The Conceptualization of Equality and Non-discrimination as Legal Standards : From Formal to More Substantive Equality /

: This book provides an in-depth analysis of the central concepts figuring in equality and non-discrimination standards across jurisdictions: formal and substantive equality, direct and indirect discrimination, reasonable accommodation, affirmative action and intersectional discrimination. It explains how different conceptualizations matter and may result in different outcomes in legislation, case law and policies. In doing so it draws on examples from a wide variety of sources, including the European, Inter-American and global human rights systems and the jurisprudence of the apex courts in Canada, India, South Africa and the US. This study also shows how the conceptualization of equality has been moving overall from formal to more substantive equality.

The capacity to be displaced : resilience, mission, and inner strength /

: The experience of displacement is shared by people who work internationally. The capacity to be displaced is a necessary strength and skill for people working across cultures, particularly for missionaries. In order to deal with the stressful nature of displacement people need to be resilient, resilience makes people flourish in adverse circumstances. This volume presents a specific type of resilience, namely "resilience nourished by inner sources." Cultivating inner resilience draws on all the facets of a person's interior life: thoughts and memories, hopes and desires, beliefs and convictions, concerns and emotions. The notion of inner strength and resilience from within is developed using many examples from missionaries and development workers as well as case studies from all over the world.

Between orality and literacy : communication and adaptation in antiquity /

: The essays in Between Orality and Literacy address how oral and literature practices intersect as messages, texts, practices, and traditions move and change, because issues of orality and literacy are especially complex and significant when information is transmitted over wide expanses of time and space or adapted in new contexts. Their topics range from Homer and Hesiod to the New Testament and Gaius' Institutes , from epic poetry and drama to vase painting, historiography, mythography, and the philosophical letter. Repeatedly they return to certain issues. Writing and orality are not mutually exclusive, and their interaction is not always in a single direction. Authors, whether they use writing or not, try to control the responses of a listening audience. A variable tradition can be fixed, not just by writing as a technology, but by such different processes as the establishment of a Panhellenic version of an Attic myth and a Hellenistic city's creation of a single celebratory history.

Histories of the Middle East studies in Middle Eastern society, economy and law in honor of A.L. Udovitch /

: For four decades Abraham L. Udovitch has been a leading scholar of the medieval Islamic world, its economic institutions, social structures, and legal theory and practice. In pursuing his quest to understand and explain the complex phenomena that these broad rubrics entail, he has published widely, collaborated internationally with other leading scholars of the Middle East and medieval history, and most saliently for the purposes of this volume, taught several cohorts of students at Princeton University. This volume is therefore dedicated to his intellectual legacy from a uniquely revealing angle: the current work of his former students. The papers in this volume range chronologically from the period preceding the rise of Islam in Arabia to the Mamluk era, geographically from the Western Mediterranean to the Western Indian Ocean and thematically from the political negotiations of Christian and Islamic Mediterranean sovereigns to the historiography of Western Indian Ocean port cities.

International Institutional Law : Seventh Revised Edition /

: This seventh, revised edition of International Institutional Law covers the most recent developments in the field. Although public international organizations such as the United Nations, the World Trade Organization, the World Health Organization, the African Union, ASEAN, the European Union, Mercosur, NATO and OPEC have widely divergent objectives, powers, fields of activity and numbers of member states, they also have many institutional characteristics in common. There is unity within diversity. Rather than being a handbook for specific organizations, the book offers a comparative analysis of the institutional law of international organizations. It includes chapters on the rules and practices concerning membership, institutional structure, decision-making, financing, legal order, supervision and sanctions, legal status and external relations. The books theoretical framework and extensive use of examples from practice is designed to appeal to both academics and practitioners.

La Ciotat in the Age of Steam (1836-1916) : The Messageries Maritimes and the Making of an Industrial Maritime Society /

: La Ciotat, a small port-town in the French Mediterranean, underwent a profound metamorphosis during the nineteenth century. Once a small maritime community, it was transformed into the technical base and shipbuilding centre of the Compagnie des Messageries maritimes , France's largest steam navigation company. This book charts the journey of a maritime society through its industrial grown and discovers its economic, demographic, labour, and social changes. Drawing on unpublished archival material, it explores how technological changes and the dominance of a single private shipping company reshaped the town's identity and redefined its relationship with the sea.

Women's agency and rituals in mixed and female Masonic orders /

: Women have been structurally part of the masonic enterprise from at least the middle of the 18th century. Yet, little is known about the ways in which they themselves obtained and exercised power to influence the systems they were involved in, in order to adapt them to be more appropriate to their needs. This volume intends to concentrate on two aspects: Women's agency (i.e. the power women gained and exercised in this context) and rituals (i.e. the role of men and women in changing and shaping the rituals women work with). These two aspects are closely related, since it requires some agency to realise changes in existing rituals.

