This book examines in depth the degree of compatibility and incompatibility between the general principles and jurisdiction of Islamic law and international criminal law (the Rome Statute). It discusses the controversy related to the non-ratification of the Rome Statute by some Islamic and Arab countries. The author analyses arguments that maintain that Islamic law cannot be compatible with international criminal law, and makes it clear that there are no fundamental differences between the principles of Islamic law and the principles of international criminal law. The scriptural tale in the fourth gospel : with particular reference to the prologue and a syncretic (oral and written) poetics /

A more nuanced view of the Fourth Gospel's media nature suggests a new and promising paradigm for assessing expansive and embedded uses of scripture in this work. The majority of studies exploring the Fourth Evangelist's use of scripture to date have approached the Fourth Gospel as the product of a highly gifted writer, who carefully interweaves various elements and figures from scripture into the canvas of his completed document. The present study attempts to calibrate a literary approach to the Fourth Gospel's use of scripture with an appreciation for oral poetic influences, whereby an orally-situated composer's use of traditional references and compositional strategy could be of one and the same piece. Most importantly, pre-formed story-patterns-thick with referential meaning-were used in the construction of new works. The present study makes the case that the Fourth Evangelist has patterned his story of Jesus after a retelling of the story of Adam andamp; Israel in two interrelated ways: first in the prologue, and then in the body of the Gospel as a whole.

Quantification : transcending beyond Frege's boundaries : a case study in transcendental-metaphysical logic /

In his attempt to give an answer to the question of what constitutes real knowledge, Kant steers a middle course between empiricism and rationalism. True knowledge refers to a given empirical reality, but true knowledge has to be understood as necessary as well, and so consequently, must be a priori. Both demands can only be reconciled if synthetic a priori judgments are possible. To ground this possibility, Kant develops his transcendental logic. In Frege's program of providing a logicistic basis for true knowledge the same problem is at issue: his logicist solution places the quantifier into the position of the basic element connected to the truth of a proposition. As the basic element of a theory of logic, it refers at the same time to something in reality. Mołczanow argues that Frege's program fails because it does not pay sufficient attention to Kant's transcendental logic. Frege interprets synthetic a priori judgments as ultimately analytic, and thus falls back onto a Leibnizian rationalism, thereby ignoring Kant's middle course. Under the title of the transcendental analytic of quantification Mołczanow discusses Frege's concept of quantification. For Frege, the proper analysis of number words and the categories of quantity raises problems which can only be solved, according to Mołczanow, with the help of Kant's transcendental logic. Mołczanow's book thus deserves its places in the series Critical Studies in German Idealism because it provides a further elaboration of Kant's transcendental logic by bringing it into conversation with contemporary logic. The result is a new conception of the nature of quantification which speaks to our time.

With critical reference to Eisenstadt's theory of "multiple modernities," Muslim Subjectivities in Global Modernity discusses the role of religion in the modern world. The case studies all provide examples illustrating the ambition to understand how Islamic traditions have contributed to the construction of practices and expressions of modern Muslim selfhoods. In doing so, they underpin Eisenstadt's argument that religious traditions can play a pivotal role in the construction of historically different interpretations of modernity. At the same time, however, they point to a void in Eisenstadt's approach that does not problematize the multiplicity of forms in which this role of religious traditions plays out historically. Consequently, the authors of the present volume focus on the multiple modernities within Islam, which Eisenstadt's theory hardly takes into account.

This book focuses on iconoclastic controversies and, in particular, their impact on the creation of religious identities. In the history of Jewish, Christian and Muslim culture, religious identity was not only formed through historical claims, but also through the use of certain images: 'images of God', 'images of the others', and 'images of the self.' Moreover, in the struggle for religious identity these 'images' were time and again employed for the purpose of establishing distinct groups, both ortho- dox and deviant. At the same time, they supplied weapons in the theological debate and found explicit expression in certain rituals or liturgical traditions. These conference proceedings include a discussion of the role of images in society, politics, theology and liturgy, in particular addressing the 'iconoclash' of physical, mental and verbal images on the construction of religious identity.

The transition process of the Roman city between the Early Roman period and Late Antiquity is difficult to understand due to the absence of urban models and the decline in epigraphy. The transformations that accompany this period are detectable in the western provinces of the Empire from a very early time. Their interpretation varies with each study case. Ancient Cartagena is a paradigm of these changes. Starting under Marcus Aurelius, the city began to show symptoms of exhaustion, at the same time as literary and epigraphic evidence began to decline, until it disappeared altogether. In these pages the author contributes - and at the same time vindicates - an approach to discovering more about the 2nd and 3rd centuries AD based on the archaeological record and taking into account the stratigraphic sequences and especially the pottery material culture.

In a Mediterranean area characterised by strong seismic activity, the earthquake that struck central Italy in 2016 caused considerable damage to the archaeological and historical heritage. To enrich the existing debates on Islam and sexual diversity, in the present book, I seek the potential discursive spaces on homosexuality in modern Imāmī legal debates. I have undertaken this research on the thesis that modern Imāmī legal tradition on homosexuality is more flexible and dynamic than one might expect. To address this essential issue, I build the study around the following constructive question: what are the discursive spaces on homosexuality in contemporary reflections within modern Shiʿi legal scholarship? Responding to this central query, the study is premised on the notion that Imāmī legal sources consist of a tradition of sacred (textual) sources, intellectual reasoning, a vast stockpile of (often contrasting) interpretations of these sources, and a distinguished methodological repertoire called ijtihad . Following the same methodology, in this work, I describe, analyse, and critique such textual-exegetical and intellectual-rational discursive aspects concerning homosexuality.

Aetiologies seem to gratify the human desire to understand the origin of a phenomenon. However, as this book demonstrates, aetiologies do not exclusively explore origins. Rather, in inventing origin stories they authorise the present and try to shape the future. This book explores aetiology as a tool for thinking, and draws attention to the paradoxical structure of origin stories. Aetiologies reduce complex ambivalence and plurality to plainly causal and temporal relations, but at the same time, by casting an anchor into the past, they open doors to progress and innovation.

The two protagonists, the Professor and the Bureaucrat, each ridicule their opponent in alternating speeches, while at the same time scoring points based on their detailed knowledge of Sumerian lexical and literary traditions. But they also represent the two social roles into which nearly all graduates of the Old Babylonian Tablet House typically gained entrance. So the dialogue also reflects on larger themes such as professional identity and the nature of scholastic activity in Mesopotamia in the Old Babylonian period (ca. 1800-1600 BCE).

Cannibalism in the linear pottery culture : the human remains from Herxheim /

The Herxheim enclosure, located in the German region of Palatinate, is one of the major discoveries of the last two decades regarding the Linear Pottery Culture, and probably one of the most significant in advancing understanding of how this culture ended. The spectacular deposits, mostly composed of human remains, recovered on the occasion of the two excavation campaigns carried out on the site, grabbed people's attention and at the same time raised several questions regarding their interpretation, which had so far mostly hesitated between peculiar funerary practices, war and cannibalism. The authors provide here an extensive study of the human remains found at Herxheim, focusing mainly on those recovered during the 2005-2010 excavation campaign.

Entrenched in the myth of being victim of the Nazi aggression, Austrian elites pursued a politics of memory that symbolically shook off any responsibility for the emergence, development and consequences of National Socialism. Authors of the vast majority of films produced early after 1945 were not interested in dealing with the recent Nazi past of their country. There were, however, exceptions. Through detailed analysis of the narratives, stylistic patterns and reception of films that were set during or immediately after World War II, this book explains how cinema corroborated Austrian national self-stereotypes, at the same time offering a critique of the Nazi regime.
