The reign of al-Muqtadir (295-320/908-32) is a crucial and controversial epoch in the history of the Abbasid empire. Al-Muqtadir's regime has traditionally been depicted as one of decline, when the political power of the caliphate and the lustre of its capital began to crumble. This book not only offers a substantial investigation of the idea and reality of decline, but also provides new interpretations of the inner workings of the court and the empire. The authors, four specialists of Abbasid history, explore the formal and informal power relationships that shaped politics at the court, involving bureaucrats, military, harem, courtiers and of course al-Muqtadir himself. A study of the topography of Baghdad completes this vivid picture of the court and its capital.

Exploring the Mind of God: An Introduction to Shiʿite Legal Epistemology /

This book introduces readers to the legal epistemology that is advocated within Twelver Shiʿite uṣūl al-fiqh (legal theory). It critically surveys the epistemological underpinnings upheld by post-19th century Uṣūlī clerics that impel them to mainly deduce and interpret Sharia using scripture and literalist hermeneutical methods. An evaluation of these underpinnings uncovers the important juxtaposition that exists between the seminarian discourses of uṣūl al-fiqh and philosophy. The book hypothesises that uṣūl al-fiqh has both space and historical precedence to accept alternative epistemological theories that may enable orthodox Shiʿite clerics to display greater dynamism in deducing and interpreting Sharia.

In Malay Court Religion, Culture and Language: Interpreting the Qurʾān in 17th Century Aceh Peter G. Riddell undertakes a detailed study of the two earliest works of Qur'anic exegesis from the Malay-Indonesian world. Riddell explores the 17th century context in the Sultanate of Aceh that produced the two works, and the history of both texts. He argues that political, social and religious factors provide important windows into the content and approaches of both Qur'anic commentaries. He also provides a transliteration of the Jawi Malay text of both commentaries on sūra 18 of the Qur'ān ( al-Kahf ), as well as an annotated translation into English. This work represents an important contribution to the search for greater understanding of the early Islamic history of the Malay-Indonesian world.

This volume presents annotated English translations of 72 court decisions handed down by the the Sharīʿa Courts of Adjābiya and Kufra roughly during the period 1930-1970; the original texts (facsimiles and edited documents) appeared in A.Layish, Legal Documents on Libyan Tribal Society in Process of Sedentarization (Wiesbaden, 1998). The documents address personal status, succession, homicide and bodily injury, property, obligation, and attest to the interaction between the sharīʿa representing normative Islam, and tribal customary law, representing social reality in Cyrenaica during the aforementioned period. They also exemplify the qadi 's role of bringing a Bedouin society within the orbit of normative Islam. A.Borg's essay Orality, Languages, and Culture in Arabic Juridical Discourse addresses cultural aspects of orality on the language of these documents. Anthropology of Law in Muslim Sudan analyses the hybridity of law systems and the plurality of legal practices in rural and urban contexts of contemporary Sudan, shedding light on the complex relation between Islam and society. It is the outcome of the international research program ANDROMAQUE ( Anthropologie du Droit dans les Mondes Musulmans Africains et Asiatiques ), funded by the French ANR ( Agence National de la Recherche ) between 2011 and 2014. Crossing two disciplinary perspectives, anthropology and law, the present volume contains original fieldwork data on contemporary urban and rural Sudan. Breaching the Bronze Wall deals with the idea that the word of honorable Muslims constituted proof and with the concept that written documents and the word of non-Muslims were inferior. Foreign merchants in cities like Istanbul, Damascus or Alexandria could barely prove any claim, as neither their contracts nor their words were of any value if countered by Muslims. Francisco Apellániz explores how both groups labored to overcome these 'biases against non-Muslims' in the courts and markets of Mamluk Egypt and Syria of the 14th and 15th centuries, and how the Ottoman conquest (1517) imposed a new, orthodox view on the problem.
