What is good, and what God demands : normative structures in Tannaitic literature /

: The normative rhetoric of tannaitic literature (the earliest extant corpus of rabbinic Judaism) is predominantly deontological. Prior scholarship on rabbinic supererogation, and on points of contact with Greco-Roman virtue discourse, has identified non-deontological aspects of tannaitic normativity. However, these two frameworks overlook precisely the productive intersection of deontological with non-deontological, the first because supererogation defines itself against obligation, and the second because the Greco-Roman comparate discourages serious treatment of law-like elements. This book addresses ways in which alternative normative forms entwine with the core deontological rhetoric of tannaitic literature. This perspective exposes, inter alia, echoes of the post-biblical wisdom tradition in tannaitic law, the rich polyvalence of the category mitzvah, and telling differences between the schools of Akiva and Ishmael.

4QMMT : reevaluating the text, the function, and the meaning of the epilogue /

: This book focuses on the third section of one of the most important documents from the Qumran library, the epilogue of 4QMMT. It re-evaluates the textual basis for this section, and analyses how the epilogue functions as a part of the larger document. In addition to addressing the structure and genre of 4QMMT, this volume analyzes the use of Scripture in the epilogue in order to illuminate the theological agenda of the document's author/redactor. Although this book's primary focus is on the epilogue, the results of this investigation shed light on 4QMMT as a whole.

Former Yugoslavia Through Documents : From its dissolution to the peace settlement: Part 2 /

: From the end of the 1980s and beginning of the 1990s onwards, the world's attention has been occupied with the events which eventually led to the dissolution of the Socialist Federal Republic of Yugoslavia and to the creation of five independent and sovereign states. Apart from the humanitarian disaster and the devastated economies of the countries created on the territory of the former Yugoslavia, it brought some important issues of international law to the forefront, and provided the impetus for some new and rapid developments. The book is an epilogue to the first, very successful, collection Yugoslavia through Documents: from its creation to its dissolution , published by Martinus Nijhoff Publishers in 1994. However, because of the complexity of the issues in the political, military, humanitarian and legal fields, its structure is different. The book is divided into an Introduction and nine Parts, each of them dealing with specific issues and containing, where appropriate, the Editor's note, comment or additional information. These two volumes constitute an absolutely essential collection for all research libraries.

Primeval histor y Babylonian, biblical, and Enochic : an intertextual reading /

: Most cultures have myths of origin. The Babylonians were the first to combine blocks of traditions about primeval time into primeval histories where humans had a central role. In the first millennium there were different versions that influenced the concepts of primeval history within Jewish religion, both in the Bible and in the parallel Enochic tradition. Atrahasis and the traditions of primeval dynasties had crucial impact on Genesis; the traditions of the primeval apkallus as cosmic guardians were lying behind the Enochic Watcher Story. The book offers a comprehensive analytic comparison between the images of primeval time in these three traditions. It presents new interpretations of each of these traditions and how they relate to each other.

The Formation of the Classical Tafsīr Tradition : The Qurʾān Commentary of al-Thaʿlabī (d. 427/1035) /

: This work is both an introduction to the genre of classical tafsīr and a detailed study of one of its major architects, al-Thaʿlabī (d. 427/1035). The book offers a detailed study of the hermeneutical principles that governed al-Thaʿlabī's approach to the Qurʾān, principles which became the norm in later exegetical works. It is divided into three main sections; the first outlines the life and times of the author; the second is a detailed study of his major exegetical work, al-Kashf ; the third charts a brief history of the genre of tafsīr through documenting the reactions of later exegetes to al-Kashf. This work brings together material never examined before and tries to offer a new way of understanding the history of classical Qurʾān exegesis.

The lower stratum families in the Neo-Assyrian period /

: This pioneering study wrestles with the perpetual problem of the structure of the Neo-Asssyrian society. Part I of this volume surveys all 446 Lower Stratum families in the period under review (800-600 B.C.), mentioned in 177 texts, mainly legal transactions, administrative records, court decisions, and letters. It also examines the terminology, the formulation of the texts, and the status of these families. Part II of this volume considers socio-economic and demographic issues, including family types, family size, marriage patterns, childless families, single-parent families, and more. It is the most important and the most responsible study of the lower stratum of Neo-Assyrian society proposed to date, and it will be the point of departure of every study of this field in the future.

