This volume presents annotated English translations of 72 court decisions handed down by the the Sharīʿa Courts of Adjābiya and Kufra roughly during the period 1930-1970; the original texts (facsimiles and edited documents) appeared in A.Layish, Legal Documents on Libyan Tribal Society in Process of Sedentarization (Wiesbaden, 1998). The documents address personal status, succession, homicide and bodily injury, property, obligation, and attest to the interaction between the sharīʿa representing normative Islam, and tribal customary law, representing social reality in Cyrenaica during the aforementioned period. They also exemplify the qadi 's role of bringing a Bedouin society within the orbit of normative Islam. A.Borg's essay Orality, Languages, and Culture in Arabic Juridical Discourse addresses cultural aspects of orality on the language of these documents. Legal pluralism in Muslim contexts /

Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. The volume is based on papers presented at a conference in Münster (Germany) in 2016 and comprises contributions by Judith Koschorke, Karen Meerschaut, Yvonne Prief, Ulrike Qubaja, Werner de Saeger, Ido Shahar, Katrin Seidel, Konstantinos Tsitselikis, Vishal Vora and Ihsan Yilmaz.

The Technique of Islamic Bookbinding is the first monograph dedicated to the technical development of the bookbinding tradition in the Islamic world. Based on an assessment of the extensive oriental collections in the Leiden University Library, the various sewing techniques, constructions and the application of covering materials are described in great detail. A comparative analysis of the historic treatises on bookbinding provides further insight into the actual making of the Islamic book. In addition, it is demonstrated that variations in time and place can be established with the help of distinctive material characteristics. Karin Scheper's work refutes the perception of Islamic bookbinding as a weak structure, which has generally but erroneously been typified as a case-binding. Instead, the author argues how diverse methods were used to create sound structures, thus fundamentally challenging our understanding of the Islamic bookbinding practice. Karin Scheper has been awarded the De La Court Award 2016 by The Royal Netherlands Academy of Arts and Sciences for her study of the bookbinding tradition in the Islamic world.

Risāla-yi Ḥātimiyya /

Ḥātim al-Ṭāʾī, a pre-Islamic poet from the late sixth century CE, is especially known for his chivalry and magnanimity. A member of the tribe of Ṭayy in Yemen, he is mainly associated with the court of the Lakhmids in Ḥīra in Mesopotamia under king Nuʿmān b. Mundhir (reg. ca. 580-602). His poetry centers around the qualities that earned him his fame, even if part of the poems ascribed to him may be later inventions. Legend has it that his grandfather, who was his guardian, abandoned him when he saw that his grandson's generosity was incurable. Four mourning girls, hewn in stone, lined his grave, together with the cooking pots from which he had served his guests. A popular character in medieval Arabic literature, no separate work was ever dedicated to him, unlike the Persian tradition. The present text on his life and deeds by Wāʿiẓ Kāshifī (d. 910/1504-5) is the oldest to exist in Persian.

Bahāʾ al-Dīn Iṣfahānī (d. 1137/1725), better known as Fāḍil Hindī, was born into a comfortable home in Isfahan. Being a particularly precocious child, he completed his studies in the traditional and the foreign sciences by the age of thirteen, even carrying the title of mujtahid (someone authorized to issue legal opinions in Shīʿī Islam). He then accompanied his father to the court of the Mughal emperor Awrangzīb (r. 1658-1707), where he remained for several years before returning to Isfahan. At a time at which Isfahan was under the spell of the anti-speculative, literalist Akhbārī school in Shīʿism, Fāḍil Hindī was one of the few to engage in philosophy, so much so that one could call him equally a juristic philosopher or a philosophical jurist. The present work is a very readable, complete course in logic and philosophy that bears witness to his originality as a thinker in each of these domains.

Fakhr al-Dīn Rāzī (d. 606/1210) was a prominent theologian, interpreter of the Qurʾān and philosopher. He was born in Rayy where he studied theology, philosophy and law under different masters, including his father, a preacher. After his studies, he started a wandering life which took him to different cities and courts in Transoxania and Khwārazm. He finally settled in Herat where he spent the rest of his life, a wealthy and respected scholar and author of a number of seminal works. Naṣīr al-Dīn Ṭūsī (d. 672/1274) was an influential philosopher, theologian, mathematician and astronomer, besides being the first director of the famous observatory at Marāghah near Tabriz as well as a man of politics. Author of a large number of scholarly works, his influential commentary on Rāzī's Muḥaṣṣal on philosophical theology is a critical appraisal of a work which Ṭūsī considered much overrated. Facsimile of the oldest known copy, dated 669/1270.
