Retraçant la généalogie des textes utilisés par le mufti provincial, Aykan étudie aussi la circulation de diverses interprétations juridiques de la Grande Syrie à la Transoxiane et la Horde d'Or, et leur intégration dans la pratique juridique ottomane. Ce livre offre ainsi une approche renouvelée et historicisée des acteurs et hiérarchies de systèmes juridiques de ce cadre provincial. In Rendre la justice à Amid , Yavuz Aykan analyses the legal life of the city of Amid, the capital of Ottoman Diyarbekir province in the 18th century. Making use of court records from the cities of Amid, Harput and Mardin, he explores the centrality of the qadi, the provincial governor, and the provincial mufti to law enforcement. By tracing the genealogies of legal texts used by the mufti for fatwa production, Aykan maps out the broader transformations of various judicial interpretations in their journey from Greater Syria to Transoxiana and the Golden Horde, and finally into Ottoman legal praxis. As such, this book offers a far more historicized approach to the multiple actors and hierarchies of juridical systems operating in this provincial setting.

En dehors d'analyses de type sociologique, les déclamations latines n'ont généralement que peu retenu l'attention des spécialistes de l'Antiquité. Pourtant, ces discours fictifs constituaient le couronnement de l'éducation rhétorique et un élément central de l'activité littéraire. De ce fait, ils appartiennent de plein droit au domaine de la littérature antique. Ce livre veut mieux faire connaître les déclamations latines et leur fonction dans le système éducatif romain. Il s'attache à mettre en lumière leur littérarité, en analysant les techniques narratives mises en œuvres et en soulignant leurs liens avec la poésie et le roman. L'ouvrage se penche également sur la question des rapports que ces textes entretiennent avec la réalité et sur celle de la pertinence de leur utilisation comme sources historiques. Il en ressort une réévaluation des déclamations, susceptible de susciter un nouvel intérêt pour ce genre littéraire majeur de l'Antiquité. The Latin declamations have, except for sociological analysis, drawn but little attention from specialists of Antiquity. However, these fictional discourses represented the highlight of the rhetorical education and were a central element in literary activity. This book strives to draw the Latin declamations and their role in the Roman educational system from the shadows. It will bring to light their literary nature and underline their ties with poetry and the novel. It also investigates the relation between these texts and reality and the pertinence of their use as historical sources. The result is a revaluation of the declamations, liable to provoke a new interest in this major literary genre of Antiquity.

Comment prévoir l'inconnu et contrôler l'inattendu ? Les Anciens ont tenté de répondre à ces questions en interprétant des signes dans lesquels il reconnaissaient des messages divins. Ce recueil permet de comparer la diversité de leurs questionnements dans les sociétés polythéistes ou monothéistes de la Méditerranée antique. Il interroge premièrement la construction rituelle des signes au sein des institutions divinatoires ; deuxièmement, des phénomènes naturels spontanés, qui, apparus hors de toute institution, ont néanmoins valeur de présages ou d'avertissements ; troisièmement, l'intentionnalité manifestée à travers l'intervention divine dans l'histoire des peuples ou les vies singulières ; quatrièmement, l'épistémologie des signes dans des élaborations philosophiques ou théologiques qui éclairent la tension entre données oraculaires et contrôle ritualisé des signes, entre données révélées et argumentations raisonnées visant à neutraliser les injonctions du destin. How to foresee the unknown and master the unexpected? Ancient people tried to answer those questions by interpreting signs considered as divine messages. In this volume, the writers compare and examine this manifold questioning in the polytheistic and monotheistic societies of the ancient Mediterranean Sea. In the first place, it is shown how signs were ritually constructed within instituted practice of divination ; second, how, although some spontaneous natural phenomena appeared out of any instituted context, may nevertheless constitute omens or monition ; third, how the gods' intervention may reveal a sort of intention in the course of national history or individual life ; finally, the essays study the epistemology of signs at work in some philosophical or theological elaborations, which may enlighten the tension between oracular evidence and ritual control of signs, and between revealed facts and reasoning arguments intending to neutralize the injunctions of the divine.