Economics of an Islamic economy /

: This book challenges the interventionist stance of Islamic economics as well as its presumption that riba equals interest. An Islamic economy, it argues, is essentially a market economy, but it differs from capitalist economies because both its institutions and the structure of, for example, property rights are specifically Islamic, deriving from Qurʾān and other sources of Islamic law. The book also focuses on the similarities and differences between riba and interest, establishes the often neglected connection between the two, and explores the ramifications of this connection for Islamic financial systems.

Life at the bottom of Babylonian societ y servile laborers at Nippur in the 14th and 13th centuries, B.C. /

: Life at the Bottom of Babylonian Society is a study of the population dynamics, family structure, and legal status of publicly-controlled servile workers in Kassite Babylonia. It compares some of the demographic aspects proper to this group with other intensively studied past populations, such as Roman Egypt, Medieval Tuscany, and American slave plantations. It suggests that families, especially those headed by single mothers, acted as a counter measure against population reduction (flight and death) and as a means for the state to control this labor force. The work marks a step forward in the use of quantitative measures in conjunction with cuneiform sources to achieve a better understanding of the social and economic forces that affected ancient Near Eastern populations.

Reading the human body : physiognomics and astrology in the Dead Sea scrolls and Hellenistic-early Roman period Judaism /

: This study deals with physiognomic and astrological texts from the Dead Sea Scrolls that represent one of the earliest examples of ancient Jewish science. For the first time the Hebrew physiognomic-astrological list 4Q186 (4QZodiacal Physiognomy) and the Aramaic physiognomic list 4Q561 (4QPhysiognomy ar) are comprehensively studied in relation to both physiognomic and astrological writings from Babylonian and Greco-Roman traditions. New reconstructions and interpretations of these learned lists are offered that result in a fresh view of their sense, function, and status within both the Qumran community and Second Temple Judaism at large, showing that Jewish culture in Palestine participated in the cultural exchange of learned knowledge between Babylonian and Greco-Roman cultures.

Islam in South Asia : a short history /

: Islamic South Asia has become a focal point in academia. Where did Muslims come from? How did they fare in interacting with Hindu cultures? How did they negotiate identity as ruling and ruled minorities and majorities? Part I covers early Muslim expansion and the formative phase in context of initial cultural encounter (app. 700-1300). Part II views the establishment of Muslim empire, cultures oscillating between Islamic and Islamicate, centralised and regionalised power (app. 1300-1700). Part III is composed in the backdrop of regional centralisation, territoriality and colonial rule, displaying processes of integration and differentiation of Muslim cultures in colonial setting (app. 1700-1930). Tensions between Muslim pluralism and singularity evolving in public sphere make up the fourth cluster (app. 1930-2002).

Wahhabi Islam facing the challenges of modernity : Dar al-Ifta in the modern Saudi state /

: This book focuses on the history and work of the Saudi Dār al-Iftā, one of the most central modern Islamic official religious institutions. The study was undertaken from two perspectives: (1) Dār al-Iftā creation, power structure, functions and the sociopolitical environment in which it operates; and (2) The actual work of this institution, mainly the mechanisms by which modern Saudi state muftis cope with clashes between Wahhābī idealism and the reality of an evolving society. This is a critical work which updates the readers' grasp of contemporary law and society in the modern Saudi state, in particular, and in Islamic jurisprudence in general.

Song of song s a close reading /

: This book puts forward an interpretation of the Canticle which is alert to the literal sense of the poem. The author thus distances himself both from the allegorical interpretation and from an interpretation that is purely secular. According to the author, the Song offers a theological vision of human love. Barbiero sees the Song as composed in the third century BC, in the Hellenistic epoch, but also as hugely dependent on the love poetry of the Ancient Near East, particularly that of Egypt. Above all, however, the Song was composed in dialogue with the other books of the Old Testament, especially in contrast with the negative view of sexuality which they represent. The study pays particular attention to the structure of the poem and of the individual cantos: for Barbiero, the Song is a closely unitary work and is only to be understood as a whole.

Early Islamic legal theory : the Risāla of Muḥammad ibn Idrīs al-Shāfiʻī /

: The Risāla of al-Shāfiʿī (d. 204/820), the earliest preserved work of Islamic legal theory, has been understood in previous scholarship as either the elaboration of a hierarchy of sources of law (Qurʾān, Sunna, consensus, and analogical reasoning) or an extended defense of the Sunna. Through a careful rereading of this celebrated text, this book offers a comprehensive reinterpretation of the Risāla , in which Shāfiʿī formulated an all-encompassing hermeneutic that portrays the law as a tightly interlocking structure organized around defined interactions of the Qurʾān and the Sunna. Topics covered include Shāfiʿī's creative account of the law's architectonics, hermeneutical techniques, legal epistemology, relationship to kalām , and the role of consensus ( ijmāʿ ).

