Order and Compromise questions the historicity of government practices in Turkey from the late Ottoman Empire up to the present day. With critical reference to Eisenstadt's theory of "multiple modernities," Muslim Subjectivities in Global Modernity discusses the role of religion in the modern world. The case studies all provide examples illustrating the ambition to understand how Islamic traditions have contributed to the construction of practices and expressions of modern Muslim selfhoods. In doing so, they underpin Eisenstadt's argument that religious traditions can play a pivotal role in the construction of historically different interpretations of modernity. At the same time, however, they point to a void in Eisenstadt's approach that does not problematize the multiplicity of forms in which this role of religious traditions plays out historically. Consequently, the authors of the present volume focus on the multiple modernities within Islam, which Eisenstadt's theory hardly takes into account.

The current view among Western scholars of Islam concerning the early development of Islamic jurisprudence was shaped by Joseph Schacht's famous study on the subject published 50 years ago. Since then new sources became available which make a critical review of his theories possible and desirable. This volume uses one of these sources to reconstruct the development of jurisprudence at Mecca, virtually unknown until now, from the beginnings until the middle of the second Islamic century. New methods of analysis are developed and tested in order to date the material contained in the earliest compilations of legal traditions more properly. As a result the origins of Islamic jurisprudence can be dated much earlier than claimed by Schacht and his school.

Dr. 'Abd al-Razzāq al-Sanhūrī (1895-1971) is one of the most prominent jurists to emerge to date in the Arab world. His alarm at the growing social gap in his country, Egypt, during the first half of the twentieth century, fueled his vision of establishing moral social order by means of a new civil code. Although Sanhūrī's chosen tool was the legal text, this book argues that his vision was essentially a social one: to introduce the principles of compassion, solidarity and fairness, alongside progress and pragmatism, into polarized Egyptian society, whereby property laws acquired a social function, the laws of partnership were perceived as having an educational value, and contract law was activated as a balance favoring the weaker members of society. Accordingly, this book examines the drafting of the Egyptian Civil Code, exposing the hitherto unknown sociological strata of this act of legislation.

How did the Tocharians reach China? "Who did they meet on the way?" are some of the most intriguing questions in Indo-European studies. This book is zooming in on a specific part of the question: on their way to China, Tocharians were in contact with an Iranian people living in the south Siberian Steppes, and with a people related to the Oxus Civilization (BMAC). This Iranian people spoke a specific language, called here "Old Steppe Iranian". They gave Tocharians many words, such as mañiye 'servant', etswe 'burden-carrying horse' or 'mule', pāke 'portion, share'. The BMAC-related people gave the Tocharians other words such as etre 'hero' and kercapo 'donkey'. This book reconstructs features of the language of both these peoples, and examines how they influenced the Tocharians. Based on the latest archaeological findings, it also suggests a reconstruction of the chronology and the way the Tocharians followed before entering the Tarim Basin. Winner of the 2nd prize for the best dissertation of the Indogermanische Gesellschaft prize for the best Indo-European studies dissertation.

Die vorgestellten Belegstücke stammen aus unterschiedlichen geographischen Kontexten: a. Städtedreieck Tabriz-Konya-Bagdad; b. persischer Kulturraum; c. Osmanisches Reich. Diese Rollen waren bei Angehörigen von Männerbünden (Sufi-Orden, Futuwwa - und Aḫī -Gruppierungen, Gilden) beliebt. Die Studie untersucht das auf diesen Dokumenten verwendete textliche und ge¬stalterische Vokabular. Neben Passagen aus dem Koran (auch vollständige Abschriften) lassen sich oft Gebete und weitere Texte frommen Inhalts feststellen. Gelegentlich finden sich Hinweise, dass die Dokumente aus heterodoxen Umfeldern stammen. Die Studie unterstreicht ausserdem den hohen kunsthistorischen Wert der vorgestellten Belegstücke, die oft für Angehörige von gesellschaftlichen Eliten angefertigt worden sind. Devotion and Protection in Islam deals with hand-written documents in the scroll format dating from the 14th-19th centuries. These documents can be attributed to various geographic contexts: a. the triangle between the cities of Tabriz, Konya and Baghdad; b. the Persianate world; c. the Ottoman Empire. These scrolls were appreciated by members of different associations ( Männerbünde ; e.g. Sufi orders, Futuwwa and Aḫī groups). This study analyses the textual and ornamental vocabulary applied on the scrolls. The copied texts mostly comprise passages from the Quran and prayers. Certain features suggest that such scrolls were often produced in heterodox environments. Additionally, this study underscores the high art-historical value of these documents, particularly appreciated by members of the ruling elite.

The Epistle of the eloquent clarification concerning the refutation of Ibn Qutayba /

This is an edition of an early Shiite/Fatimid Arabic epistle that includes a controversy pertaining to several issues on Islamic law. Al-Qadi al-Nu'man (d. 363/974), the most famoust jurist of the early Fatimid period refutes the illustious Ibn Qutayba (d. 276/889). In his book Adab al-Katib, Ibn Qutayba claimed that it was enough for civil servants (kuttab) to memorize a few legal formulas in order to be able to effectively do their work without the need of long dissertations on law from jurists. In the introduction to his epistle, al-Nu'man claims that without these dissertations the civil servants would not be able to apply the law correctly. Following this, al-Nu'man launches lengthy dissertations on each one of the succinct formulas listed by Ibn Qutayba. The main argument of al-Nu'man is that the only lawgivers in Islam are the prophet Muhammad and the Imams descendents of Ali (until the seventh Imam).

This is a 14th-century biography of the famous Persian mystic poet and 'Knower of God', Jalāl al-Dīn-e Rūmī, in the form of a large compendium of Sufi-style teaching stories. It was commissioned by a grandson about fifty years after Rūmī's death. The period between 950 and 1150 A.D. is regarded as "turning point in the history of the Islamic Culture" from the Early Islamic to the Late Medieval civilization. What led to the urban decline in between and the later recovery? Ḥ̣arrān and al-Raqqa serve as paradigma for the development in Northern Syria and Northern Mesopotamia. The collapse of the ʿAbbasid state left the region cornered between Buyids, Fatimids and Byzantines to the nomadic tribes not acquainted with urban culture. After 1086 A.D., measures undertaken by the Seljuqs in order to safeguard their hegemony led to a renaissance of cities inspite of permanent power struggles and the crusades. They based their rule on fortified places. The financing of the army led to the distribution of land as fiefs ( iqtaʿ ) and subsequently to a dislodgement of nomads and a recultivation of former agricultural land. Cash money for the treasury was generated by skimming long distance trade; this in turn required public security on the roads. An analysis of the monetary circulation according to archaeological and literal evidence serves as measure for the economic recovery. A corpus of the coin production in al-Raqqa, ḥarrān and al-Ruha'/Edessa supplements the textual sources.
