Tradition in Social Science is the social philosophy written early in life by the jurisprudent who became the preeminent public law jurist in France in the first quarter of the twentieth century, Maurice Hauriou. His work remains prominent in theorizing European Community as well as in Latin American jurisprudence. His studies concern three areas of research: legal theory, social science, and philosophy. In this book Hauriou first focuses on the object and method of the social sciences in a preliminary chapter. The main text is devoted first to a philosophy of history that uses the growth objectively in fraternity, liberty and equality as the criterion for progress; and next to the subjective elements of progress, namely, the recognition of a "pessimistic individualism" in which failure in conduct is to be expected, but is rectified by social institutions. This part closes with the dynamizing of his philosophy of history by evolution and alternation between two phases of social development, namely, middle ages and renaissances. The second part is the philosophy of social science built around social matter, where the dynamic of imitation is the motive force, and three social networks-positive, religious, and metaphysical-specify its consequences. The last of these, the political fabric, is provided with a final chapter of its own. The main doctrinal device that Hauriou developed for use in law was his theory of the institution; this is developed for the first time in the present work.

Sharīʻa and the Islamic state in 19th-century sudan : the Mahdi's legal methodology and doctrine /

The Sudanese Mahdī headed a millenarian, revivalist, reformist movement in Islam, strongly inspired by Salafī and Ṣūfī ideas, in late 19th century in an attempt to restore the Caliphate of the Prophet and "Righteous Caliphs" in Medina. As the "Successor of the Prophet", the Mahdī was conceived of as the political head of the Islamic state and its supreme religious authority. On the basis of his legal opinions, decisions, proclamations and "traditions" attributed to him, an attempt is made to reconstruct his legal methodology consisting of the Qurʾān, sunna , and inspiration ( ilhām ) derived from the Prophet and God, its origins, and its impact on Islamic legal doctrine, and to assess his "legislation" as an instrument to promote his political, social and moralistic agenda.

The central aim of the investigation is to evaluate the claim that the Gospel of John was a product of a 'sectarian' milieu. Fuglseth is using methods primarily derived from sociology and the study of new religious movements today. He discusses in particular the 'cult'-model as an alternative to 'sect,' and compares the Johannine texts with texts from two contemporary milieus: Philo and the Dead Sea Scrolls. The thesis is embedded in a comprehensive survey of research and discussions of methods and of the existence of a Johannine community. There are still serious debates going on about the existence and nature of the Johannine group, its 'Jewish' roots and settings, the attitude to the 'Jews' and the 'synagogue', and the two levels of meanings in the Johannine text according to Martyn and Brown. In this situation Fuglseth's investigation is of great current interest and gives new answers to central questions in the Johannine research.

Volp's study focuses on the surviving literary sources-both pagan and Christian-, together with inscriptions and other archaeological remains while taking into account recent results from science and humanities. A summary of death and ritual in the ancient Mediterranean religions is followed by detailed analyses of the Christian sources from the 2nd to the 5th century. Thus, basic developments are being discovered which led to and accompanied the forming of Christian rituals, such as ritual purity or the social structure of family and society. Being the first such interdisciplinary approach, it also represents the first monographic work on the topic since 1941.

In recent and contemporary scholarship, the deacon as a leader in the Early Church is an often-neglected subject. This book focuses on the roles and functions of the deacon in Augustine's literary output. The author's approach is detailed and appropriately cautious and is always attentive to the text. He analyses Augustine's way of commenting on deacons and how the bishop of Hippo wrote about them, as well as his manner of preaching on saints and martyrs who were deacons. The book thus provides a new perspective on the early deacons who were not social workers, but go-betweens or intermediaries between the bishop and his flock, between the Scriptures and daily life, and between Church and society. He emphasises in particular how deacons were epistle bearers responsible for the world wide web of Early Christianity.