Living water : images, symbols, and settings of early Christian baptism /

: This general survey of early Christian baptismal iconography and architecture integrates visual depictions and physical settings of baptism with textual evidence for its practice and purpose. An opening overview of pictorial art (paintings, relief sculpture, mosaics, and ivories) prompts questions about components of the actual ritual which are treated in the literary sources. The study's second half considers selected baptismal structures, examining the symbolism, purpose, and possible meaning of their spatial design and decorative programs. In most instances the synthesis of documentary and material evidence is enriching and complementary. However, even when physical and textual data diverge, their discontinuity demonstrates the variability of ritual performance and the perennial distinction between ideal and actual practice..

Frontiers of faith : the Christian encounter with Manichaeism in the Acts of Archelaus /

: Taking as their common subject the key early Christian anti-Manichaean work, the Acts of Archelaus ( Acta Archelai ), the contributors to this volume offer a systematic exploration of what the text has to tell us about inter-religious contact, conflict, and comprehension at a crucial moment in religious history: the encounter between Christianity and Manichaeism along the political and cultural frontier zone of West Asia in the early fourth century CE. The contributions examine the text's structure, apologetic and polemical strategies, and possible sources, and through these analyses challenge received notions of 'orthodoxy' and 'heresy' in the mutual construction of identity that took place between these two claimants to the Christian heritage.

Marriage as a covenant : a study of biblical law and ethics governing marriage, developed from the perspective of Malachi /

: This book focuses on the interpretation of Malachi 2:10-16, which censures the lax marital practice of its contemporaries. In particular, Hugenberger investigates Malachi's identification of marriage as a \'covenant\' in response to recent scholarly challenges to this identification. Taking the issues raised by Malachi as his point of departure, Hugenberger examines the nature of covenant and oath (including verba solemnia and oath-signs), and, in light of these findings, explores the theory of marriage implied elsewhere in the Old Testament. Included in this investigation are an analysis of the concentric literary structure of Malachi and a study of the Old Testament's ethical perspectives on divorce, polygamy, and sexual fidelity. An extensive bibliography and indices complete the book.

State and Peasant in the Ottoman Empire : Agrarian Power Relations and Regional Economic Development in Ottoman Anatolia during the Sixteenth Century /

: State and Peasant in the Ottoman Empire studies the dynamics of Ottoman peasant economy in the sixteenth century. First, it shows that contrary to the conventional wisdom about the 'stationariness'of the Asian agrarian economies, Ottoman peasant economy witnessed substantial growth in response to population increase, urban commercial expansion and to increased taxation demands. Second, the book argues that economic development did not take place independently of political structures, of the state. This meant that in the light of the fiscal and legitimation concerns of the Ottoman state and contrary to the assumptions of the models of economic development, changes in population and in commercial demand did not result in the disruption of the integrity of the small peasant holding as the primary unit of production. The book develops these arguments in the context of a detailed empirical study of the economic trends, of the state rules or institutions that embodied the relations of revenue extraction, and of exchange in Ottoman Anatolia.

The Fall of the Caliphate of Córdoba : Berbers and Andalusis in Conflict /

: This book is a discussion of the complex events which surround the breakup of the Muslim Caliphate of Córdoba in the early eleventh century. The focus of the study concerns quite a short period of time: 1009-1031 A.D., although a wide-ranging investigation of the political structure of Muslim Spain is embarked on. A thorough narrative of the events is followed by separate discussions of some of the main groups involved in the civil wars, the Marwānids (the supporters of a legitimately-appointed Umayyad representative), the saqāliba (Slavs), the Berbers and the Christians of northern Spain. This book is able to fill the gap in our knowledge of this hitherto little-understood period of Spanish history and tackles important questions, such as the attitude towards the Berbers, tribal solidarity and the importance of land-reforms during the 10th century

Religion as a Profession /

: This volume offers a conceptual and empirical study of the religious profession. It takes as its point of departure professionalisation theory that is discussed and applied to a profession in mainstream religion, in this case Dutch Catholic ministry. The book entails a well-documented empirical study of attitudes of clergy and lay personnel in the Dutch Roman-Catholic Church regarding the pastoral profession. Their attitudes towards church authority, apostolicity, sacramental efficacy, accession to the office, and spiritual role are described extensively. The research clarifies the extent to which these religious attitudes act as a positive or negative motif to engage in policies that are aimed at a professional development of the occupation. The book offers an excellent insight into basic characteristics of a religious profession.
