out of this impasse in previous scholarship, this book proposes to read the so-called "incubation" texts from the perspective of incubation as a literary device, namely, as a type-scene. It applies Nagler's definition of a type-scene to a literary analysis of two Ugaritic mythical texts, the Aqhatu and Kirta stories, and one biblical story, the Hannah story.

The so-called Sumerian conjugation prefixes are the most poorly understood and perplexing elements of Sumerian verbal morphology. Approaching the problem from a functional-typological perspective and basing the analysis upon semantics, Professor Woods argues that these elements, in their primary function, constitute a system of grammatical voice, in which the active voice is set against the middle voice. The latter is represented by heavy and light markers that differ with respect to focus and emphasis. As a system of grammatical voice, the conjugation prefixes provided Sumerian speakers with a linguistic means of altering the perspective from which events may be viewed, giving speakers a series of options for better approximating in language the infinitely graded spectrum of human conceptualization and experience. This volume covers, for the first time, the interaction of a major historical event with the development of the Egyptian Solar-Osirian theology. Pharaoh Ramesses II visited the sacred area of Abydos soon after his recognition of power at Luxor in Thebes. With him were many high officials, one of whom would be soon appointed to be the high Priest of Amun at Thebes, Nebwenenef. During his visit, the king stressed his personal relationship with his father, Seti I as well as ordering the completion of his temple. By analyzing certain passages within Ramesses' official acccount, the Dedicatory Inscription, with others of Seti, a more nuanced appreciation of the growing theological system of Osirus plus Re, the sun god, comes to the fore. Rather, Euripides' women resort to 'female' ways of talking in order to enable others to understand them and their unique point-of-view. Ever since the Elephantine papyri were first published over a century ago, scholars have speculated on the origins of the well-developed legal formularies used in these documents. Since then, many more Aramaic deeds of conveyance both from Elephantine and from elsewhere have been published, especially within the last decade or so. With this expanded text base now available, the time is ripe for a comprehensive re-assessment of these legal formularies. This book endeavors to show that these disparate Aramaic documents, whose chronological scope spans several centuries, form a discrete and coherent tradition. It isolates and identifies the distinctive elements that form the core of this tradition and traces the histories of these elements back through the cuneiform record.

The Jewish Neo-Aramaic dialect of Challa /

Aramaic has been spoken uninterruptedly for more than 3000 years, yet a generation from now most Aramaic dialects will be extinct. The study of the Northeastern Neo-Aramaic (NENA) dialects has increased dramatically in the past decade as linguists seek to record these dialects before the disappearance of their last speakers. This work is a unique documentation of the now extinct Jewish Neo-Aramaic dialect of Challa (modern-day Çukurca, Turkey). It is based on recordings of the last native speaker of the dialect, who passed away in 2007. In addition to a grammatical description, it contains sample texts and a glossary of the dialect. Jewish Challa belongs to the cluster of NENA dialects known as 'lishana deni' and reference is made throughout to other dialects within this group.
