Following profound modifications of Soviet ideology after the coming to power of Gorbachev, Europe experienced an unprecedented time of change which resulted, inter alia, in the unification of the two German States, the abolition of socialist international organizations, the obsolescence of neutrality policies in the New Europe and the pull on the European Communities to admit new members. These revolutionary events give rise to interesting legal questions. Since international relations are changing, the legal framework in which these relations are set has to change, too. In December 1990, international legal aspects of the changes in the political structure of Europe were discussed at a conference held in Amsterdam. In this book, which takes account of the outcomes of the discussions, the international legal framework in which these changes take place and their consequences are described and analyzed by eminent scholars from East and West.

Jewish and Christian communal identities in the Roman world /

Jews and Christians under the Roman Empire shared a unique sense of community. Set apart from their civic and cultic surroundings, both groups resisted complete assimilation into the dominant political and social structures. However, Jewish communities differed from their Christian counterparts in their overall patterns of response to the surrounding challenges. They exhibit diverse levels of integration into the civic fabric of the cities of the Empire and display contrary attitudes towards the creation of trans-local communal networks. The variety of local case studies examined in this volume offers an integrated image of the multiple factors, both internal and external, which determined the role of communal identity in creating a sense of belonging among Jews and Christians under Imperial constraints.

This book examines secessionist entities that arose during and after the dissolution process of the USSR and considers them as legal subjects in their own right. By employing a novel and more innovative approach, the agency of these subjects, otherwise often ignored or disregarded, is taken into account. Drawing on the cases of the South Caucasus, the author suggests going beyond the binary concept of statehood and traditional notions of sovereignty. He advocates embracing an inclusive reading of international law, which enables to foster creative ambiguity vis-à-vis these entities as means of conflict transformation.

Is it true that the forces of technology and interdependence have undermined the sovereignty of modern states? This book argues powerfully that the opposite is true: that over the past quarter century the major industrial states - the US, Britain, France, Germany and Japan - have mostly used these forces, often in novel ways, to pursue national purposes. The nation-state framework has, over that period, remained the basis of legitimate political authority and law. There has been a huge increase in the scope, incidence and detail of state regulation to manage, among other things, both the domestic economy and the effects of transnational flows. International management almost invariably depends upon state consent. The power of the state has never, anywhere, been absolute and its methods of management have always been changeable. But there is no evidence that its managerial effectiveness has, overall, been less in 1995 than in 1975 or 1965. This book therefore takes strong issue with much of the literature on interdependence and international organisation which has appeared in recent times. It is especially useful for those trying to understand the larger framework within which business must operate or the sources of authority for anyone's plan to manage problems of financial or population flows, of transnational conservation problems or of trade. The book will also be of particular use in graduate and senior undergraduate courses in international relations or organisation.

Beleaguered Nation : The Making and Unmaking of the Assamese Nationality /

The multi-ethnic state of Assam emerged to be a minefield of conflict and violence over assertions of autonomy in the 1980s. While the Assamese leaders were fighting a battle against the Bengali and the fear of immigrant Muslim domination after independence, one by one other tribal groups challenged the hegemony of the Assamese and broke free from the state: the Naga, the Khasi-Jyntia, the Mizo and the Arunachalis. They were followed by the Bodos, Dimasas and the Karbis who despite having got their autonomy are still fighting a fierce battle for complete statehood. There is a growing demand for a Ahom and Kamatapur state as well as from the smaller communities like the Rabhas, Hasong, Tiwa, Mishing, Sonowal Kachari, Thangal Kachari and Deuris, and even domiciled Gorkhas which if conceded would reduce the size of the Assamese nationality and Assamese territory to only a few pockets. There are extremist outfits like the United Liberation Front of Assam which saw secession from India as the solution to the problem of Assamese nationality, others like the Karbi National Volunteers, United Peoples Democratic Solidarity, Dima Haloa Daoga (two factions), Kuki National Front and Kuki National Army, Bodo Security Force, National Democratic Front of Bodoland resorted to violence as a mode of their assertions. Unprecedented turbulence, instability, violence, and internal displacement engulfed the entire region creating a severe crisis for the Indian state. Submerged in this ethnic cauldron, the Assamese were indeed a beleaguered nation fighting for survival amidst such multiple ethnic challenges. This book is about contradictions, conflicts, machinations, subversions, nature of state intervention and the intricate process of making and unmaking of Assamese nationality vis-a-vis north east India.
