Women in classical Islamic law : a survey of the sources /

Drawing on legal and ḥadīth texts from the formative and classical periods of Islamic legal history, this book offers an overview of the development of the questions prominent jurists asked and answered about women's issues. All assumed a woman would marry and thus the book concentrates on women's family life. The introduction establishes the historical framework within which the jurists worked. A chapter on Qurʾān verses devoted to women's lives is followed by chapters on marriage and divorce which compare the views of jurists during the formative period. The fourth chapter describes the evolution from the formative to the classical periods. The fifth uses material from both periods to describe the array of legal opinion about other aspects of women's lives in and outside their homes. Throughout, jurists' opinions are juxtaposed with relevant quotations from contemporaneous ḥadīth collections.

In Palestine, family law is a controversial topic publicly debated by representatives of the state, Sharia establishment, and civil society. Yet to date no such law exists. This book endeavors to determine why by focusing on the conceptualization of gender and analyzing "law in the making" and the shifts in debates (2012-2018). In 2012, a ruling on khulʿ -divorce was issued by the Sharia Court and was well received by civil society, but when the debate shifted in 2018 to how to "harmonize" international law with Islamic standards, the process came to a standstill. These developments and the various power relations cannot be properly understood without taking into consideration the terminology used and redefined in these debates.

Women, Islam and Familial Intimacy in Colonial South Asia highlights the rich tradition of protest and defiance among the Muslim women of colonial India. Bringing together a range of archival material including novels, pamphlets, commentaries and journalistic essays, it narrates a history of Muslim feminism conversing with, and confronting the dominant and influential narratives of didactic social reform. The book reveals how discussion about marriage and family evoked claims of women's freedom and rights in a highly charged literary and cultural landscape where lesser-known female intellectuals jostled for public space alongside well-known male social reformers. Definitions of Islamic ethics remained central to these debates, and the book illustrates how claims of social obligation, religious duty and freedom balanced and negotiated each other in a period of nationalism and reform. By doing so, it also illuminates a story of Muslim politics that goes beyond the well-established accounts of Muslim separatism and the Pakistan movement.

In A Social History of the Late Ottoman Women: New Perspectives , Duygu Köksal and Anastasia Falierou bring together new research on women of different geographies and communities of the late Ottoman Empire. Who speaks for Islam? To whom do Muslims turn when they look for guidance? To what extent do individual scholars and preachers exert religious authority, and how can it be assessed? The upsurge of Islamism has lent new urgency to these questions, but they have deeper roots and a much longer history, and they certainly should not be considered in the light of present concerns only. The present volume - grown out of an international symposium at the Free University, Berlin in 2002 - is not so much concerned with religious authority , but with religious authorities , men and women claiming, projecting and exerting religious authority within a given context. It addresses issues such as the relationship of knowledge, conduct and charisma, the social functions of the schools of law and theology, and the efforts on the part of governments and rulers to organize religious scholars and to implement state-centred hierarchies. This book investigates various forms of women's resistance to male domination, as represented in Kuwaiti women's fiction. Drawing on Marxist-feminist literary theory, it closely analyses selected texts (published between 1953 and 2000), which reflect the effects of patriarchal culture and tradition on race, class, and gender relations in Kuwait and the Arabian Gulf region in general. It argues that the selected texts portray the pre-oil generations of Kuwaiti/Arabian Gulf women-born before or in the first half of the twentieth century-as resistant and/or revolutionary figures, contrary to the common notion of their stereotypical passivity and submissiveness. This book demonstrates how Kuwaiti women writers have used literature to work for, and contribute to, social change.

Alexander histories and Iranian reflections : remnants of propaganda and resistance /

Alexander the Great's military campaign to conquer the Achaemenid empire included a propaganda campaign to convince the Iranians his kingship was compatible with their religious and cultural norms. This campaign proved so successful that the overt display of Alexander's Iranian and Zoroastrian preferences alienated some of his Greek and Macedonian allies. Parivash Jamzadeh shows how this original propaganda material displayed multiple layers of Iranian influences. Additionally she demonstrates that the studied sources do not always offer an accurate account of the contemporary Iranian customs, and occasionally included historical inaccuracies. One of the most interesting finds in this study is the confusion of historical sources that arose between the opponents Darius III and Alexander. Jamzadeh argues that the Iranian propaganda regarding Alexander the Great has contributed to this confusion.