Flavian Rome : culture, image, text /

: The politics, literature and culture of ancient Rome during the Flavian principate (69-96 ce) have recently been the subject of intense investigation. In this volume of new, specially commissioned studies, twenty-five scholars from five countries have combined to produce a critical survey of the period, which underscores and re-evaluates its foundational importance. Most of the authors are established international figures, but a feature of the volume is the presence of young, emerging scholars at the cutting edge of the discipline. The studies attend to a diversity of topics, including: the new political settlement, the role of the army, change and continuity in Rome's social structures, cultural festivals, architecture, sculpture, religion, coinage, imperial discourse, epistemology and political control, rhetoric, philosophy, Greek intellectual life, drama, poetry, patronage, Flavian historians, amphitheatrical Rome. Science Meets Politics: Machiavelli's Influence and the Birth of Political Science /

: Machiavelli's early influence was more penetrating than has ever been believed, and this book explains why. The surprising answer leads the reader into the depths of the history of science, connecting Machiavelli's thought to new ways of thinking about experience, history, nature, and politics. Machiavelli's works resonated with readers not merely because of the political and moral questions they raised and answered, and this book argues that the ways in which Machiavelli engaged with these questions were of equal importance. His method reinforced the readers' own belief in the importance of an inductive and comparative approach, which relied on facts and numbers drawn from history and experience.

Islamic leadership in the European lands of the former Ottoman and Russian Empires : legacy, challenges and change /

: In Islamic Leadership in the European Lands of the Former Ottoman and Russian Empires the history and contemporary development of Islamic leadership in over a dozen of Eastern European countries is analysed. The studies are presented through a double prism: the institutional structures of the Muslim communities and the place of the muftiates in the current national constellations on one hand, and the dimension of the spiritual guidance emanating from the muftiates on the other. The latter includes aspects such as the muftiates' powers and role in supervision of mosques and other religious institutions, production, dissemination and control of religious knowledge and discussions on traditional and non-traditional forms of Islam engaged in by the muftiates. This is the first comprehensive edited volume on the subject. Contributors are: Srđan Barišić, Ayder Bulatov, Marko Hadjdinjak, Olsi Jazexhi, Memli Sh. Krasniqi, Armend Mehmeti, Dino Mujadžević, Agata S. Nalborczyk, Egdūnas Račius, Aziz Nazmi Shakir, Vitalii Shchepanskyi, Jakob Skovgaard-Petersen, Daša Slabčanka, Aid Smajić, Irina Vainovski-Mihai, Mykhaylo Yakubovych, and Galina Yemelianova.

International Law and Business : Comparative Methods and Global Case Studies /

: This book introduces law in the context of international business. The basics of law are explored using a clear comparative methodology. International and regional economic institutions are discussed, next to the fundaments of private law. These include contract law, liability law, labour law, company law, privacy law, intellectual property law and international private law. The book goes beyond the usual focus on Western legal systems and uses examples from all over the world to provide students with comprehensive knowledge of business law. It is set up rather broadly, so that it can be used by teachers throughout their entire curriculum. Each chapter ends with a clear summary. With its colourful cases, this book is accessible and fun to read.

How Heaven Works : The Collective Shamanic Journeys of Phạm Công Tắc and the Syncretic Afterworld of Caodaism /

: In 1948, Vietnam's great 20th Century mystic Phạm Công Tắc (1890-1959) began a series of sermons making Caodaism's claims to universal salvation the clearest. In only two decades, Caodaism had stamped its fast-growing presence on the nation. With potent creative and poetic skill Phạm Công Tắc invited his co-religionists to take a shamanic journey with him to examine the heavens and literally see how they would be saved. The 35 sermons translated here are provided with a commentary and extensive introduction by Hartney. How Heaven Works is a fascinating insight into the deep connection between shamanic atmosphere, literature, and Modern syncretic concepts of salvation. See Less

The reach of the Assyrian and Babylonian empires. Case studies in Eastern and Western peripheries

: This volume deals with the Assyrian and the Babylonian Empires and seeks to provide new data for the ways that enabled these states to govern efficaciously their vast territories and diverse populations across the ancient Middle East. With both states exerting and distributing power and authority from centre to periphery, the channels through which these were asserted are understood to be of key concern in order to assess the imperial structures. Elucidating the mechanisms of control, especially in view of the always fragile relations between the state centre and remote peripheries, has long been a major subject in the study on ancient empires.0The volume edited by Shuichi Hasegawa and Karen Radner is specifically concerned with tracing the Assyrian and Babylonian Empires? reach into and their hold over their more peripheral regions. The papers collected in this volume cover the period from the 9th to the 6th century BCE and draw on the rich archaeological and textual data that has come to light in old and new excavations and survey projects in Jordan, Iran, Iraq, Israel, Lebanon, Saudi Arabia, Syria and Turkey, and in particular at the Dinka Settlement Complex (Gird-i Bazar and Qalat-i Dinka), the cemetery discovered at Sanandaj, Tel Rekhesh, Tell Ali al-Hajj, Tell Mastuma and Yasin Tepe.

The Glory of the Spirit in Gregory of Nyssa's Adversus Macedonianos : Commentary and Systematic-Theological Synthesis /

: In his commentary on Gregory of Nyssa's Adversus Macedonianos , Piet Hein Hupsch highlights the carefully composed structure of this work and the important connection between its theological, rhetorical and stylistic elements. In his capacity of arbiter fidei , which was bestowed upon him by the Council of Constantinople in 381, Bishop Gregory wrote this circular letter in the form of a counteraccusation against the Pneumatomachi, developing his Trinitarian theology of adoration in which the Spirit occupies a central role. In a systematic-theological synthesis of this work, Hupsch shows how the Spirit draws baptised human beings and human language into the relatio of the three divine persons, the dynamic circle of divine glory of which the Spirit is the personification.
