Mālik and Medina : Islamic legal reasoning in the formative period /

This book studies the legal reasoning of Mālik ibn Anas (d. 179 H./795 C.E.) in the Muwaṭṭa' and Mudawwana . Although focusing on Mālik, the book presents a broad comparative study of legal reasoning in the first three centuries of Islam. It reexamines the role of considered opinion ( ra'y ), dissent, and legal ḥadīths and challenges the paradigm that Muslim jurists ultimately concurred on a "four-source" (Qurʾān, sunna , consensus, and analogy) theory of law. Instead, Mālik and Medina emphasizes that the four Sunnī schools of law ( madhāhib ) emerged during the formative period as distinctive, consistent, yet largely unspoken legal methodologies and persistently maintained their independence and continuity over the next millennium.

Unveiling modernity in twentieth-century West African Islamic reforms /

In this book Ousman Kobo analyzes the origins of Wahhabi-inclined reform movements in two West African countries. Commonly associated with recent Middle Eastern influences, reform movements in Ghana and Burkina Faso actually began during the twilight of European colonial rule in the 1950s and developed from local doctrinal contests over Islamic orthodoxy. These early movements in turn gradually evolved in ways sympathetic to Wahhabi ideas. Kobo also illustrates the modernism of this style of Islamic reform. The decisive factor for most of the movements was the alliance of secularly educated Muslim elites with Islamic scholars to promote a self-consciously modern religiosity rooted in the Prophet Muhammad's traditions. This book therefore provides a fresh understanding of the indigenous origins of "Wahhabism."

Narrative analogy in the Hebrew Bible : battle stories and their equivalent non-battle narratives /

This volume sheds fresh light upon the phenomenon of narrative doubling in the Hebrew Bible. Through an innovative interdisciplinary model the author defines the notion of narrative analogy in relation to other literatures where it has been studied such as English Renaissance drama and makes extensive critical use of contemporary literary theory, particularly that of the Russian formalist Vladimir Propp. His exploitation of narrative doubling, with a focus upon the metaphorical, reorients our reading by uncovering a major dynamic in biblical literature. The author examines several battle reports and demonstrates how each could be interpreted as an oblique commentary and metaphor for the non-battle account that immediately precedes it. Battle scenes are revealed to stand in metaphoric analogy with, among others, accounts of a trial, a rape, a drinking feast, and a court-deliberation. Joshua Berman offers new insights to the ever-growing concern with the relationship between historiography and literary strategies, and succeeds in articulating a new aspect of biblical ideology concerning human and divine relationship.

It does so by focusing on the learning trajectories, knowledge disseminating activities, and class interactions of the women, showing that they involve themselves in a variety of activities to stay continuously engaged, and that this is a way of becoming pious. The book makes evident that this becoming is dependent on the embeddedness of the individual in a web of relations to both this- and otherworldly others. In the Arab world, people belong to kinship groups (lineages and tribes). Many lineages are named after animals, birds, and plants. Why? This survey evaluates five old explanations - "totemism," "emulation of predatory animals," "ancestor eponymy," "nicknaming," and "Bedouin proximity to nature." It suggests a new hypothesis: Bedouin tribes use animal names to obscure their internal cleavages. Such tribes wax and wane as they attract and lose allies and clients; they include "attached" elements as well as actual kin. To prevent outsiders from spotting "attached" groups, Bedouin tribes scatter non-human names across their segments, making it difficult to link any segment with a human ancestor. Young's argument contributes to theories of tribal organization, Arab identity, onomastics, and Near Eastern kinship.

Making use of a unique methodology of comparison between Islamic and Jewish sources, Mazuz convincingly argues that the Jews of Medina were Talmudic-Rabbinic Jews in almost every respect. Their sages believed in using homiletic interpretation of the Scriptures, as did the sages of the Talmud. On many halakhic issues, their observations were identical to those of the Talmudic sages. In addition, they held Rabbinic beliefs, sayings and motifs derived from the Midrashic literature.

Writing the Wayward Wife is a study of rabbinic interpretations of sotah, the law concerning the woman suspected of adultery (Numbers 5:11-31). The focus of the book is on interpretations of sotah in tannaitic and amoraic texts: the Mishnah, Tosefta, Midrash Halakhah, Midrash Aggadah, and the Palestinian and Babylonian Talmuds. The body of the work is in-depth analysis of the legal and ritual proceedings. Jewish Greek interpretations (Josephus, Philo, and LXX) also are addressed, along with the Protevangelium of James , and fragments from the Dead Sea Scrolls and Cairo Geniza. Finally, the disappearance of the ritual is discussed, with implications for the development of rabbinic authority. In previous secondary literature, the law of sotah has been understood as either proto-feminist or misogynist. This book argues that neither of these are appropriate paradigms. Rather, this book identifies the emergence of two major interpretive themes: the emphasis on legal procedures, and the condemnation of adultery.

Through a radical rereading of Isaiah, Paul appropriates these prophetic oracles as prefigurations of his own mission to Gentiles while simultaneously appealing to Isaiah as a witness to God's continuing fidelity to Israel. The book examines each of Paul's citations and allusions to Isaiah, situating them both within the milieu of early Jewish interpretive practices and within the context of Paul's unfolding argument in Romans.
