This project presents in three volumes the Mishnah's and the Tosefta's first division, Zera'im (Agriculture), organized in eleven topical tractates, together with a systematic history of the law of Zeraim in the Mishnah. To the exposition of the Halakhah on the chosen topic, the Mishnah-tractates are primary but complemented by the Tosefta's presentation of its collection of glosses of the Mishnah's law and supplements to that law. The Mishnah's and the Tosefta's tractates are integrated, with the Tosefta's complement given in the setting of the Mishnah's rules, and the whole is given in English translation. The presentation in each case encompasses an introduction, a form-analytical translation and commentary, a systematic integration of the Tosefta's compositions into the Mishnah's laws, an explanation of the details of the law, and an inquiry into how the Halakhah of the Mishnah and that of the Tosefta intersect, item by item.

In Palestine, family law is a controversial topic publicly debated by representatives of the state, Sharia establishment, and civil society. Yet to date no such law exists. This book endeavors to determine why by focusing on the conceptualization of gender and analyzing "law in the making" and the shifts in debates (2012-2018). In 2012, a ruling on khulʿ -divorce was issued by the Sharia Court and was well received by civil society, but when the debate shifted in 2018 to how to "harmonize" international law with Islamic standards, the process came to a standstill. These developments and the various power relations cannot be properly understood without taking into consideration the terminology used and redefined in these debates.

Who speaks for Islam? To whom do Muslims turn when they look for guidance? To what extent do individual scholars and preachers exert religious authority, and how can it be assessed? The upsurge of Islamism has lent new urgency to these questions, but they have deeper roots and a much longer history, and they certainly should not be considered in the light of present concerns only. The present volume - grown out of an international symposium at the Free University, Berlin in 2002 - is not so much concerned with religious authority , but with religious authorities , men and women claiming, projecting and exerting religious authority within a given context. It addresses issues such as the relationship of knowledge, conduct and charisma, the social functions of the schools of law and theology, and the efforts on the part of governments and rulers to organize religious scholars and to implement state-centred hierarchies. The volume focuses on Middle Eastern Muslim majority societies in the period from the eighteenth to the twentieth centuries, and the individual papers offer case studies elucidating important aspects of the wider phenomenon. Individually and collectively, they highlight the scope and variety of religious authorities in past and present Muslim societies. This book is also available in paperback .
