Legal issues of personal status - including those implicating women's rights - continue to be a focal area of shari'a judicial practice in the Muslim world. Changing ideas of marriage, relations between the spouses, divorce, and the rights of divorcees and widows challenge the courts around the Arab world. In this context, the areas that came under the Palestinian Authority in 1994 command particular attention: the particular political and socio-economic circumstances that surround Palestine's progress toward full statehood have created a remarkable crucible for the synthesis of a new family law in the Arab world. This rigorous study of the interpretation and application of personal status law in the Palestinian West Bank (and to a lesser extent in the Gaza Strip) is the most extensive yet attempted. It presents a systematic analysis of the application of Islamic family law in nearly 10,000 marriage contracts, 1000 deeds of talaq (unilateral divorce) or khul' (divorce with renunciation), and 2000 judicial rulings over a time span that includes Jordanian rule and Israeli military occupation, updating this with material from the beginning of the jurisdiction of the Palestinian Authority. Taken into account are the sources of law used in the shari'a courts of the West Bank: the successive codes of family law (the Jordanian Law of Personal Status 1976 and its predecessor the Jordanian Law of Family Rights 1951), and traditional Hanafi rules and texts, along with commentaries by prominent contemporary shari'a scholars and Appeal Court decisions - as well as the amendments and modifications being sought by civil society actors (notably women's groups) in the West Bank and Gaza Strip, as well as in Jordan.

This book is about the articulation of ethics in the QurʾÄn and the tafsÄ«r tradition. Based on an examination of several apparently problematic QurʾÄnic narrative pericopes and how the exegetes grappled with them, the book demonstrates that the moral world of the QurʾÄn is polyvalent and non-linear, owing, above all, to its intrinsic ethical antinomies and textual ambiguities. That is, the book contends that paradox and uncertainty are both constituents of the QurʾÄn's ethical architectonics, and that through these constituents the QurʾÄn charts a system of ethics that seeks to tread in the midst of a non-ideal world rife with uncertainty. The book also argues that the tafsÄ«r tradition tends to erode the hermeneutical openness of the QurʾÄn and, thereby, limits the QurʾÄn's ethical potential. The book, thus, advances our understanding of QurʾÄnic ethics and contributes to the field of tafsÄ«r studies and to the scholarship on QurʾÄnic hermeneutics.

The Hexaemeron of Anastasius of Sinai (late 7th-early 8th c.) expounds the creation account and the Adam and Eve story as foreshadowing the mystery of Christ and the Church, an idea that goes back to Origen and beyond. The commentary remained unpublished in Greek until 2007, received only scattered attention, and has been often considered as apocryphal. In this book, the first of its kind in any language, Dimitrios Zaganas firmly establishes its authenticity, investigates its genesis and date, offers detailed analysis of its numerous sources, and studies its distinctly allegorical approach to Genesis 1-3. Several emendations of the Greek text are suggested in the appendix. L' Hexaemeron d'Anastase le Sinaïte (fin VIIe-début VIIIe s.) traite du récit de la création et de l'histoire d'Adam et Ève comme préfigurant le mystère du Christ et de l'Église, une idée qui remonte à Origène et au-delà. Le commentaire est resté inédit en grec jusqu'en 2007, n'a reçu qu'une attention distraite et a été souvent considéré comme apocryphe. Dans cet ouvrage, le premier consacré à l'Hexaemeron, Dimitrios Zaganas établit fermement son authenticité, examine sa genèse et sa datation, propose une analyse détaillée de ses nombreuses sources et étudie son approche clairement allégorique de Genèse 1-3. This monograph endeavors to chart the development of kalām and Islamic philosophy during the early modern Maghreb. The primary focus is on the Moroccan thinker Ibn Yaʿqūb al-Wallālī (d. 1716) and his text Ashraf al-Maqāṣid fī Sharḥ al-Maqāṣid. It sheds light on al-Wallālī's contribution to Islamic philosophy by examining his interpretation of some topics in epistemology, metaphysics, and physics. It also involves the reception of al-Rāzī's (d. 1210) and al-Taftāzānī's (d. 1390) works in the Maghreb. The book attempts to offer a re-evaluation of the prevailing claims in the scholarship that has dominated the region, asserting that the engagement with Islamic philosophy in the Maghreb continued beyond the time of al-Sanūsī (d. 1490).
