Mālik and Medina : Islamic legal reasoning in the formative period /

This book studies the legal reasoning of Mālik ibn Anas (d. 179 H./795 C.E.) in the Muwaṭṭa' and Mudawwana . Although focusing on Mālik, the book presents a broad comparative study of legal reasoning in the first three centuries of Islam. It reexamines the role of considered opinion ( ra'y ), dissent, and legal ḥadīths and challenges the paradigm that Muslim jurists ultimately concurred on a "four-source" (Qurʾān, sunna , consensus, and analogy) theory of law. Instead, Mālik and Medina emphasizes that the four Sunnī schools of law ( madhāhib ) emerged during the formative period as distinctive, consistent, yet largely unspoken legal methodologies and persistently maintained their independence and continuity over the next millennium.

On the basis of a newly discovered manuscript this book offers the most comprehensive bibliography of the enormous output of the fifteenth-century scholar Ibn ʿAbd al-Hādī - enlarging our view of his scholarly contribution and correcting numerous mistakes in this regard. This book is thus essential reading for all those interested in the writerly world of Damascus and the scholarly world of the late fifteenth century, especially with regard to the Ḥanbalī tradition and ḥadīth scholarship. In particular, linking the titles of his books with the extant manuscripts in libraries around the world opens new perspectives to these scholarly worlds. The first part of this work includes all the known works of the twelfth-century Andalusi author Ibn Quzmān, most of which are zajal poems composed in the colloquial dialect of Andalus. They have been edited in a Romanized transliteration, and are accompanied by a facing-page English prose translation, along with notes and commentaries intended to elucidate matters relevant to each poem. In the second part of the work, sixteen chapters are devoted to analyzing specific poems from a literary perspective, in order to delve into their meaning and, thereby, explain the poet's literary goals.
